The revised plan would generate 118 peak hour trip ends, or a 22% reduction from that originally proposed. Other: Enclosed is a letter from John Giebink explaining why they chose to revise the plan. Also enclosed is the previous denial motion and a draft motion of approval. 4) LAIDMAN HAIR SALON a 79 PATCHEN ROAD - SITE PLAN This project consists of the conversion of a single-family dwell- ing to an 1,173 square foot hair salon. The only exterior alter- ation to the building proposed consists of the removal of a por- tion of the existing attached garage. This property is located in the C1 zone and is bounded on the south by office buildings on the west by multi -family dwellings, on the north by J.C. Park, and on the east by Patchen Road. Access/Circulation: Access to the site will be provided by a 20 foot curb cut on Patchen Road with a 20 foot 2-way access drive to the parking area along the rear. Circulation pattern is acceptable. Parking: This project requires 5 parking spaces and 8 spaces are being provided including 1 handicapped space. Parking stall dimensions and aisle width requirements are being met. Landscaping: The minimum landscaping requirement for this project is $120 which will be met. Plantings will include Juni- per and Spirea. Coverage/Setbacks: Building coverage is 11.6'% (maximum allowed is 30%). Overall coverage is 55.2% (maximum allowed is 70%). Front yard coverage is 48.2% (maximum allowed is 30%). The applicant obtained a variance from the Zoning Board on April 8, 1991 to exceed the coverage limits by 18.2% (minutes not avail- able). Memorandum - Planning April 16, 1991 agenda items April 12, 1991 Page 3 The building does not meet the front yard setback and is there- fore nonconforming. This application does not propose to in- crease the degree or nonconformity. Lighting: Exterior lighting will consist of two (2) building mounted lights, a 175 watt metal halides light on the south side of the building and a 250 watt metal halide on the south-west corner of the building. These lights will be of a cutoff lumi- naire type. The other lighting proposed will consist of 2 ground mounted sign lights. Sewer: This project will require an additional 190 gpd of sewer allocation. The $2.50 per gallon fee would have to be paid prior to permit. Traffic: The parcel is located within the limits of the Willis- ton Road Improvement Fund (Area 1). The applicant will be re- quired to contribute $624 to the fund based on an additional 5 peak hour trip ends to be generated. Other: The plans incorporate the revisions requested by Bill Szymanski except for closing an existing curb cut which was found to not be along the applicant's frontage. 5) L&M PARTNERSHIP/MARIE UNDERWOOD - 2 LOT SUBDIVISION This proposal consists of the subdivision of a 127.39 acre parcel into two (2) lots. Lot A, being the northerly half of the lot and consisting of 66.69 acres, is to be retained by L&M Partner- ship. Lot B, being the southerly half of the lot and consisting of 60.7 acres, is to be retained by Marie Underwood. Separating lots A and B is a proposed 80 foot r.o.w. which would serve as an extension of Deerfield Drive. Sketch plan was reviewed on Febru- ary 19, 1991 (minutes enclosed). This property is located on the easterly side of Spear Street in the vicinity of Deerfield Drive and to the south and east of the IBIS property. This property is bounded on the north, east and south by developed land and on the west by 5 single-family dwell- ings and Spear Street. This property is located in the R1 and R2 Districts and an inter- im zoning district adopted by the City Council in April, 1989 which has a minimum lot size of 10 acres. I agree that even in growth centers, important wetland areas should be preserved. For example, we should preserve the Kennedy Drive wetlands, Centennial Woods wetlands, and wetlands located near the airport. However, we should be willing to sacrifice marginal wetlands to allow other goals to be achieved such as compact growth centers. If every wetland, natural area and prime agri- cultural land is to take precedent and be preserved, this will promote sprawl and all of the adverse effects associated with sprawl. Enclosed is an article on this subject and the efforts of Repre- sentative Chuck Ross to bring greater strength in dealing with this issue to the planning process rather than regulatory process (Act 250). 4) COMPREHENSIVE PLAN COMMENTS , Enclosed are conunent.s which were submitted by Cathy Debo of CCTA, Nile Duppstadt, and Herb Durfee of CCRPC. The Planning Commis- sion should review these comments and send its comments and recommendations on to the Council. Also enclosed are my comments regarding the submitted comments. 5) AMENDMENT TO NOISE STANDARDS Enclosed is a proposed amendment to Table II of the South Burl- ington Zoning Regulations regarding noise. These amendments were proposed by the Council and were primarily intended to address the Dorset Street construction. The proposed amendment would make two (2) changes: a) Change the "quiet hours" between 12 midnight and 8:00 A.M., Monday through Friday, to between 12:00 A.M. and b:^'' -A.M. A variance to exceed front yard coverage limits must be obtained. A seven (7) foot gravel projection into the green space behind parking space #8 should be made to allow for additional maneuvering space. L&M PARTNERSHIP/MARIE UNDERWOOD - 2 LOT SUBDIVISION City Attorney Steve Stitzel is being consulted as to whether this subdivision should be treated as a minor or major subdivi- sion and whether the Planning Commission can ask that the pro- posed parkland can be set aside as part of this application. The IBIS subdivision should be properly shown. Additional information required: The location and size of any existing sewers and water mains, culvert and drains on the property or serving the property. Details of proposed connection with existing water supply and sewage disposal system if you are proposing to connect. The location of temporary markers adequate to enable the Commission to locate readily and appraise the basic layout in the field (Section 203.1((15)). It would be very helpful if you would stake the centerline of the proposed r.o.w. prior to Pre- liminary Plat. This was raised in my memo dated February 15, 1991. M E M O R A N D U M To: Project File From: William J. Szymanski, City Engineer Re: Preliminary Comments - April 16, 1991 agenda Date: March 21, 1991 NOWLAND PROPERTY. SPEAR STREET 1. All interested parties should be aware of the Terry Boyle study of the area and further development should conform with this study. The extension of Deerfield Road as shown does con- form with this study. 