THE CHILDREN'S SCHOOL
I move the South Burlington Planning Commission approve the site
plan application of The Children's School for conversion of one
dwelling unit within a two-family residential dwelling to a 26
child day care/pre-school and construction of a 900 square foot
addition for day care use as depicted on a plan entitled "Proposed,
The Children's School", prepared by John Patch and stamped
"received" January 4, 1993, with the following stipulations:
1. The applicant shall revise th lan prior to issuance of a
zoning/building permit to show additional evergreen plantings
to better screen the new parking lot. The plan shall also

shall be saved. The revised plan shall be approved by the
City Planner.
2. The applicant shall post a 3-year landscaping bond to cover

MOTION OF APPROVAL
S.B. COLLINS
I move the South Burlington Planning Commission approve the revised
site plan application of S.B. Collins for construction of an
accessory structure for trash storage on a site approved for a
retail "mini -mart" in conjunction with gasoline sales as depicted
on a plan entitled "S.B. Collins, Site Plan, Williston Road, South
Burlington, Vermont", prepared by Schreib Engineering, Inc. and
dated 12/8/92, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The plan shall be revised to show all landscaping which was
placed in the public r.o.w. moved to a location on the site.
The landscaping shall be so moved to the on -site location in
the spring of 1993.
3. The plan shall be revised to show the following:
a) the "as -built" conditions of the site including curbing,
paving, green area, etc.
b) sidewalk along Patchen Road in the correct location
c) no curbs through the sidewalk
d) sewer and water connections
4. The revised plan shall be submitted to the City Planner for
approval within one month or this approval is null and void.
The applicant shall submit three (3) copies of the approved
revised plan.

Lighting: Exterior lighting has changed slightly. One (1)
additional 400 watt metal halide lamp on a 16 foot pole was added
for a total of four (4). One (1) similar type lamp on a five (5)
foot pole was eliminated for a total of six (6) low level lights.
Sewer: No changes.
Other:
--- the plan should be revised to accurately depict site
conditions. The note on the plan indicates that the plan is
"as -built" but this is wrong.
3) THE CHILDREN'S SCHOOL - DAY CARE CENTER - SITE PLAN
This proposal consists of converting one (1) dwelling unit of a
two-family dwelling to a 26 child day care facility and
construction an 896 square foot addition for the day care use.
This property located at 173 Patchen Road lies within the R-4
District. It is bounded on the south by Arbor Road, on the east by
Patchen Road, on the west by a vacant lot, and on the north by
Melna Concrete.
Access/circulation: Current access is via one (1) 15 foot curb cut
on Arbor Road. Applicant has agreed to widen the access to 20 feet
as requested by the Fire Chief. This should be shown on a revised
plan.
Circulation is adequate.
Landscaping: The minimum landscaping requirement is $900 which is
being met. Plantings will consist of a Dense Spreading Yew hedge
in front of the parking area. Applicant has indicated that the
number of plantings will be increased to 15. This should be noted
on the plan. Staff recommends more screening of the parking area
since this is a new commercial lot in a residential neighborhood.
It is suggested that several evergreen trees such as Red Pine or
Colorado Blue Spruce be planted. Also, the large tree located in
the area of the proposed parking lot should be shown and saved.

This use would have less impact on the character of the
neighborhood if the parking lot could be constructed behind the
house. However, this would require razing the existing garage.
Parking: The day care use requires seven (7) parking spaces and
the one (1) dwelling unit requires two (2) spaces for a total of
nine (9) spaces required and nine (9) spaces are being provided.
The spaces for the residential unit will be inside the two (2) car
garage. The plan should show at least one (1) handicapped space.

The existing structures and the proposed addition meet the setback
requirements.
Lighting: Exterior lighting consists of four (4) 150 watt
lights and three (3) 100 watt porch lights.

Sewer: Sewer allocation needed for this project is 135 gpd. The, �t-

Sidewalk: Staff supports Bill Szymanski's position that a sidewalk
should be constructed. A sidewalk currently exists on this side of
Patchen Road from Williston Road to this property. It is logical.,,
that the sidewalk should continue along this side of the street to
provide a safe access to J.C. Park. Also, Patchen Road is a
collector street and the 1991 Comprehensive Plan states that-.�) t&_,
"sidewalks ... which parallel roadways should be constructed on ... (LG,.,,,
one or both sides of collector streets...
Other: The dumpster will be screened by a fence.

4) STAPLES -PLAZA - PARKING/CIRCULATION CHANGES - SITE PLAN��
This project consists of parking, circulation, exterior lighting, sCA---�J
landscaping and coverage changes made by the applicant since this
project was last approved by the Planning Commission on 3/24/92
(minutes enclosed). Staff discovered changes made to the approved
site plan in early November and has since been trying to get the
applicant to submit an accurate revised plan. Plan being reviewed
at the meeting is still not "as -built" and the applicant is aware
that a more accurate plan must be submitted (see enclosed letter
from applicant's attorney). Staff decided to leave this
application on Tuesday's agenda in order to get this issue resolved
in the near future.

I would like to call to your attention the matter of landscaping at
your 173 Patchen Road property. Your approved site plan called for
the planting of a cedar hedge along the front of the parking area.
To date, these trees have not been planted.
Another matter which needs your attention is the dumpster. It is
located in the driveway which is not an approved location. If you
refer to the site plan you will see that it was to be placed
between the garage and Arbor Road. Please maintain the dumpster in
its approved location.
Please have the landscaping installed as soon as possible as the
end of the plantings season is rapidly approaching. If you have
any questions, please give me a call.

