We would like to use the property commercially and request that the City of South Burlington issue a zoning variance on our behalf. The nonconformance is a result of the building's inherent dimensions and location on the lot and makes it impossible to meet the current zoning ordinance regarding front yard green space coverage. We ask for a variance to use 48% of the front yard so we can provide the necessary 20-foot width for the driveway. It is our understanding that this variance is needed for any commercial use of the property. We would like to demonstrate how our property meets each of the five criteria outlined in SS 4468, Section 19104, part a: 1. The lot dimensions at 79 Patchen Road are 80 feet in width and 100 feet in depth. The building was erected within the first 50 feet of depth and uses 14 of the lot coverage. Between the house and the commercially required driveway the lot coverage exceeds the 30% regulation, creating a hardship. 2. In order to use the property commercially we need a variance to provide the required 20 foot wide driveway. 3. The building's dimensions and its placement on the lot have been the same for its 56 year history. 4. The majority of the neighborhood is commercially zoned and already developed. We've shown our concern for public welfare by improving and beautifying a property previously known as a neighborhood eyesore. 5. The variance will provide the required 20-foot width for the driveway accessing the parking lot. We hope this letter explains the need for the variance so that this property can be used for its intended commercial purpose.
