This permit does not relieve the permittee from obtaining all other approvals and permits as may be required from local officials prior to proceeding with this project. 2. The project shall be completed as shown on the plans Job #87-354, "Final Plat Three Lot Subdivision for Terry & Mary Shepard" dated Sept. 7, 1987 last revised 6-27-03 prepared by Vermont Land Surveyors and stamped by John P. Pitrowski, P.E. which have been stamped "approved" by the Wastewater Management Division. 3. The project shall not deviate from the approved plans in a manner, which would change, or affect the exterior water supply or wastewater disposal, building location or the approved use of the building without prior review and written approval from the Wastewater Management Division. 4. The conditions of this permit shall run with the land and will be binding upon and enforceable against the permittee and all assigns and successors in interest. The permittee shall be responsible for the recording of this permit and the "Notice of Permit Recording" in the South Burlington Land Records within thirty (30) days of issuance of this permit and prior to the conveyance of any lot subject to the jurisdiction of this permit. 5. This project has been reviewed and approved for the existing three bedroom single family residence on the lot. The permittee shall not construct any other type structures requiring plumbing, including public buildings, duplexes, condominium units, or commercial buildings, without prior review and approval by the Wastewater Management Division. Such approvals will not be granted unless the proposal conforms to the applicable laws and regulations. 6. All conditions set forth in Subdivision Permit #EC-4-1954 shall remain in effect except as modified or amended herein. The amendment consists of revising the layout of "Cluster C" which consists of 5 duplex buildings on 1.5 acres of land: Mr. Rabideau said there will be 10 units in 5 footprints. It is anticipated they will be upscale duplexes. The lot is 10 feet wider than previously shown, so they have increased the width of the driveway to 24 ft. and made some of the driveways a little deeper. They have added three more guest parking spaces and one space for a bike rack. The patios have been identified as an "on -grade amenity" as requested by the Commission. They are not subject to setback re- quirements. The utility plan has been changed to incorporate a retention basin. All utilities have been added. Mr. Rabideau said they talked with neighbors about keeping traffic from coming out the north access. It is suggested the road be made one-way coming in from the north. M E M O R A N D U M To: South Burlington Planning Commission From: Joe Weith, City Planner Re: June 27, 1995 agenda items Date: June 19, 1995 3) TERRY SHEPARD - 3 LOT SUBDIVISION - FINAL PLAT This project consists of the subdivision of a 1.47 acre lot with a single family dwelling into three (3) lots of 29,856 square feet (parcel A), 16,492 square feet (parcel #1) and 17,867 square feet (parcel #2). The preliminary plat was approved on May 25, 1995 (minutes enclosed). The final plat has not changed since preliminary and is acceptable. This property located at 131 Patchen Road lies within the R4 District. It is bounded on the west by a single family dwelling, on the north by Summer Woods residential development, on the east by Patchen Road and on the south by Jaycee Park. Access: The property access includes a 27 foot curb cut on Patchen Road serving the residence on parcel A and a 10 foot curb cut and 20 foot r.o.w. serving an existing residence on parcel B. No access changes proposed. The existing 20 foot r.o.w. would serve the two (2) new lots and the existing residence on parcel B. The 10 foot curb cut will be widened to at least 12 feet to meet the minimum driveway width requirement for residential driveways under Section 26.103(b) of the zoning regulations. This is indicated on the plat with a note. The plan shows a 12 foot wide drive serving three (3) lots. The South Burlington Subdivision Regulations require that "all private roadways shall be a minimum width of 30 feet with parking and 24 feet without parking". The Planning Commission at preliminary plat approved a 12 foot wide drive since it will serve only three (3) homes. The drive must be widened to 12 feet prior to issuance of a zoning permit for the development of lots #1 & #2. This widening is indicated on the plat with a note. Lot size/frontage: The minimum lot size requirement of 9500 square feet is being met by all three (3) lots. The minimum lot frontage requirement of 100 feet is being met by parcel A. Parcels #1 and #2 have no frontage on a public street. It is bounded on the west by a single family dwelling, on the north by Summer Woods residential development, on the east by Patchen Road and on the south by Jaycee Park. Access: The property access includes a 27 foot curb cut on Patchen Road serving the residence on parcel A and a 10 curb cut and 20 foot r.o.w. serving an existing residence on parcel B. No access changes proposed. The existing 20 foot r.o.w. would serve the two (2) new lots and the existing residence on parcel B. The 10 foot curb cut should be widened to at least 12 feet to meet',\ the minimum driveway width requirement for residential driveways / under Section 26.103(b) of the zoning regulations. The plan shows a 10 foot wide drive serving three (3) lots. The South Burlington Public/Private Roadway Policy requires that "all private roadways shall be a minimum width of 30 feet with parking and 24 feet without parking".
