T IS AGREEMENT, executed in triplicate by and between
OI �-e VV bL , hereinafter referred to as "Developer", the
CITY OF SOUTH BU�4,NGTON, hereinafter referred to as "Municipality", and
the��t�'��r.�t �vsi �2���� hereinafter referred to as
"Bank".
WITNESSETH-
WHEREAS, Developer has received site plan approval from the
MUNICIPALITY'S Development Revie Board for the development of property
located at C as depicted on a site plan

WHEREAS, Developer is required by said approval, at its own expense, to
complete certain improvements; and
WHEREAS, the parties to this Agreement wish to establish an escrow
account to secure the obligations of the Developer as set forth in the City
approval; and
WHEREAS, the Bank executes this Agreement solely in the capacity of
escrow agent.
NOW THEREFORE, the parties hereby covenant and agree as
follows..
1. DEVELOPER will, at its own expense, complete the following construction
as depicted and in accordance with the specifications set forth in said site
plan and related documents.-
2. The Developer shall complete the improvements set forth in Paragraph
one no later than' ket-
3. DEVELOPER shall replace or repair any defective or improper work or
materials which may be recognized within three (3) years after completion
of the improvements set forth in Paragraph one. For the purpose of this
Agreement "completion" shall be deemed to have occurred when the
MUNICIPALITY has inspected and approved the construction of all the
improvements required by this Agreement and issued written notice to the
DEVELOPER that the construction is complete.
4. For the guaranty of Developer's performance of all requirements
herinabove set forth, and prior to the issuance of any zoning permit for
1L , Developer and Bank agree that the
sum of Q 4r Q . O �' shall be set aside and held in escrow by the
Bank and shall be available for payment to the Municipality in accordance
with the terms herein set forth.
5. If the Municipality shall file with the Bank a statement that the Developer is
in the judgement of Municipality in default under the terms of this
Agreement, the Bank shall from time to time pay monies from said escrow
fund to the Municipality, in amounts not to exceed a total enabling the
Municipality to complete improvements and requirements set forth in this
Agreement.
6. The Municipality will promptly submit to the Developer a copy of such
statement as it files with the Bank. The consent of the developer to such
payment by the Bank to the Municipality shall not be required. The Bank
shall incur no liability to the Developer on account of making such
payment to the Municipality , nor shall the Bank be required to inquire into
the propriety of any claim by the Municipality of default on the part of the
Developer or into the use of such funds by the Municipality in completing
such improvements.
7. The Municipality shall not file with the Bank a statement of default until
thirty (30) days after notice has been sent by it to the Developer by
certified mail, return receipt requested, setting forth its intention to do so.
8. All monies released by the Bank to the Municipality pursuant to paragraph
five (5) shall be used by the Municipality solely for the purpose of
performing obligations imposed upon the Developer by that portion of this
Agreement upon which the Developer is then in default. Any work to be
performed by the Municipality pursuant hereto shall be let on a contractual
basis, or on a time and material basis or shall be performed by the
Municipality with its own work force and equipment or shall be
accomplished in such a manner as in the judgement of the Municipality
shall accomplish the work most expeditiously and economically.
9. If monies are released by the Bank to the Municipality pursuant to
paragraph five (5) and it shall later develop that a portion of the released
monies are surplus to the Municipality's needs, any such surplus shall be
refunded by the Municipality to the Bank to be held and distributed by the
Bank pursuant to the terms of this Agreement.
10. The Bank will not refuse or delay to make such payments to the
Municipality when requested by the Municipality by the appropriate
statement, and Developer will not interfere with or hinder such payments
by the Bank to the Municipality. Said statement shall contain a certificate
of compliance with the notice requirements of paragraph seven (7) of this
agreement.
11. This agreement shall terminate and shall be of no force or effect upon
performance of all requirements contemplated hereby, and the completion
of the warranty period set forth in paragraph three (3).

to the Bank by the Municipality of the completion of the warranty period
set forth in paragraph three (3).
13. This agreement shall not only be binding upon the parties hereto, but also
their respective heirs, executers, administrators, successors, and assigns.

