Rear Setback 30 ft. >30 ft. zoning compliance CONDITIONAL USE CRITERIA Pursuant to Section 12.01(D) of the South Burlington Land Development Regulations, the proposed structure shall be reviewed as a conditional use and shall meet the following standards: The proposed use, in its location and operation, shall be consistent with the planned character of the area as defined by the City of South Burlington Comprehensive Plan. Staff feels that the proposed project is consistent with the planned character of the area, as defined by the Comprehensive Plan. The proposed use shall conform to the stated purpose of the district in which the proposed use is located. Staff feels that the proposed project is consistent with the stated purpose of the Lakeshore Neighborhood District, which is "to encourage residential use at densities and setbacks that are compatible with the existing character of the lake shore neighborhoods located in the vicinity of Bartlett Bay Road and Homes Road. " The Development Review Board must find that the proposed uses will not adversely affect the following: (a) The capacity of existing or planned municipal or educational facilities. 2 The proposed project will not adversely affect municipal services. This addition will have no impact on educational facilities. (b) The essential character of the neighborhood or district in which the property is located, nor ability to develop adjacent property for appropriate uses. The proposed project will not have an adverse affect on the character of the neighborhood or zoning district that this property falls within. (c) Traffic on roads and highways in the vicinity. It is extremely unlikely that this proposed addition will generate any additional traffic. Any traffic that is generated by this addition will be negligible in its effect on the neighborhood. (d) Bylaws in effect. --� The proposed project is not in keeping with applicable regulations for the flood plain overlay district. Further explanation is offered below as 'other.' (e) Utilization of renewable energy resources. The proposed project will not likely affect renewable energy resources. (0 General public health and welfare. The proposed project will not likely have an adverse affect on general public welfare. SITE PLAN REVIEW STANDARDS Pursuant to Sections 14.06 and 14.07 of the Land Development Regulations, the proposed conditional use shall meet the following standards: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. The proposed project has been planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement. (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. K I Parking is to the front and side of the building. However, given that the nature of the project as a single-family residential use, staff finds this layout acceptable and in harmony with the rest of the neighborhood. (c) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. The applicant has stated that the proposed structure will be approximately 22' in height, which is in compliance with Section 3.07 of the Land Development Regulations. (d) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. 1. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. Staff feels that this requirement is being met. (f) Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. Staff feels that this requirement is being met. (g) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. Staff does not feel it is necessary to require any additional access easements as part of the proposed project. (h) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Staff has already stated that any new utility lines, services, and service modifications shall be underground. 4 I (i) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). 2. The applicant should ensure that trash is kept inside the building. Q) Landscaping and Screening Requirements The applicant has not submitted a landscaping plan or budget. This project will require a minimum landscaping of $1,800. The City Arborist shall review the plans and provide comments. 3. The applicant shall submit a landscaping plan and budget. The landscaping proposed shall meet or exceed $1, 800 and be acceptable to the City Arborist. OTHER Pursuant to Section 12.01(D)(e) of the SBLDR, the applicant shall submit a landscaping plan showing plans to preserve, maintain, and supplement existing trees and ground cover vegetation. The DRB shall find that the overall plan will provide a visual and vegetative buffer for the lake. 4. The landscaping plan submitted shall provide a visual and vegetative buffer for the lake. The proposed addition is located within the Floodplain Overlay District and as su h shall ; be subject to the criteria included in Section 10.01 of the SBLDR. RECOMMENDATION Staff recommends that the Development Review Board Miscellaneous application #MS-05-10, subject to the applicant addressing the numbered items in the comments section of this report. No. 05233.00 Thank you for discussing this issue with me on the phone this afternoon and offering to consult with your contact at the state. We look forward to hearing her response. As we discussed on the phone this afternoon, our position is as follows: 1. The Flood Insurance Rate Map (FIRM) designates Lake Champlain as "Zone A2', with a Base Flood Elevation (BFE) of 102 feet (NGVD'29). The map's legend reiterates that Zone A2 is an area where the BFE has been determined. 