2. Plan titled "Nowland Property II" dated July, 1990, prepared by Fitzpatrick -Llewellyn is acceptable. FORTE SALON, PATCHEN ROAD 1. There exists a curb cut along the north side of the property. This curb cut shall be closed by removing the depressed curb and pouring a new concrete barrier curb. 2. The new curb opening shall be 40 feet of depressed curb. This will allow for 10 foot flairs along each side for an im- proved turning radius. 3. A drop inlet should be provided in the parking lot and piped to the inlet along Patchen Road just south of the lot line. 4. A contract has been let for the improvement of Patchen Road. This contract will include a sidewalk along the frontage of this property. The residential portion of the site is present- ly well landscaped with lawn and existing mature trees. Section 19.104a. of the zoning regulations allows the Planning Commission to grant credit for existing trees. Given the amount of existing landscaping and the small amount of landscaping required staff feels that this requirement is being met without additional plantings. Sewer: The previous 5 motel rooms required a sewer allocation of 500 gpd. The 3 residential units require 450 gpd. Therefore, the proposed use fits within the existing allocation. 4) RALPH GOODRICH, DRAINAGE DITCH Ralph Goodrich has altered and relocated a watercourse on his property located at 1170 Hinesburg Road without first obtaining approval from the Planning Commission as required under Section 3.307 of the zoning regulations. The relocated ditch is approxi- mately 2,600 feet in length and runs in an east -west direction with the water flowing in an easterly direction and draining into an existing pond. This pond drains to the north flowing eventu- ally into Potash Brook. This property is located on the easterly side of Hinesburg Road just north of and abutting the Ledge Knoll development. Accord- ing to Mr. Goodrich the increased runoff from Ledge Knoll, Butler Farms and Oak Creek developments was flooding and eroding his farm so this ditch was dug to control this runoff. The easterly portion of the ditch was constructed along the edge of a Class II wetland and within the 50 foot buffer area required for all such wetlands. The State Agency of Natural Resources is aware of this encroachment. The ditch runs along the rear of several residential lots in the Ledge Knoll development. This new watercourse also results in the relocation of a CO District within 50 feet of the centerline of the ditch. The new CO District extends approximately 40 feet onto the adjoining Ledgeknoll properties. There are several sheds and playground structures which are now nonconforming. Mr. McGowan located the house on the plan. There is a 2-way drive on the south side of the building. There will be 8 parking spaces in back. There is an existing fence in back, also existing trees on the south side and north side. Trees will be put in in front of the building. Drainage will tie into city storm drainage. There will be no outside storage of rubbish. The parking lot will be lit as well as the signage in front. There will be two snow storage areas. Ms. Pugh suggested making the building handicapped accessible as there is a handicapped space. Mr. Burgess questioned whether lights will light the lot from their proposed location. Mr. Weith felt it was OK. Public Hearing: Preliminary Plat application of L & M Partnership for subdivision of 127.39 acres of land into two (2) parcels of 66.69 acres and 60.7 acres, Spear Street: Mr. Milot explained they had bought an interest of one of the Nowland sisters and now want to subdivide out their interest. They have done the topography required. Mr. Steele noted that the Boyle report stated an interest in a road to connect. Dorset St. and Spear St. The original proposal showed a curved road going around the wetland. The official city map shows the road right through the wetland. The present pro- posal shows a road very much like that in the Boyle Report, missing both the woods and the wetland. Mr. Weith noted the proposed road is a few hundred feet north of the Boyle suggested road. He added that it is very important to miss the woods and wetland and didn't feel strongly about moving the road south. Mrs. Maher read from a memo from the Natural Resources Committee regarding a swale, other wetlands, and the views. Mr. Milot said he didn't dispute any of this and when there were development plans, he would be sensitive to these issues. Mr. Sporzinsky said the later phase of the Recreation Path would go along the ridge and asked if anything in the plan would affect this. Mr. Milot said the would include the path in any plan. The major changes from the previous plan include: 1) the removal of the northern building fronting Dorset Street, 2) an addition to the existing main building in the area of Net Result and Cork and Board , and 3) the reduction in size of the retail building (F) on Corporate Way by 2,000 square feet. The total project with the proposed additions is now proposed to be 87,850 square feet as opposed to the February 5th proposal which had a total of 89,850 square feet or a 2.2% decrease in total square footage. The existing 100 Dorset Street project has a total of 46,850 square feet including the 2,100 square foot Net Result building and the 1750 square foot deli building, both of which are to be razed. The expansion will result in a total of 87,850 square feet or an 87.5% increase in total square footage. The proposal now consists of an 8,750 square foot 1-story retail addition to the existing 35,000 square foot 2-story retail/office building and a 3,000 square foot 1-story retail addition to theater building (same size as before). The two (2) buildings proposed adjacent to Corporate Way include a 24,000 3-story office building and a 9100 square foot 1-story retail building (previously it was 11,100 square feet). This property is located in both the Commercial 1 District and Central District 1. It is bounded to the north by Mills and Greer, to the east by the Ramada Inn, to the south by the Anchor- age Motor Inn and to the west by Dorset Street. This project also includes a parcel with frontage on Corporate Way which is contiguous to the main parcel, recently acquired from Ramada Inn. Minimum area: This being a PCD, Section 11.502(a) applies which requires a minimum of 4 acres. The original parcel is 3.74 acres and according to the applicant the additional land obtained from Ramada will bring the total acreage in C1 to 4.06 acres.
