This project, consists of a three lot subdivision. Lot 1, 0.25 acres and Lot 2, 0.37 acres (for the
construction of single family residences). Lot 3, 0.53 acres (with an existing 3 bedroom duplex). All
three lots will utilize municipal water and wastewater disposal services. The project is located off
Patchen Road and Kirby Road, in the City of South Burlington, Vermont and is hereby approved
under the requirements of the regulations named above, subject to the following conditions.
This Permit does not constitute Act 250 approval.
This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from the Act 250 District Environmental Commission, the Department of
Labor and Industry -phone (802) 828-2106 or (802) 658-2199, the Vermont Department
of Health - phone (802) 863-7220, and local officials prior to proceeding with this project.
2. The project shall be completed- as -shown on the plans prepared by Trudell Consulting
Engineers, Inc., (with revisions by Karre Paterson), which have been stamped "approved"
by the Wastewater Management Division.

3. The project shall not deviate from the approved plans without prior written approval from
the Wastewater Management Division.
4. Each prospective purchaser of each lot shall be shown a copy of the approved plot plan and
this Subdivision Permit prior to conveyance of the lot.

This project has been reviewed and is approved for the construction of one, three bedroom,
single family residence on each of the approved lots (Lots 1 and 2). Construction of other
type of building or dwellings, including public buildings, commercial buildings, duplexes, and
condominium units, is not allowed without prior review and approval by the Wastewater
Management Division and such approval will not be granted unless the proposal conforms to
the applicable laws and regulations (Lot 3 is approved with the existing 3 bedroom duplex).
6. The conditions of this permit shall run with the land and will be binding upon and enforceable
against the permittee and all assigns and successors in interest. The permittee shall be
responsible for the recording of this permit and the "Notice of Permit Recording" in the City
of South Burlington Land Records within 30 days of issuance of this permit and prior to the
conveyance of any lot subject to the jurisdiction of this permit.
7. In the event of a transfer of ownership (partial or whole) of this project, the transferee shall
become permittee and be subject to compliance with the terms and conditions of this permit.
8. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose
of ascertaining compliance with Vermont environmental/health statutes and regulations, with
this permit.
9. A copy of the approved plans and this permit shall remain on the project during all phases of
construction and, upon request, shall be made available for inspection by State or local
personnel.
10. Each lot is approved for water supply by connection to the municipal water system. No
other means of obtaining potable water shall be allowed without prior review and approval
by the Wastewater Management Division.

WASTEWATER DISPOSAL
11. Lots 1 and 2 are approved for wastewater disposal by connection to the municipal sewer
system for a maximum of 450 gallons per day per lot. Lot 3 is approved for 450 gallons per
day. No other method of wastewater disposal shall be allowed without prior review and
approval by the Wastewater Management Division, and such approval will not be granted
unless the proposal conforms to the applicable laws and regulations.
12. The building sewer from the proposed houses (Lots 1 an 2), to the main sewer line
shall be less than 100 feet and a straight run with appropriate slope and connection.
Any other type of layout will require a design by qualified consultant and a
application submittal to this office.

The South Burlington Planning Commission a held a meeting on
Tuesday, 24 March 1998 at 7:30 pm, in the Conference Room, City
Hall, 575 Dorset St.
Members Present:

2. Review Minutes of 3 March 1998:
Mr. Teeson noted that he had been present at this meeting.
Ms. Barone moved to approve the, Minutes of 3 March as amended.
Mr. O'Rourke seconded. Motion passed unanimously.
3. Report on recent site plan decision issued by City Planner:
a) Site plan application of Mark J. Rocheleau to amend a pre-
viously approved plan for a 20,000 sq. ft. building for mul-
tiple industrial uses (10,000 sq. ft. for warehouse & whole-
sale business, 3333 sq. ft. for warehouse and 6666 sq. ft.
for light manufacturing). The amendment consists of adding
6100 sq. ft. of mezzanine space resulting in the following use
breakdown: 12,000 sq. ft. for warehouse & wholesale, 5433 sq.
ft. for warehouse and 8666 sq. ft. for light manufacturing.
16 Gregory Drive. APPROVED.
No issues were raised.
4. The applicant for item #4 was not present, so this item was
moved to the end of the agenda.
5. PUBLIC HEARING: Final plait application of Mary Ann Hegeman for
subdivision of a 50,003sc.ft-parcel into three lots of 10,967 sq.
ft., 16,013 sq. ft. and 23,023 sq. ft., 316 Patchen Road:
Ms. Paterson said there have been no changes from Preliminary
Plat.
No issues were raised by the Commission.

Ms. Barone moved the Planninq Commission approve the final plat
application of Mary Ann Hegeman for subdivision of a 50,003 sq
ft. parcel into three lots of 10,967 sq. ft., 16,013 sq. ft., and
23,023 sq. ft., 316 Patrchen Rd, as depicted on a plat entitled
"Subdivision Plat Paterson Builders, Inc, 316 Patchen Road South
Burlington, Vermont" prepared by Trudell Consulting Engineers,
Inc, dated 2/25/98, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The Planninq Commission a'

