The South Burlington Planning Commission held a meeting on
Tuesday, 7 March 1989, at 7:30-pm, in the Conference Room, City
Hall, 575 Dorset St.

Mr. Weith advised the cul de sac has been redesigned to provide 30
ft. of pavement and 5 ft. for snow storage. A note has been added
for extension of the road for future development of the Munson
property. There is also a note for the future curb cut for the
driveway to the Brill property. The plan has been revised to show
the road crown slope of 1/3" per foot, the sidewalk cross slope of
1/4" per foot to the top of the curb, and concrete curbs on all
streets. Wording has been added to the Condo Association rules
giving the city the right to enforce the "no conversion of garage
space to living space" stipulation and to reimburse the city for
legal fees to enforce this. A denser, taller hedge has been pro-
vided along the Brill property. Street trees have been moved from
road pavement around the cul de sac. 89 parking spaces are shown
with 86 required.
A discussion on lighting followed. Members were concerned that
Act 250 has required lights.that cost the city too much to
operate. Messrs. Burgess and Craig felt the applicant should
return to the Commission if this happens; Mr. Jacob didn't grant
the developer "in the middle" of a contention between the city and
Act 250.
Members did not feel 2 exit lanes were needed now. They did feel
private loops should be signed as fire lanes to give police the
right to tow cars parked there.

Ms. Peacock moved the Planning Commission approve the Final Plat
amendment for subdivision of a 15.11 acre parcel into two parcels
of 14.79 acres and 0.32 acres, and construction of a 38 unit
planned residential development on the 14.79 acre parcel as de-
picted on the 7 page set of plans titled "Summer Woods, Patchen
Road, South Burlington, Vermont," prepared by Krebs & Lansing Con-
sulting Engineers, Inc, dated January, 1989, last revised 2/28/89
(page 2), with the following stipulations:
1. A $38,400, 3-year landscaping bond shall be posted prior to
permit. This includes $30,300 for site landscaping and $8100 for
street trees.
2. An intersection improvement fee of $893 shall be paid to the
City prior to permit based on the 17 peak hour trip ends from this
development that will use the White Street/Patchen Road
intersection and Williston Rd. corridor.
3. The developer shall furnish to the City in writing the name of
the contractors and/or builders that will be doing the work. This
shall be done at least 7 days prior to any construction. In
writing, the developer shall submit the name of the architect and/
or engineer who will stake out and supervise the construction and
upon completion of the work, the architect and/or engineer shall
certify that the work is in conformance with the approved plans,
stipulations and any other requirements and/or changes that the
City requests.
Concrete curbs shall be continuous across entrances where they
shall be depressed with a 1-1/2 inch reveal.
5. A utility plan showing all underground utilities (electric,
gas, cable, telephone) and street lighting shall be submitted to
l the City for review and approval prior to recording. The
underground lines shall be in an easement along and outside the
road rights of way. Street lights shall be in place and operating
before any units are occupied. A downcast luminere which costs no
more to operate than the Town and Country light shall be
installed.
6. The sewage pumping station shall be privately maintained and
owned.
7. The recorded plat shall show a 60 foot wide right of way where
the road is proposed for future extention. The current plan shows
a 50 foot wide right of way in this location.
8. Legal documents including the Declaration of Condominium and
bffers of dedication and deeds for streets, sewer and water lines,
and provisions for non -conversion of garages per R. Spokes'

letter of 2/23/89, and the pedestrian easement shall be submitted
to and approved by the City Attorney prior to recording. Prior to
permit, the City shall be granted enforcement rights to enforce
the garage covenants and the revision to covenant #1 per Dick
Spokes' 2/23/89 letter.
9. A sewer allocation of 18,000 gpd is granted. The $2.50 per
gallon fee shall be paid for 7,500 gpd and shall be paid prior to
permit.
10. City standard street name signs and stop signs shall be
installed at the Patchen Road intersection of the 2 new streets.
The locations of these signs shall be shown on the plans. Street
names shall be submitted to the City Planner for approval prior to
recording. "No Parking" signs shall be installed around both cul
de sacs. All traffic signage shall be in place prior to occupancy
of units.
11. A snow fence shall be erected along the top of the bank along
the CO Zone and no trees shall be cut in the CO Zone.
12. A bond shall be posted for streets, water, sewer lines and
sidewalks in an amount determined by the City Engineer prior to
permit.
13. The recorded plan shall show the dead -ended water main near
units 24-32 extended to the north property line and capped for
future loop connection when property to the north is developed.
14. The private loop drives serving the units shall be posted as
Fire Lanes and no parking signs shall be erected.
15. A recreation fee of $200 per unit shall be paid prior to
permit.
16. A formal letter from Ms. Brill approving the planting of the
hedge on her property shall be submitted to the City Planner prior
to recording.
17. It is the applicant's responsibility to record the final plat
with the City Clerk within 90 days or this approval is null and
void. It must be approved by the Planner and signed by the
Chairman or Clerk prior to recording. '