This project, consisting of amending previously day care
facility for a maximum of 26 children, and 4 staff (no meal
preparation) served by municipal water and sewer services located
at 173 Patchen Road in the City of South Burlington, Vermont is
hereby approved under the requirements of the regulations named
above, subject to the following conditions.
GENERAL
(1) This permit does not relieve the permittee from
obtaining all other approvals and permits as may be required
from the Act 250 District Environmental Commission, the
Department of Labor and Industry (phone 828-2106 or 658-
2199), the Vermont Department of Health (phone 863-7220),
and local officials PRIOR to proceeding with this project.
(2) No alterations to the building that would change or affect
the exterior water supply or sewage disposal, or the
approved use of the building shall be allowed without prior
review and approval from the Agency of Natural Resources.
( 3 ) in the event of a transfer of ownership ( partial or whole)
of this project, the transferee shall become permittee and
be subject to compliance with the terms and conditions of
this permit.

Please be advised that the South Burlington Planning Commission at
their meeting held on 1/12/93 allocated 285 gpd of additional sewer
allocation to the Children's School for a 26 child care/pre-school
and construction of a 900 square foot addition. The property has
a pre-existing allocation of 300 gpd and together with the
additional allocation results in a total allocation for the
property of 585 gpd.
This property is being served by the City's Airport Parkway
Treatment facility which has sufficient capacity to handle the
additional demand.

A. The Planning Commission shall review as a single
project all parcels of land proposed for inclusion
in the PRD under the standards of this Article 26
and Section 19.15.
B. The Planning Commission may approve an assignment
of all or a portion of the residential development
density calculated for one parcel in the PRD
pursuant to Section 26.401 above to another parcel
in the PRD. Any such assignment shall be subject
to the limitation set forth in Section 26.403,
above.
26.605 New development shall be required to connect to
municipal sewer and water services. New services
shall be sufficiently sized to accommodate all
proposed and planned development within the
potential service area.
26.606 The Planning Commission shall review proposed
development activity or the location of
residential development lots in a restricted area
according to the following criteria:
A. Designated open space shall be located so as to
maximize the aesthetic enjoyment of users of the
site, surrounding properties, and roads in the
vicinity.
B. Proposed buildings, lots, streets and other
structures shall be placed so as to maximize
potential of land for open space and natural
resource preservation, scenic view protection,
and/or continued agricultural use. In an effort
to maximize the above goals, the following shall
be considered:
1. Existing natural resources on the site including
streams, wetlands, floodplains, conservation
zones, wildlife habitats and special features such
as mature maple groves or unique geologic
features.
2. Scenic view corridors from existing or planned
public ways.
3. Existing agricultural use and/or ability of the
land to be improved for agricultural use.
4. Size and shape of contiguous open space and
potential for combination with open space and
adjacent lots.

I have reviewed your information concerning the creation of a lot

and sewage disposal services. This Exemption supersedes the
Exemption dated May 10, 1989.

(2) If the parcel being acquired is to be considered for
building development at some future date, the purchaser
understands that the information required by Section 3-08 of the
rules must be submitted for evaluation. If such information does
not meet the Environmental Protection Rules, permission to build
on the lot will be denied.

(3) The conditions of this permit shall run with the land and
will be binding upon and enforceable against the permittee and
all assigns and successors in interest. The permittee shall be
responsible for recording this permit and the "Notice of Permit

subject to the jurisdiction of this permit.

3. Site plan application of the Children's School for conversion
of one dwelling unit within a 2-family residence dwelling to a
26 child day care/pre-school and construction of a 900 sq. ft.
addition for day care use, 173 Patchen Rd.:
Mr. Patch located the property at Arbor Lane & Patchen Rd. He
said the school will be a non-profit cooperative. It has pre-
viously been located in a church but now has to move. He noted
that the sewer allocation required by the state is more than
the city requirement. Mr. Patch added the plan will be fine-
tuned as soon as the property is bought and an architect does the
drawings.
Mr. Craig felt the northernmost parking space would be hard to
get out of.
Mr. Weith said that with the front parking lot, the applicant may
exceed front yard coverage requirements.
Mr. Craig said he was concerned that all outdoor lighting stay
on site. Mr. Patch said all lighting is existing and is down -
casting.
Regarding the sidewalk, Mr. Patch said their budget is very
tight. The children won't be using the sidewalk as there is a
fenced in play area. He asked for some consideration, either
that the sidewalk not be required or that they be given a few
years to put it in. Mrs. Maher suggested 3 years and other
members agreed. Mr. Burgess did note that he had a problem with
setting this as a precedent.
Mr. Weith said that staff has suggested additional plantings in
front of the parking lot for screening. Mr. Teeson suggested a
berm in front to raise the landscaping up. Members agreed to
leave this to the discretion of the Planner.

26.60 Planned Residential Developments:
26.601 The Planning Commission may approve Planned
Residential Developments in the Southeast Quadrant
District for residential uses and accessory
outdoor recreation uses. A proposal for a Planned
Residential Development shall be reviewed under
the standards of this Article (Article 26) and the
standards set forth in Section 19.15 regarding
Planned Unit Developments.
26.602 In connection with approval of a Planned
Residential Development, the Planning Commission
may allow development activities in addition to
those authorized under Section 26.501 to occur in
restricted areas or allow residential lots or
portions of residential lots to be located in
restricted areas. +�
26.603 Unless authorized by the Planning Commission as
provided below, the number of residential units or
lots that may be approved for a PRD shall not
exceed the allowable residential development
density for the property determined in accordance
with Section 26.401. The Planning',Commission may
allow an increase of up to twenty-five percent
(25%) in the residential development density
calculated for parcels under section 26.401 above.
26.604 The Planning commission may approve a Planned
Residential Development involving non-contiguous
parcels of land located in the Southeast Quadrant
