Especially if plan is used for lot description in their deed. Memorandum - Planning March 24, 1998 agenda items March 20, 1998 Page 2 Coverage/setbacks: Building coverage is 29.9% (maximum allowed is 30%). Overall coverage is 68.7% (maximum allowed is 70%). Front yard coverage is 36.2% (maximum allowed is 30%). This is the same as previously approved. Setback requirements are being met. Landscaping The minimum landscaping requirement, based on building costs, is $107,500 which is being met. The previously approved plan was $10,110 short of this requirement. Additional landscaping was added to meet the minimum requirement. Parking: The revised plan proposes to reduce the number of parking spaces by 33 spaces. The 12/7/96 approval granted a 223 space or 6.6% waiver. The current proposal requires a total of 3379 spaces and provides 3127 spaces which is a 252 space or 7.5% shortfall. This represents a parking ratio of 5.1 spaces per 1000 square feet GLA. Staff feels this should be adequate. 5 ) MARY ANN HEGEMAN - 3 LOT SUBDIVISION - FINAL PLAT This project consists of subdividing a 50,003 square foot parcel into three (3) lots of 10,967 square feet (lot #1), 16,013 square feet (lot #2) and 22,023 square feet (lot #3). This property is currently developed with a two (2) family dwelling. The sketch plan was reviewed on 11/11/97 (minutes enclosed). This property located at 316 Patchen Road lies within the R4 District. It is bounded on the north by Kirby Road, on the east and south by single family residences, and on the west by Patchen Road. Access: Access to the existing two (2) family dwelling is provided by a 15 foot curb cut on Patchen Road. Access to lot #1 will be via a curb cut on Kirby Road. Access to lot #2 will be via a curb cut on Patchen Road. Lot size/frontage: Lots #1 and 2 meet the minimum lot size requirement of 9500 square feet for a single family dwelling and lot #3 meets the minimum lot size requirement of 12,000 square feet for a two (2) family dwelling. 2 Memorandum - Planning March 24, 1998 agenda items March 20, 1998 Page 3 Lots #2 and 3 meet the minimum frontage requirement of 100 feet along Patchen Road. Lots # 1 and 3 meet the minimum frontage requirement of 80 feet along Kirby Road. Density: The maximum density allowed on this parcel is four (4) units (4 x 1.15 acres = 4.6). Lot /0AN; t"' #3 is developed with a two (2) family dwelling so lots #1 and 2 can only be developed with single U family dwellings. Sewer: The sewer allocation request is 720 gpd (this includes 20% reduction allowed by State). The``f applicant will be required to pay the per gallon fee prior to permit issuance. Setbacks: The new property lines meet the 10 foot side yard setback requirement from existing buildings. Impact fees: The applicant should be aware that the new houses will be subject to school, road and recreation impact fees. 6) AMY SYLVESTER AVERILL -2 LOT SUBDIVISION - SKETCH PLAN This project consists of the subdivision of a 19.65 acre lot (13.98 acres in South Burlington and 6.34 acres in Shelburne) into two (2) lots of 13.98 acres (lot #1) and 5.67 acres (lot #2). Lot #1 is developed with a single family dwelling. This property lies partially in South Burlington and partially in Shelburne. The new lot being created (lot #2) lies entirely within Shelburne. The City Attorney has ruled that we should treat this subdivision as if it was entirely within the City of South Burlington. This subdivision will be treated as a major subdivision because lot #2 has no road frontage. This property located at 1985 Spear Street lies within the R1 and R2 Districts. It is bounded on the north, west and south by residences and undeveloped land, and the east by residences and Spear Street. Access: Access to lot #1 is provided by a curb cut on Spear Street. Access to lot #2 will be provided by a 20 foot r.o.w. across lot #1 since lot #2 has no road frontage. The metes and bounds information for the r.o.w. should be shown on the final plat. Both lots will share the same curb cut. Patterson Builders, Inc, and Vincent Morin to subdivide a 50,003 sq. ft. parcel into three lots of 11,550 sq. ft. (Lot #1) 16,030 sq. ft. (Lot #2) and 22,423 sq. ft. (Lot #3), 316 Patchen Rd: Mr. Dinklage asked the applicant to address staff comments about the angled lot. Mr. Patterson said the reason the lot was angled was to increase the building envelope to address restrictions brought about by the frontage limitation on Kirby Road. No other issues were raised. 