3. Final Plat application of Joanne Brill for subdivision of a
40,600 sq. ft. lot on Patchen Road into two lots of 28,600 and
12,000 sq. ft., Patchen Road
Ms. Brill indicated that the curb cut on Arbor will be farther
than 80 feet from Patchen Road. Both lots meet the minimum lot
sizes for either single or 2-family homes. Frontage requirements
are met. All issues raised at the sketch plan hearing have been
addressed.
Ms. Peacock moved the Planning Commission approve the final Play
application of Joanne Brill for subdivision of a 40,600 sq. ft.
lot ^n Patchen Road into two lots of 28,550 and 12,063 sq. ft. as
depicted on a plan entitled "Subdivision Plat, Jo Anne Brill,
Patchen Road, South Burlington, Vermont," prepared by Krebs &
Lansing Consulting Engineers, Inc, and dated September, 1989 with
the followinq stipulations:
1. The curb cut on Arbor Road for lot #1 shall be at least 80 feet
from Patchen Rd. The existing driveway on Patchen road shall be
closed.
2. A $200 per unit recreation fee shall be paid prior to permit
for lot #2.
3. A $2.50 per gall sewer fee shall be paid prior to building
permit for lot #2.
4. The final plat must be recorded within 90 days or this approval
is null and void.
Mr. Belter seconded. Moation passed unanimously.
4. Site Plan Application of Airport Realty Associates for erection
of a 420 sq. ft. building to be used as a pilot's lounge, 3060
Williston Road.
Mr. Kellogg indicated the building will be a modular type and will
be used only for a pilot's lounge for private, corporate pilots
waiting for their return flights. Overnight pilots will still be
referred to motels. The building will be immediately southwest
of the existing Valley Air Hangar. Access is over the private
road at 3060 Associates property across from Shunpike Rd.
Five new spreading yews and one pine tree and a Norway Maple will
be put in. An existing Norway maple will be relocated.
No additional traffic will result from the building.

2) COMMUNITY BIBLE CHURCH, WILLISTON ROAD
Community Bible Church proposes to construct a 1,344 square foot
building to be used for storage and activity space for children.
Enclosed are: 1) the 8/29/89 minutes when the Sketch Plan was
reviewed, and 2) my comments for that meeting.
At the last meeting, the Commission requested one pine tree be
planted. This has been shown on the plan.
3) 2-LOT SUBDIVISION. PATCHEN ROAD
Joanne Brill proposes to subdivide a 40,600 square foot lot into
two lots of 28,600 and 12,000 square feet. Enclosed are the
8/29/89 minutes of the meeting at which the Sketch Plan was
reviewed. Also enclosed are my comments for the meeting.
The plan has been revised to meet all of the concerns raised at
the Sketch Plan meeting. A $200 per unit recreation fee shall be
paid at time of application for a building permit.
4) T0WN & COUNTRY. SHELBURNE ROAD
Nathaniel and Millicient Lash have submitted a Site Plan showing
the "as built" structure, the block retaining wall and proposed
landscaping. It is my understanding that the applicants are
requesting approval for a 9,344 square foot addition (5,061
square foot footprint) which consists of 5061 square foot first
floor and a 4,283 square foot basement.
A proposal to build a 5064 square foot addition was denied on
August 5, 1986 (minutes enclosed). A proposal to construct. a
5,061 square foot addition was later submitted and approved on
10/28/89 (minutes enclosed). As you are aware, the site con-
struction did not follow the approved site plan.

4) TOWN AND COUNTRY FURNITURE. SHELBURNE ROAD
A massive concrete block wall was placed within the water line
easement very close and portions on top of the water main. Fill
was also placed on top of the water main making it very deep and
impossible to get to in an emergency. The water main serves Goss
Dodge and Grossmans. If the wall remains, the water serving
other businesses should be relocated. That would mean Goss Dodge
to be served from Shelburne Road and Grossmans from Bartlett's
Bay Road. The water main now under the wall and in the deep fill
would become a service and Town & Country be responsible if it
fails.
5) VALLEY AIR SERVICE. BURLINGTON INTERNATIONAL AIRPORT
Site plan dated 10/5/89 prepared by Richard Kellogg Architect is
acceptable.