Ms. Quimby moved to approve Final Plat Application #SD-06-86 of The Rock of Greater
Burlington subject to the stipulations in the draft motion. Mr. Farley seconded. Motion
passed unanimously.
5. Site Plan Application #SP-06-61 of Brad Rabinowitz to amend a previously
approved plan for a 24' x 24' 2-story medical office addition to an 1809 sq. ft.
medical office building. The amendment consists of reducing the parking
requirement from 15 spaces to 12 spaces, 34 Patchen Road:
The applicant noted that when they came to paving the parking lot, they realized they
would have to take down some good trees in order to get 15 spaces. Mr. Belair then
suggested they look for some off -site parking, but no one in the area was interested or
willing to accommodate them. The applicant said they are not strictly speaking a
"medical" use. They are psychologists, and all 6 of them are never in the building at the
same time. There has never been a full parking lot in 20 years. They are hoping not to
have to destroy trees when it isn't necessary.
Mr. Bolton, from the neighboring building, expressed concern that if there are no parking
spaces available in this lot, people will come and park in his lot, and it will become his
problem. He said he doesn't want to have to police the situation.
Ms. LaRose said she had talked with Craig Lambert, and he would like to see the trees
saved.
Mr. Belair said this could become an enforcement action. If he is called, and there is a
problem, the DRB can then require the added spaces.
The applicant said he is willing to work with Mr. Bolton if there is a problem. Mr.
Bolton said he is happy with that assurance.
Ms. Quimby moved to approve Site Plan Application #SP-06-61 of Brad Rabinowitz
subject to the stipulations in the draft motion. Mr. Plumeau seconded. Motion passed
unanimously.
6. Public Hearing: Appeal #AO-06-03 of Magali Mouscardy appealing the
denial of zoning permit #ZP-06-348 for a detached garage, 25 Brigham Road:
Mr. Belair indicated he had denied the permit because the applicant did not have approval
from the DRB for expansion of the footprint, which is required in that district because of
the stream buffer. Mr. Belair showed the area on the map and indicated the buffer zone.
Mr. Goodrich gave the Board a folder of information. He noted that all towns have
different setback requirements, and he felt there should be consistency so the Lake can be
cleaned up.

Site plan application #SP-06-61 of Brad Rabinowitz to amend a previously approved
plan for a 24' x 24' 2-story medical office addition to an 1809 sq. ft. medical office
building. The amendment consists of reducing the parking requirement from 15 spaces
to 12 spaces, 34 Patchen Road.
The applicant has stated that they are seeking to reduce the parking requirement in
order to preserve several old and large trees (see enclosed statement from the
applicant). Based on 2,993 square feet of medical office space, 15 parking spaces are
required by the South Burlington Land Development Regulations. However, pursuant to
Section 13.01(N), the Development Review Board may grant a parking waiver of up to
25%. The applicant is requesting a waiver of 3 spaces, or 20%.
Staff supports the applicant's request for a parking waiver. Reducing impervious
coverage in favor of maintaining landscaping and increasing green space is a
continuous goal of the City whenever it can be accomplished without creating parking or
circulation problems. Staff is not aware of any problems with parking on the site; the
applicant has stated that their parking lot has never been full

Staff finds no issues with this proposal and recommends that the Development Review
Board approve Site Plan Application #SP-06-61.
Application for Amended Permit: Expansion Project 34 Patchen Road
To Ray Belair and The Development Review Board:
REOUEST FOR A 20% REDUCTION IN PARKING SPACE REOUIRMENT
It is my understanding that, while brainstorming for solutions to save green space and
trees, in conversation with Ray Belair, that requesting a 20% (3 parking space) variance
would be a good solution to my present parking space dilemma, and that such a request is
allowable within existing zoning regulations.
When it came time to pave the designated area for parking on my property, I realized that
such paving would require the destruction of many trees and the coverage of much
additional green space unless we reduced the paved area by 3 parking spaces (drawings
and documentation of proposed changes attached). While I could create these 3 parking
spaces, I do not wish to cut 15-20 trees including a 100 year old pine tree and destroy the
natural green barrier between my property and my neighbors in order to succeed. This is
especially true in that the parking needs on my property have proved more than sufficient
for my kind of business without this action for over 20 years. I therefore ask for a 20%
reduction in my parking zoning requirement (a reduction of 3 spaces).
My request is based on the following criteria:
1) I have worked at 34 Patchen Road for over 20 years, and have never seen our
parking lot more than 75% full. We have not had parking problems and I don't
assess that we should have them in the future.
2) All attempts to acquire off -site parking as a solution for zoning have been
exhausted without success. Over 3 weeks, I have talked with all commercial
locations near my property on Patchen Road, on White Street, and on Williston
Road. Owners are unable, uninterested, or unwilling to rent parking. I am and
have been certain that we do not need of -site parking for our business for
functional purposes.
3) Though we are zoned as a Medical practice, we are psychologists and
psychotherapists, and as such we are a low volume business traffic -wise. We see
only one client per hour, with 15 minute breaks between patients. We have never
had parking or traffic flow problems in our 20 years of business. Our business
does not induce heavy traffic times or large traffic flow in general. If we are
granted this variance, our ratio of parking will be 250 sq ft per space, which I
understand is the zoning requirement for a non -medical office. We more closely
resemble a non -medical office than we do a medical one, despite our professions.
4) This project involved the removal of a rented garage whose foot print was larger
than the 592sq footprint of the addition that has beemadded. Our parking area is
actually larger now than prior to construction. This in itself will improve the
parking area that had already proved itself suitable and large enough for our kind
of business for over 20 years.
5) The removal of the garage created 4 new parking spaces. The Addition to my
building causes us to lose 2 parking spaces. The loss of the tenant (who did not
park in the garage but the parking lot) adds another parking space. In short, we
have created 5 parking spaces and lost 2 for a net gain of 3 new parking spaces we
did not have before.
6) The business will be adding 2 new clinicians in the addition and converting 3
previous offices into either (non -staffed) administrative area or waiting room
areas that we lacked before. I anticipate that we will need 4 new parking spaces,
functionally, for these new clinicians. As we have created 3 already, and the
parking was never at greater than 75% capacity in the last 20 years, I anticipate no
parking or traffic flow problems with these 2 new clinicians in residence.
7) Maintaining the green space and protecting the trees and the green envelope
around my property will not interfere with already approved snow removal zones.
8) As a long term South Burlington business owner, I do not wish to destroy trees
and pave additional green space and change the appearance of my property into
one that is more industrial looking when such action (bullets 1-7) seems
unnecessary for real life functional and practical use. I believe my choice is good
for the City of South Burlington, and for the area and my neighbors.
I would like to thank Mr. Belair for his assistance in coming up with this proposal
idea. I hope I represented my thoughts clearly and understood his intentions, and that
the Board will see fit to grant my request. Thank you.