5. Public Hearing: Final Plat application of MBL Associates to amend a previously approved planned residential development in- volving 202.2 acres of land and consisting of 161 single family lots and 60 multi -family units, Dorset Street. The amendment consists of minor boundary adjustments caused by a more accurate survey: Mr. O'Rourke stepped down during this hearing due to a conflict of interest. Mr. Crampton showed the location of the discrepancies in the boundaries. He said these are very small adjustments which caused small adjustments in a few lots ranging from 1 sq. ft. to 7 sq. ft. Mr. Weith said there are no impacts and it is basically the same plan. No questions were raised by the Commission. The Planning Commission may modify the setback under Section 12.406(b) of the zoning regulations. — the minimum landscaping requirement, based on building costs, is $240 which is not being met. The plan should be revised to add the additional landscaping or request a credit for existing landscaping. — submit undated traffic generation analysis to take into account the day care use. — will there be any additonal exterior lighting for the deck? If so, submit details (cut -sheets) for the new lights. UNIVERSITY MALL REALTY TRUST - SITE MODIFICATION - REVISED FINAL PLAT — the revised plan results in an increase in front yard coverage of 262 square feet and an increase in C.O. Zone coverage of 350 square feet. Staff recommends that there be no increase in coverages in these two (2) areas. — the revised plan proposes to reduce the number of parking spaces by 33 spaces. The 12/7/96 approval granted a 223 space or 6.6% waiver. The current proposal requires a total of 3379 spaces and provides 3127 spaces which is a 252 space or 7.5% shortfall. Plan approved in 1976 was for 67.2% overall coverage. The Planning Commission can not approve more than 70% coverage. --- plan should show access easement for property at 1795 Williston Road. --- front yard coverage information should be provided. --- provide details (cut -sheets) for all exterior lights. --- note type of screening to be used for dumpster. --- provide additional sewer allocation needed. --- staff counts 18 spaces along the easterly side of the building and the plan shows 17 spaces. --- it appears that fill and a retaining wall will be necessary to construct the new dumpster enclosure, finished contours and details of the retaining wall should be provided. --- indicate size of new ramp and entry. --- applicant should be aware that the road impact fee is approximately $900. The amendment consists of increasing the size of the addition by 96 square feet and minor parking changes. b) Application of Truex Cullins & Partners Architects to construct a 240 square foot accessory building at 30 Community Drive (former Digital building). c) Application of Evergreen Investments, Inc. to convert a portion of a general office building to medical office, 1820 Shelburne Road. All applications were approved. 4) J.K. PATTERSON BUILDERS, INC. & VINCENT MORIN - 3 LOT SUBDIVISION - SKETCH PLAN This project consists of subdividing a 50,003 square foot parcel into three (3) lots of 11,550 square feet (lot #1), 16,030 square feet (lot #2) and 22,423 square feet (lot #3). This property is currently developed with a two (2) family dwelling. Memorandum - November 11, November 7, Page 2 Planning 1997 agenda items 1997 Lot size/frontage: Lots #1 and 2 meet the minimum lot size of 9500 square feet for a single family dwelling and lot #3 meets the minimum lot size 12,000 square feet for a two (2) family dwelling. Lots #2 and 3 meet the minimum frontage requirement of 100 feet along Patchen Road. Lots #1 and 3 meet the minimum frontage requirement of 80 feet along Kirby Road. Density: The maximum density allowed on this parcel is four (4) units (4 x 1.15 acres = 4.6). Lot #3 is developed with a two (2) family dwelling so lots #1 and 2 can only be developed with single family dwellings. Sewer: The final plat submittal should include the sewer allocation request. Setbacks: The new property lines meet the 10 foot side yard setback requirement from existing buildings. Other: --- the final plat should show the triangle area at the corner of Kirby and Patchen Roads which was to be dedicated to the City as part of the Queensbury Road development. The appropriate legal documents (i.e., offer of dedication, warranty deed, etc.) for this area should be recorded prior to recording the final plat plan. --- staff suggest that the westerly boundary of lot #1 be adjusted so that it is more of a 900 angle with Kirby Road. 5) MBL ASSOCIATES - RESUBDIVISION - REVISED FINAL PLAT This project consists of amending a plan previously approved on 10/12/93 (minutes enclosed) and amended on 5/10/94 and 8/8/85 for a planned residential development involving 202.2 acres of land and consisting of 161 single family lots and 60 multi -family units. The amendment consists of minor boundary adjustments caused by a more accurate survey. The only issue affected by the application is lot size.
