Subject: Pre - 1970 Duplex to Office Space, 1 - 33 Patchen Road, outh Burlington, Vermont.
This letter is in response to your letters to me dated December 15, 2000 and February 5, 2001
regarding the above subject property. It is my understanding that the duplex building was constructed
prior to June 1, 1970, the duplex contained a total of six bedrooms, the use of the building will be for
a total of six employees and there has been no changes to the exterior footprint of the building nor
changes to the existing municipal water and/or sewer services.
Based on the above understanding, this letter shall serve as approval by the Waste Water
Management Division for the change in use of the structure from a six bedroom duplex to office space
with a maximum of six employees with the following condition:
1. By acceptance of this letter, the landowner agrees to allow representatives of the State
of Vermont access to the property subject to this permit, at reasonable times, for the
purpose of ascertaining compliance with Vermont environmental/health statutes and
regulations.
2. No alterations to the building that would change or affect the exterior water supply or
sewage disposal, or the approved use of the building shall be allowed without prior
review and approval from the Wastewater Management Division.

Please note, the conversion of the building described above is authorized by this letter. Any
alterations, modifications and/or additions to this building or for similar type projects may, in the
future, require a Water Supply and Wastewater Disposal Permit from the Wastewater Management
Division. Additionally, this letter does not relieve the landowner form obtaining all other permits or
approvals as may be required from other Departments within the State of Vermont and the city of
South Burlington.

AFFIDAVIT
The undersigned, being duly sworn, deposes and says:
1. I have been one of the existing owners of the lands and premises located at 31-33 Patchen
Road in South Burlington (the "Patchen Road Property"), and the adjacent lands and premises located at 55
White Street in South Burlington (the "White Street Property") since 1988.
2. For several years before 1988 (from 1971 to 1988), my office was located at 1340 Williston
Road, in close proximity to the Patchen Road Property and the White Street Property. During this period,
I personally observed the operations of both the Patchen Road Property and the White Street Property and
became acquainted with Ronald Muir (the prior owner of both properties), since I had a long-term interest
in acquiring both properties.
3. Based on my personal observations and ownership of the Patchen Road Property and the
White Street Property, I hereby certify the following:
(a) The parking lot behind the Patchen Road Property and the parking lot behind the White
Street Property were paved as a contiguous parking lot more than 15 years ago and were
used as a common parking facility serving both properties. Although a fresh course of
paving was re -applied approximately 10 years ago, no new areas were paved. Therefore,
the current limits of the pavement and the current use of the parking lot have been in
existence for more than 15 years.
(b) The Patchen Road Property was converted for use and actually used as a business office
more than 15 yeas ago.
(c) For the past 15 years, there have been no changes to the uses and/or structure on the Patchen
Road Property, except as otherwise described in the approved building/zoning permits for
the Patchen Road Property.

As the meeting opened, Mr. Poger and members of the Commission
welcomed the new City Planner, Jane Bechtel.
Minutes of May 1, 1984
Mr. Burgess moved that the Minutes of May 1, 1984 be approved
as printed. Mr. Belter seconded with 5-0 approval, Mr. Poger
abstaining.
Continue site plan application of Ronald Muir tabled 5[1184,
conversion of a duplex unit into an -owe complex at 31-33
Mr. Muir explained that the property is across from Flair, on
the corner Patchen Rd. and White St. The proposal is to buy
the building and change it from a two -apartment house to an
office building with Mr. Muir using one office for his real
estate business and renting one or more other offices, depending
on the size of the renter. There will be 2,116 sq. ft. of
rentable space, with 9 parking spaces in the back. They will
eliminate the scruffy trees on the left side. Mr Muir spoke
with the neighbor and they have agreed to a two -rail fence
between the properties. There will be green areas between the
houee and White Street and all along the front. Present
fences will be removed. The problem that arose last week was
that Mr. Bolton was concerned about water draining onto his
land. Mr. Muir met with him and with the City Engineer and
a drop inlet was suggested running to a catch basin draining
into a 61, pipe. They will also pitch the parking lot about
6 inches toward the inlet. Mr. Muir said it was his under-
standing that the property line which was was questioned last
time is correctly drawn.
Mrs. Maher then moved that the South Burlington Planning Com-