2. It has been our experience that in areas where a BFE has been determined, the elevation, rather than the shaded area on the map, controls the location of the flood zone. In other words, the intent of the FIRM is to show that the BFE for the lakeshore is 102'. (The surrounding grade at the Sprout residence is at or above 118 feet in elevation.) 3. The South Burlington Floodplain Overlay District is based on the FIRM. The city's Overlay District Map contains a note stating, in part, that the map, "...is not a replacement for surveyed information or engineering studies." We concur. 4. A brief examination of the floodplain overlay on the city's GIS indicates the inclusion of at least two -dozen lakefront homes within the depicted floodplain overlay district. 5. The purpose of a Letter of Map Amendment (LOMA), according to FEMA, is to make corrections due to the fact that, "...limitations of scale or topographic definition of the source maps used to prepare the FIRM may cause small areas that are at or above the flood elevation to be inadvertently shown within the SFHA (Special Flood Hazard Area) boundaries." (emphasis added) We are not talking about "small areas" in this case. (See item 4 above.) 6. We certainly understand Planning & Zoning authorities requiring proof of whether or not a structure is above, at, or below flood level, but believe it would be an undue burden for all lakeshore homeowners to individually prove that the line depicting the horizontal extent of the flood plain is incorrect, and to individually arrange "corrections" with FEMA. Date., Monday, October 31, 2005 Subject: Sprout Project 76 Bartlett Bay Road I was very surprised with your phone call this morning indicating that the proposed addition was in the flood plain according to the Fema mapping system. I checked the elevation change according to CEA's contour data that is shown on the plan that we filed and clearly the grade at the existing foundation is at elevation 118' I believe the lake flood level is near 102 and therefore some 16' of grade difference. You indicated that we must file with Fema to have them provide a correction to their map at this site. I checked with CEA and this is time consuming and not simple. I also indicated that CEA (Civil Engineers Associates) would certify that there information is correct and therefore no flood issues should be part of the approval procedure. I am scheduled to have a review with the DRB on the fifteenth of November and I would request that your review board could agree that the difference in elevation is so large that it should not be an issue for the approval of this small house addition. Request is for permission to remove an existing 4' x 8' storage shed, replace with a 10' x 10' shed located to within twenty (20) feet of the high water level of Lake Champlain, located at 76 Bartlett Bay Road. Mr. Ward informed the board that the area in question is R-1 District. Section 19.00 Non complying structures, sub section 19.002 and 19.003 alterations and extension. Section 18.105 setback from high water level of Lake Champlain - 150 feet - existing setback 20 feet. Existing shed 4' x 8' - proposed 10' x 10'. C -2- Mr Ward said a portion of this is already under construction. It is non -complying but fits under the 35% rule of the Ordinance. This will be remodeled. Mr. Sprout said the new deck is identical to the old deck and the stairs are also identical. The shed that's there now is not very attractive. The 10' x 10' storage shed will be slightly larger than the old and will be in the same location. This will be stained cedar and will'be an improvement over what we had there. Mr. Randazzo asked what is the rate of elevation from the lake to the stairs? Mr. Sprout said 15' down. Mr. Blais said all lots are relatively small and in my view there is no way that this could be built in compliance. Mr. King said this is are improvement. Mr. Graf said there are properties there that are more noncomplying than this one. Mr. Ward Said all have the same thing. The appeal was granted unanimously. No. 4 Appeal of Gary Barrett Appeal of Gary Barrett seeking a variance from Section 19.00 Non complying structures and Section 18.00 Dimensional requirements. Request is for permission to construct a 30' x 30' and 30' x 39' addition to an existing storage building to within four (4) feet of the sourtherly side yard and a second story addition 14' x 30' to an existing office building which is non -complying to minimum dimensional requirements, located at 376 Patchen Road. Mr. Ward informed the board that the area in question is R-4 District. Section 19.00 Non conforming uses and non complying structures - sub section 19.002 alterations. Present use under variance. Section 18.00 Dimensional requirements - minimum setback (front yard) 50 feet, minimum side yard 10 feet. Existing office building - setback 35 feet, side yard 4 feet (northerly). Existing storage building 27' x.90' - rear and southerly side yard - zero - proposed addition to shed 30' x 30' and 30' x 39' to within 4 feet. Proposed addition to office building - 14' x 30' second floor. Mr. King said I feel that I should abstain from any further voting on this appeal because I feel it is a conflict of interest. Mr. Blais said Mr. King will not participate in further discussion or voting on this appeal. Mr. Graf asked could we look at this under two structures? There was some discussion regarding this and the board decided to proceed with the arguments and decide later on this.