in the amount of paving.

This permit affects property referenced in deeds recorded in Book 473 Pages 481-482 of the
Land Records in South Burlington, Vermont.
This project, consisting of constructing a 592 square foot addition to an existing building for an office
with a total occupancy four psychologists seeing a maximum of 30 clients per day served by
municipal water and wastewater services located at 34 Patchen Road in the City of South Burlington,
Vermont, is hereby approved under the requirements of the regulations named above subject to the
following conditions.
GENERAL
1. This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from the Department Public Safety, Division of Fire Safety— telephone
Williston Regional Office (802) 879-2300 and local officials prior to proceeding with this
proj ect.
2. The project shall be completed as shown on the following plans that have been stamped
"approved" by the Wastewater Management Division:

Consulting Engineers, Inc. ..
3. The project shall not deviate from the approved plans in a manner that would change or affect
the exterior water supply or wastewater disposal systems, building location, or, the approved
use of the building, without prior review and written approval from the Wastewater
Management Division.
4. The conditions of this permit shall run with the land and will be binding upon and enforceable
against the permittee and all assigns and successors in interest. The permittee shall be
responsible for the recording of this permit in the South Burlington Land Records within
thirty, (30) days of issuance of this permit and prior to the conveyance of any lot subject to the
jurisdiction of this permit.

5. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose of
ascertaining compliance with the Vermont environmental and health statutes and regulations.
A copy of the approved plans and this permit shall remain on the project during all phases of
construction, and upon request, shall be made available for inspection by State or local
personnel.
WATER SUPPLY & WASTEWATER DISPOSAL
6. The project is approved for water supply by connection to the municipal water system as
depicted on the approved plans. The project is approved for a maximum of 210 gallons of
water per day. The Wastewater Management Division shall allow no other method or
location of obtaining potable water without prior review and approval.
7. The project is approved for wastewater disposal by the construction of a connection to the
municipal wastewater treatment facility as depicted on the approved plans. The project is
approved for a maximum of 210 gallons of wastewater per day. The Wastewater
Management Division shall allow no other method, or location of wastewater disposal without
prior review and approval.

Project Description:
The project consists of an addition to an existing office building on Patchen Road in the
C1 zoning district.
The existing site is a basically flat area that has approximately 63% coverage, which will
change by about 1170. Drainage patters will remain as existing.
The proposed addition will be used as counseling offices, as is the existing building. The
addition will be approximately 24' x 24', 2 stories. Utilities, etc will be extended from
the existing building. The addition meets all setbacks.
Parking for the completed project, existing and new, will be met on site. This is
calculated as 15 spaces.
Note that there is an existing garage that will be removed that is actually slightly larger
than the proposed addition, thus the actual building area will decrease with this project.
The total lot coverage will increase by about 130SF or 10/0.
As the existing building pre -dates the current zoning, the existing building does encroach
on one side yard and the front yard setbacks. Due to this, the proposed addition is
limited to 25% of the existing, appraised, value. The appraised value is $186,200. The
construction cost of the proposed addition is $43,000.
The building is designed in a residential style, as are all the neighboring structures.
Traffic:
This site is in a Traffic Overlay Zone.
At a site size of 12,900 SF, this site would be allowed 14.5 trip ends. At approximately
1900 SF existing, this would be 7.4 trip ends; as proposed with the addition at 2,993SF
this would be 11.16 trip ends. Well within the requirement.