purpose of converting the duplex to an office complex, wits
the following stipulations:
1. The driveway presently to the right of the ftont door will
be eliminated.
2. Landscaping to the right and front of the building will be
provided.
3. A bond in an amount to be stipulated by Mr. Ward will be
secured.
4. Fencing and any other proposals made by Mr. Muir to the
Planning Commission will be adhered to.
5. The drainage as proposed by the City Engineer will be under-
taken and completed.
6. This permit expires 6 months from date of approval.
The motion was seconded by Mr. Burgess and was approved unanimously.
PreliminarV plat application of Harold Bensen for construction
of 16 residential units in conjunction with two offices, a

Mr. Lamphere explained that there will be 3 buildings. The
first and third will be two-story, slab on grade; the center
building, also two stories, will have a basement. New water and
sewer lines will be put in. There will be an 8" water line
instead of the originally proposed 6" line, in compliance with
the City Engineer's request. Mr. Szymanski was also concerned
about storm water, and contours are being done. If a manhole
is required, there will be no problem. Mr. Poger noted this
project will be second on the sewer waiting list. The question
of sidewalks was discussed, and it was noted that the Commission
favored the idea of the development because it would allow the
residents access to the Post Offices and other facilities on
Williston Road. Mr. Poger said he felt that there should
either be a sidewalk to Patchen Road or a walkway from the
interior to the edge of one of the parking lots in front. It
was also noted that the Fire Chief had requested two hydrants,
and Ms. 'Bechtel was asked to discuss this with the Chief.
Mrs. Maher then moved that the South Burlington Planning Commission
approve the preliminary plat application of Harold Bensen for
construction of sixteen 1 residential units in con unction
with two office complexes, as depicted on a p an en it ed "Proposed
development or Hal Bensen " dated Januar and revised
April 9 re are Wiemann-Lama ere Architects, subject
o the following stipulations:
I. That the sewer allocation be 4,000 gpd, in accordance with
the sewer policy adopted by the Planning Commission.

the drainage concerns. See Mr. Szymanski's memo.
3) H. Bensen, 65 Patchen Road
Access from Patchen Road is proposed, involves extension of the present driveway.
Drive will be private, 20 feet in width. Street is presently called Executive Drive.
Street should have a base similar to City specifications. The sewer capacity,
projected is 4000 g.p.d. this project will be second on the waiting list, in
accordance with the Planning Commission sewer policy.
The recreational fee ($200.00 per unit) is payable prior to the issuance of a
building permit.
Landscaping: plan should be submitted at final plat review, the site has a growth
of poplar trees. The Commission may wish to allow a credit, however, those trees
have no real value. A planting schedule of $350 per unit on a average would be
considered acceptable. Setbacks, along with parking meets the requirements.
4) V.L. Properties, Dorset Square Shopping Center
Proposed is a new design of the buildings, the foot print will change which will
result in a reduction of the square footage. Approved was 47,044 square feet, the
new design is 46,868 square feet.
Parking design and circulation changes, however, the parking spaces remain the
same (220 spaces). An area of 12 compact cars is proposed. The green area will
be increased to 29.4%. Commission approved 29% originally.
Access drive to the side and rear of the complex is reduced from 24 to 22 feet.
Entrance to complex remain the same, however, southerly ehtrance to University
Mall will be relocated. A revised landscape plan must be submitted for approval
by the Planner or the Commission.
5) R.D.R. Enterprises
Parcel contains 23.7 acres - division into three lots (a) 4.8 (b) 7.0 (c) 11.9
acres. Access to Dr. Brown's property was discussed at sketch plan review. Joint
access along easterly property line of the Scottish Rite Temple lot is proposed.
Sewer capacity of two remaining lots will be determined as uses are proposed. Not
able to consider the gallonage, therefore impossible to include those lots on waiting
lost. Suggest a maximum of 1000 g.p.d. for the two lots in question.

