HomeMy WebLinkAboutSP-06-61 - Decision - 0034 Patchen Road#SP-06-61 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING BRAD RABINOWITZ - WASSON VISTA, LLC - 34 PATCHEN ROAD SITE PLAN APPLICATION #SP-06-61 FINDINGS OF FACT AND DECISION Brad Rabinowitz, hereinafter referred to as the applicant, is seeking to amend a previously approved plan for a 24' x 24' 2-story medical office addition to an 1809 sq. ft. medical office building. The amendment consists of reducing the parking requirement from 15 spaces to 12 spaces, 34 Patchen Road. The Development Review Board held a public hearing on October 17, 2006. Matthew Zilboorg was present at the meeting. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1) The applicant is seeking to amend a previously approved plan for a 24' x 24' 2- story medical office addition to an 1809 sq. ft. medical office building. The amendment consists of reducing the parking requirement from 15 spaces to 12 spaces, 34 Patchen Road. 2) The owner of record of the subject property is Wasson Vista, LLC. 3) The subject property is located in the Commercial1 — Residential 12 (C1-R12) Zoning District. 4) The applicant has stated that they are seeking to reduce the parking requirement in order to preserve several old and large trees. Based on 2,993 square feet of medical office space, 15 parking spaces are required by the South Burlington Land Development Regulations. However, pursuant to Section 13.01(N), the Development Review Board may grant a parking waiver of up to 25%. The applicant is requesting a waiver of 3 spaces, or 20%. 5) The Board supports the applicant's request for a parking waiver. Reducing impervious coverage in favor of maintaining landscaping and increasing green space is a continuous goal of the City whenever it can be accomplished without creating parking or circulation problems. There are not any apparent problems with parking on the site; the applicant has stated that their parking lot has never been full. 6) The plans submitted consist of a two (2) pages set of plans, page one (1) entitled, "Expansion: Patchen Road Office 34 Patchen Road South Burlington, VT", prepared by Brad Rabinowitz Architect, dated 9/25/06, last revised on 9/26/06. - 1 - #S P-06-61 DECISION Motion by 6WN, W JNseconded by ����� khfi,��—Ao approve Site PI t Applica ion #SD- 6-61 of Brad Rabinowitz, subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect, except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. 3. The Board grants a parking waiver of three (3) parking spaces, or 20%, for a total of 12 spaces. 4. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the parking area. 5. Any change to the site plan shall require approval of the Development Review Board of Administrative Officer.
