HomeMy WebLinkAboutAD-99-0000 - Decision - 0011 Bay Crest DriveSOUTH BURLINGTON ZONING BOARD OF ADJUSTMENT Re: William & Nancy Jacobus STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Request for variance I I Baycrest Drive Findinas of Fact, Conclusions of Law & Order , �)' 60 () This matter came before the South Burlington Zoning Board of Adjustment on December 28, 1998 by application of William & Nancy Jacobus, represented by Attorney Neil Wheelwright for a variance to adjust a boundary line which creates a side yard (easterly line) of nine feet seven inches (9.7 feet) also establishes a westerly side yard of nine feet seven inches which results from the original placement of the structure at I I Baycrest Drive according to plans submitted. The Board of Adjustment finds as follows: 1) 11 Baycrest Drive is zoned Residential 4 District. 2) Section 25.00 Dimensional requirements, requires a minimum side yard of ten (10) feet. 3) The structure in question was constructed in 1985 by Ireland Industries. 4) Original developer adjusted boundary lines without State or local permits. 5) Errors with property lines discovered by recent title search. 6) Adjustment of boundary lines does not alter the character of the neighborhood. 7) The appellants were not involved in any way with the placement of the structure and not aware of a problem. 8) Removal of stairs from rear dick creates a minimum variance that affords relief ORDER The variance to adjust a easterly boundary line at I I Baycrest Drive is hereby GRANTED Dated at City Hall, South Burlington, Vermont this L7 5- day of 1999 Fred Blais, Chairman South Burlington Zoning Board of Adjustment JAN 2 5 1999
