HomeMy WebLinkAboutVR-96-0000 - Decision - 0397 Patchen RoadSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 12th day of August, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Robert Beauchemin and Frank Cota, 397 Patchen Road, this meeting was also attended by Donna Purcell and Esther Lotz. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question is zoned R-4 District. 2) The existing uses are non -conforming and are under variances dating back to 1967. 3) The proposed use sale of used furniture is allowed within the Commercial I District. Existing uses are also allowed within the Commercial I District. 4) The property contains 1.13 acres and is developed with three (3) principal structures. 5 ) The structure in question is occupied with retail uses and contains approximately 7000 square feet of leasable floor area. The proposed use will occupy approximately 3700 square feet of floor area. Conclusion 1) The proposed use is more conforming with existing uses. Light manufacturing is out of character with the surrounding. 2) Hardship created by change is uses granted over the years by the City. 3) The character of the area northerly of Kirby Road is developed with commercial uses to include the City Highway Department and C.S.W. re -cycle center. 4) Improvements as proposed by the applicant would be aesthetically pleasing to the area. 5) Traffic generated by the proposed use would change, no heavy equipment or large trucks will operate from the area. 6) Proposed use is the highest and best use of the property. Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicant a variance to operate a retail use (sale of used furniture and other miscellaneous merchandise) loca at 97 Patchen Road. ,1 i , .