Ron Muir, Office Building, Patchen Road
On May 3, 1984 I visited the site with Mr. Muir and Mr. Bolton.
It was agreed that a drop inlet be installed in the north-west corner of Mr. Muir's
lot approximately 13 feet south of the White Street property line and 4 feet east
of the westerly property line. The inlet to be piped with a 6 inch pipe to the
Patchen Road corner inlet. The rim elevation shall be approximately 99.5' and
the new parking area to be sloped toward this inlet via a swale skewed south-westerly
across parking lot.
3) Hal Bensen, Residential Development, Patchen Road
I. Method of handling storm water along the rear of the buildings shall be shown
on final plans.
2. Consideration should be given for a walkway to bank and post office.
3. I question the adequacy of a 6 inch water line for both fire protection and
domestic use. If it is to be public the minimum size is 8 inches. The same applies
to the sewer line.
4) V.L. Properties, Storm Sewer Relocation
1. I have worked closely with Mr. Llewellyn on this relocation and my only comment
is that the pipe be plastic or concrete preferably plastic.
6) Scottish Rite Temple
1. Property to the east and possibly some to the north drains toward this parcel.
This should be anticipated and provided for by a swale or a drainage pipe.
2. North parking lot should have a walkway across wooded area to building.
3. A turnaround should be provided for service drive near building.
4. Building elevations not shown but I would recommend first floor elevation of
approximately elevation 335.
5. The north parking lot width may be cut down (10' - 15') by utilizing the one
entrance and exit lane and turnaround.
6. The anticipated sewage flow from this facility is about 400 gallons per day.
The Muir proposal for converting a residential duplex at White-Patchen Road to
office use will substantually decrease the sewage flow from that property
(700 plus or minus g.p.d. to 200 plus or minus g.p.d.). I would reconunend that
this building be substituted for that difference.

PLANNING COMMISSION MAY 1, 1984
Site plan application of Ronald Muir for conversion of a duplex unit into an
office complex at 31-33 Patdhen-Road
Mr. Ward noted that the parking lot in the rear would be gravel. The
City Manager/Engineer feels that the entrance drive should be narrowed to
allow for snow storage, but the ordinance requires 20' width. The entrance
will be from Patchen Road.
Mr. Muir said there were two curb cuts on the lot now and that the one
closest to the Patchen Road/White St. intersection would be eliminated. There
will be no parking in front of the building, and a lot of the trees on the
site will be taken down. There will be a real estate office in the building,
which will be for professional offices. Landscaping will be added in front
of the building. Mr. Muir said his office would use about 1/4 of the building,
and he hoped to find3 or 4 other 1-2 person office uses, or one large 5-6 person
use for the rest of the building.
Mr. Muir said his neighbor Mr. Bolton did not want any more water draining
onto his property, so the land will be built up 2-3" so excess water will flow
away from that area. He added that his other neighbor, Mr. Sanderson, did not
want traffic on his land, so he suggested a simple rail fence between the two
lots. Mr. Ward noted that the 20' entrance drive would run from the edge of
the house to the property line. Mr. Muir said snow could be stored on the
lot. Mrs. Maher felt the drainage and snow storage issues could be worked out
by the applicant and the City Manager/Engineer, but she felt the drive had to
be two-way. Mr. Jacob noted that snow might have to be removed.
Mr. Bolton said he was happy to have the site improved, but he did not
want any more runoff onto his land. He said also that he was not sure the
property line was actually where it was shown. It was felt that that was something
to take up with Mr. Muir's surveyor.
Mr. Mona felt Messrs. Bolton and Muir should speak with the City Manager/
Engineer on some of the issues that had come up tonight and resolve them for
the next meeting.
Mrs. Maher moved to continue the hearing on the site plan application
of Ronald Muir until the next meeting, May 8, 1984 at 7:30 pm at City Hall.
Mr. Belter seconded the motion and all voted for it.
Continue preliminary plat application of University Mall Realty Trust, tabled_
as of March 27, 1984, University Mall, 155 Dorset St.
Mr. Jacob said he had resolved his situation concerning the Mall and that
he would remove himself from the discussion or not, as the Commission felt was
best. Several members felt he should stay, but others felt it would set a bad
precedent. Mr. Jacob removed himself from the discussion.
Mr. Ward said the major issues were the number of parking spaces and the
percentage of compact spaces. He said the Zoning Board had granted conditional
use approval to allow the Cl zone to extend into the CO district by 50'. The
Hannaford building will be 150' from the Interstate, and 50' will be used for
parking and circulation. Mr. Ward said the Zoning Board had stipulated that
a 20' buffer strip between the mall and the Interstate be maintained, so one
row of parking will have to come out there behind the existing building. Mr.
Spitz noted that in most places the buffer would be considerably more than 20'
wide. This area will be landscaped. Mr. 'lard said the parking satisfied the
city's planning consultant, Mr. Spitz. It is just under 5.25 spaces per 1,000
sq. ft. of gross leasable area, and the compact car ratio is 11.6% of the total
number of spaces.
Mrs. Maher asked when the existing Martin's building would be removed and