you that at this time I do not see any problem for our
department in given emergency protection if it would

4. The applicant has said that he will put in $2,500 worth of
landscaping to improve the appearance of the property and dock A
revised plan shall be submitted to the Planner for approval prior
to permit. A 3-year bond in this amount shall be posted prior to

5. The plan shall be revised to show a single bay dock not to
exceed 10 feet in width.
6. The building permit shall be obtained within 6 months or this
approval is null and void.

sq. ft., Patchen Road
Ms. Brill said she will subdivide off a section of the back lot,
the exact footage to be determined when surveyed. This lot will
be for either a single family home or a duplex. The existing curb
cut on Patchen Rd. will be closed when Summer Woods road is built
and opened for use. Mr. Weith said he would need to see the
garage and house plotted on the plat. Mr. Weith said that the garage
currently exceeds the minimum setback from Larch Road.
Members had no objections to the subdivision plans.
7. Sketch Plan application of Community Bible Church for
construction of a 1,344 sq. ft. building for uses in conjunction
with Sunday School services and storage, 2025 Williston Road
The applicant proposes a 3-bay garage to house vans in 2 bays and
for 9se in building props for plays and other craft projects.
there will also be a small bathroom.
Mr. Jacob asked whether the applicant should be required to pay a
sidewalk fee. The concensus of the Commission was they should
not.
Mr. Weith noted that $650 in landscaping is required. Members
agreed that one nice evergreen would be satisfactory.
7. Continue Public HEaring: Revised Final Plat application of
Heathcote Associates for: 1) change the parking layout, and 2)
request an amendment to stipulation #5 of the approval dated 10/
14/89 regarding intersection improvements, Factory Outlet Mall,

6) 2-LOT SUBDIVISION. PATCHEN ROAD
Joanne Brill proposes to subdivide a 40,500 square foot lot
located on Patchen Road into two lots of approximately 12,375 and
28,125 square feet. There is an existing house and garage on the
parcel both of which would be retained on the 28,125 square foot
lot.
The parcel is zoned R-4. It is bounded on the east by Patchen
Road, on the north by Melna Concrete, on the south by the pro-
posed Larch Street (Summerwoods project) and on the west by an
undeveloped duplex lot (Summerwoods). It is my understanding
that Summerwoods Associates is interested in purchasing the new
12,375 square foot lot for either a single-family or two-family
building.
Since this in only a two -lot subdivision, it should be handled as
a minor subdivision which requires a sketch and Final Plat re-
view.
Lot size/frontage: Both lots meet the minimum lot sizes for
single-family (9,500 square feet) and two-family (12,000 square
feet). Lot frontage requirements are also met - 85 feet on Larch
Street and 100 feet on Patchen Road.
Setback/Coverage: Assuming the front yard for the 28,125 square
foot lot is Patchen Road, the required setbacks are 50 feet from
Patchen Road, 30 feet from Larch Street, 30 feet from the new
rear property line, and 10 feet from the Melna Concrete line.
Currently, all setbacks are met except for the garage setback
from Larch Street (only 21 feet). The proposed subdivision would
still meet all required setbacks with the exception of the garage
setback from Larch Street. Coverage requirements are met.
Access: Access for both lots will be from Larch Street.
Other: A $200 per unit recreation fee and $2.50 per gallon sewer
allocation fee will be required for the new lot only. I will
check with the Zoning Administrator, Dick Ward, to see when this
fee should be assessed (i.e., as a condition of subdivision
approval or building permit?) I suspect the most appropriate
time is at permit since this is when we know for sure whether a
one or two unit building will be constructed.
The Final Plat should show allowable building envelopes.

3) L & M PARK, SHELBURNE ROAD
Streets should be public built to City standards. They shall be
looped together or terminate with a cul-de-sac, also no parking
turnoffs as plan shows. Intersecting streets shall line up and
not offset.
4) DEGRAFF PROPERTY, PATCHEN ROAD = KIRBY ROAD
1. There should be a pedestrian easement to the City Park to
serve this neighborhood. The land was acquired to serve as a
neighborhood park. The only other access to the park is from
Clover Street.
2. Another set of inlets should be placed at approximately sta.
12 + 25 and tied into the inlet at 10 + 25. The pipe may follow
the street curve.
3. A construction easement will be required from lot 17 for the
reconstruction of Patchen Road. That easement shall be granted
before any sale of that lot.
6) BRILL PROPERTY, PATCHEN ROAD
Two lot subdivision plan dated August 17, 1989 is acceptable.
7) COMMUNITY BIBLE CHURCH, WILLISTON ROAD
