FINDINGS OF FACT AND DECISION
Marlee-Bone, LLC, hereinafter referred to as the applicant, is seeking site plan approval
to amend a previously approved plan for a 1109 sq. ft. mixed use building. The
amendment consists of allowing required parking for 55 White Street on the property, 31
and 33 Patchen Road.
The Development Review Board held a public hearing on Tuesday, January 22, 2008.
Pat Clark represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking site plan approval to amend a previously approved plan for a
1109 sq. ft. mixed use building. The amendment consists of allowing required parking for
55 White Street on the property, 31 and 33 Patchen Road.
2. The combined proposed uses on the subject properties require twenty-two (22)
parking spaces and twenty-seven (27) parking spaces are shown on the plan including
one (1) handicapped accessible parking space. The parking requirement is being met.
3. The owner of record of the subject property is Marlee-Bone, LLC
4. The subject property is located in the C1-R12 Zoning District.
5. The plan submitted is entitled, "Site Plan Marlee-Bone, LLC, 31-33 Patchen and 55
White Street South Burlington, Vermont," prepared by Vermont Land Surveyors, dated
November 20, 2007.
DECISION

approve Site Plan Application #S-07-105 of Marlee-Bone, LLC, subject to the following
conditions:
1. All previous approvals and stipulations, which are not superseded by this approval,
shall remain in full effect.

2. This project shall be completed as shown on the plan submitted by the applicant and
on file in the South Burlington Department of Planning and Zoning.
3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations, or this approval is null and void.-
4. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to using the property for parking for 55 White Street.
5. Any change to the site plan shall require approval of the South Burlington
Development Review Board or the South Burlington Administrative Officer.