scaping and curb work.
3) Lums addition, 1705 Williston Road
Zoning Board of Adjustment granted a variance to the front yard landscaped area
requirements. Proposed is a green area of 41 per cent, addition buffer area
with increase landscaping. Additional 17 spaces along westerly property line
are proposed. Addition to the rear plus repair of fire damage is proposed
An increase of 50 seats is proposed. Parcel is located within Zone 5 of the
Traffic Overlay District, increase does not pose a problem, additional lot area
will be used. Present sewer usage is 2,250 g.p.d. and increase of 600 g.p.d.
is projected. Landscaping bond is required.
4) Muir 7- 31/33 Patchen Road
Proposed is the conversion of an existing duplex unit into an office complex.
The rear yard will be graveled to provide parking.. The tree line along the
southerly line must be removed to provide access. The northerly curb opening
will be closed. The best access being the southerly opening, this is a corner
lot, located at a heavy traveled intersection. Approximately 450 g.p.d. of sewer
will be added to the present capacity, the proposed use requiring 250 g.p.d.
No major concerns. Bonding for landscaping and curb closing is required.

approved plan for a 1092 sq. ft. general office building. The amendment
consists of converting the building to medical office use, 8 White Street:
Mr. Belair said staff has no issue with the shared parking arrangement. Two additional

6. Sketch Plan Application #SD-07-81 of Wedgewood Development Co. for a
planned unit development consisting of. 1) six duplexes (12 units) and 2)
three single family lots, 232 Autumn Hill Road:
Mr. Burke reviewed the history of this application. He said they had been to the DRB in
March 2007 for 6 duplexes and 2 carriage units plus the existing Goldberg house. The
zoning boundary between the NRP and NRT subzones is currently under review for a
change that would allow for 2 single family lots in the mature tree growth area.
Mr. Burke said they would like not to propose any separate park feature on the property.
Mr. Burke also indicated that they will argue for something other than a cul de sac,
possibly a T-intersection. There is a sidewalk planned on the entrance road to what is
currently shown as a cul de sac. There would be no sidewalk on the spur road.
Mr. Dinklage asked the applicant to seriously consider adding curbing and sidewalk on
the road serving the duplexes because of potential future connections. Members agree
they want curbs and sidewalks on that road. They also prefer a 24-foot road. Mr. Burke
said he felt their stormwater plan could be accomplished either way.
Mr. Jewitt indicated that he would be interested in the connection to the property to the
north. He stressed that future use of Autumn Hill Road would have to be agreed upon by
4 property owners and the city. It would also have to meet concerns of the Fire Chief.
Mr. Dinklage indicated that the property to the north should use Black Dog Drive.
No other issues were raised.