for lots #1 and 2 (includes 20o reduction allowed by State). The
applicant shall be required to pay the per gallon fee prior to
permit issuance.
3. Any change to the final plat plan shall require approval by
the South Burlington Planninq Commission.
4. The final plat plan shall be recorded in the land records
within 90 days or this approval is null and void. The plan shall
be signed by the Planning Commission Chair or Clerk prior to
recording. Prior to recording the final plat plan, the applicant
shall submit a copy of the survey plat in digital format. The
format of the diaital information shall require approval of the
City Planner.
Mr. Dinklage seconded. Motion passed 5-0 with Mr. Crow
abstaining.
6. Sketch plan application of Amy Sylvester Averill to subdivide
a 19.65 acre lot (13.98 acres in South Burlington and 6.34 in
Shelburne) into two lots of 13.88 acres (lot #1) and 5.67 acres
(lot #2). Lot #1 is developed with a single family dwelling.
This property lies partly in South Burlington and partly in
Shelburne. The lot being created (lot #2) lies entirely within
Shelburne, 1985 Spear Street.
Ms. Averill said the lot is divided by the town line. There is
also an easement to Velco across the lot. The larger parcel has
been her parents' home for 25 years. Lot #2 will be accessed
from the same access as lot #1.
The Commission raised no issues.
The applicant asked for preliminary and final plat to be held
on the same night. The Commission had no objections.

the Airport Parkway Wastewater Treatment Facility which has sufficient capacity to handle this
additional demand.

Coverage/setbacks: Building coverage is 29.9% (maximum allowed is 30%). Overall coverage is
68.7% (maximum allowed is 70%). Front yard coverage is 36.2% (maximum allowed is 30%). This
is the same as previously approved.
Setback requirements are being met.
Landscaping The minimum landscaping requirement, based on building costs, is $107,500 which is
being met. The previously approved plan was $10,110 short of this requirement. Additional
landscaping was added to meet the minimum requirement.
Parking: The revised plan proposes to reduce the number of parking spaces by 33 spaces. The
12/7/96 approval granted a 223 space or 6.6% waiver. The current proposal requires a total of 3379
spaces and provides 3127 spaces which is a 252 space or 7.5% shortfall. This represents a parking
ratio of 5.1 spaces per 1000 square feet GLA. Staff feels this should be adequate.

This project consists of subdividing a 50,003 square foot parcel into three (3) lots of 10,967 square
feet (lot #1), 16,013 square feet (lot #2) and 22,023 square feet (lot #3). This property is currently
developed with a two (2) family dwelling. The sketch plan was reviewed on 11/11/97 (minutes
enclosed).
This property located at 316 Patchen Road lies within the R4 District. It is bounded on the north by
Kirby Road, on the east and south by single family residences, and on the west by Patchen Road.
Access: Access to the existing two (2) family dwelling is provided by a 15 foot curb cut on Patchen
Road. Access to lot #1 will be via a curb cut on Kirby Road. Access to lot #2 will be via a curb cut

Enclosed are the Findings of Fact and Decision for the following
site plan applications:
a) Application of Gary Farrell to amend a recently approved
addition to the Ramada Inn. The amendment consists of
increasing the size of the addition by 96 square feet and
minor parking changes.
b) Application of Truex Cullins & Partners Architects to
construct a 240 square foot accessory building at 30 Community
Drive (former Digital building).
c) Application of Evergreen Investments, Inc. to convert a
portion of a general office building to medical office, 1820
Shelburne Road.
All applications were approved.
4) J.K. PATTERSON BUILDERS, INC. & VINCENT MORIN - 3 LOT
SUBDIVISION - SKETCH PLAN
This project consists of subdividing a 50,003 square foot parcel
into three (3) lots of 11,550 square feet (lot #1), 16,030 square
feet (lot #2) and 22,423 square feet (lot #3). This property is
currently developed with a two (2) family dwelling.
This property located at 316 Patchen Road lies within the R4
District. It is bounded on the north by Kirby Road, on the east
and south by single family residences, and on the west by Patchen
Road.
Access: Access to the existing two (2) family dwelling is provided
by a 15 foot curb cut on Patchen Road. Access to lot #1 will be
via a curb cut on Kirby Road. Access to lot #2 will be via a curb

Lot size/frontage: Lots #1 and 2 meet the minimum lot size of 9500
square feet for a single family dwelling and lot #3 meets the
minimum lot size 12,000 square feet for a two (2) family dwelling.
Lots #2 and 3 meet the minimum frontage requirement of 100 feet
along Patchen Road. Lots #1 and 3 meet the minimum frontage
requirement of 80 feet along Kirby Road.
Density: The maximum density allowed on this parcel is four (4)
units (4 x 1.15 acres = 4.6). Lot #3 is developed with a two (2)
family dwelling so lots #1 and 2 can only be developed with single
family dwellings.
Sewer: The final plat submittal should include the sewer
allocation request.
Setbacks: The new property lines meet the 10 foot side yard
setback requirement from existing buildings.
Other:
--- the final plat should show the triangle area at the corner of
Kirby and Patchen Roads which was to be dedicated to the City
as part of the Queensbury Road development. The appropriate
legal documents (i.e., offer of dedication, warranty deed,
etc.) for this area should be recorded prior to recording the

consisting of 161 single family lots and 60 multi -family units.
The amendment consists of minor boundary adjustments caused by a
more accurate survey. The only issue affected by the application
is lot size.

--- minimum landscaping requirement of $8440 is not being
met.
--- parking requirement is increasing from 96 spaces to 104
spaces and 71 spaces are provided. This is a 33 space or
31.7% shortfall. The Planning Commission on 11/23/76
granted a 19 space or 19% shortfall for a total of 81
spaces.
--- overall coverage is 72% and maximum allowed is 70%. Plan
approved in 1976 was for 67.2% overall coverage. The
Planning Commission can not approve more than 70%
coverage.
--- plan should show access easement for property at 1795
Williston Road.
--- front yard coverage information should be provided.
--- provide details (cut -sheets) for all exterior lights.
--- note type of screening to be used for dumpster.
