LICENSE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS THAT the CITY OF SOUTH
BURLINGTON, a municipal corporation situated in the County of Chittenden and
State of Vermont (herejnafter "City', does hereby grant to A,� t z �,b►��_. G c.�.,,
of iso PrJC' &'6 , South Burlington, Vermont (hereinafter
"Grantee', a license for purpose of installing, repairing, maintaining and
replacing a fence within the public right-of-way for A;,, e `-) e�.. a
public roadway in the city of South Burlington. The grant of this License by CITY
to GRANTEE is subject to the following terms and conditions:
1. No portion of the fence shall be I cated closer than 5 feet to the paved
road surface of Pj�, z S iLf T
2. GRANTEE shall, at its sole cost, construct the fence so that it is
structurally sound and maintain it in such condition.
3. In addition to any requirements contained in this License, GRANTEE shall
construct and maintain the fence in accordance with any and all applicable
federal, state, and City of South Burlington laws, regulations, and by-laws.
4. GRANTEE hereby indemnifies and holds CITY harmless from any and all
claims, causes, actions, damages, and demands whatsoever, in law or in
equity, resulting from or attributable to the cons ruction, maintenance or
presence of the fence within the )',,, Situ- T right-of-way.
5. GRANTEE shall maintain liability insurance in the minimum amount of
$ per person and $ per occurrence. GRANTEE shall
provide CITY proof of such insurance if City so requests.
6. CITY retains the right to revoke this License at any time upon provision of
sixty (60) days written notice of GRANTEE.
7. Upon termination of this License, GRANTEE shall have sixty (60) days to
remove the fence from the �,�u �-�-c i right-of-way. Upon
GRANTEE'S failure to remove the fence within such time, CITY may
remove the fence and recover the cost of removal from GRANTEE in any
manner provided by law. Such cost, if unpaid by GRANTEE shall bear
interest at the rate of twelve percent (12%) per annum and shall
constitute a lien on GRANTEE'S above -referenced property upon the
recording of a notice of lien in the City of South Burlington land records.
8. GRANTEE may assign this License to successor owners and/or mortgages
of the above -described property.
9. This License may be recorded in the City of South Burlington Land
Records.
