Be it resolved by the Planning Commission of the City of
South Burlington that:
WHEREAS, on March 7, 1989 the Planning Commission approved
the Final Plat amendment application of Summerwoods Associates
for subdivision of a 15.11 acre parcel on Patchen Road into two
lots of 14.79 and 0.32 acres, and construction of a 38 unit
planned residential development on the 14.79 acre parcel; and
WHEREAS, the approved Final Plat described above is recorded
in book 252, pages 131 and 132 of the South Burlington land re-
cords; and
WHEREAS, pages 2 and 3 of the Final Plat clearly indicate
the proposed conveyance of a 3.2 acre parcel of land lying east
of the centerline of the brook to the adjoining property owner to
the east, Tygate properties; and
WHEREAS, this issue of conveyance was presented to and
discussed with the Planning Commission during the various public
hearings on this application; and
WHEREAS, the Planning Commission reviewed and approved the
Final Plat amendment with the full understanding that the 3.2
acre parcel was to be conveyed to the adjoining property owner to
the east;
NOW, THEREFORE, the Planning Commission hereby approves the
proposed conveyance of the 3.2 acre parcel of land lying east of
the centerline of the brook as shown on the Final Plat as record-
ed in book 252, pages 131 and 132, of the South Burlington land
records.
