Re: Sign Application of John Martin: 1525 Shelburne Road
Dear Ray,
This letter follows up on the sign application that I submitted yesterday on behalf of my
client, John Martin relative to the property located at 1525 Shelburne Road. You informed
me today by phone that the existing free-standing sign that Mr. Martin intends to attach his
sign to is already a non -conforming use because it is higher than the 15 foot height limit
allowed for free-standing signs under the sign ordinance. As such, you further informed
me that if Mr. Martin desires to install his free-standing sign as shown in the application,
the overall height of the free-standing sign would need to be reduced by 25%. Finally, you
informed me that under the current sign ordinance, all non -conforming signs will need to
come into compliance on or before June 3, 2009.
Given the non -conformity of the existing free-standing sign, we would like to withdraw
that portion of the sign application without prejudice. This will leave Mr. Martin free to
decide how he would like to proceed in the future with the free standing sign. We ask that
you continue to proceed with the wall sign portion of the application.
As we discussed, I had provided you with a check in the amount of $96.00, representing
the fees for the application for site plan review and for each of the two signs that were
included in the original sign application. Given the withdraw of the sign application with
respect to the free-standing sign, you suggested that I resend you two separate checks for
each of the two applications. Accordingly, enclosed please find two separate checks, one
in the amount of $86.00 for the Site Plan Review and the other in the amount of $5.00 for
the sign application. Would you please return the original $96.00 check to me.
