Rushford Shareholder rrushford@gravelshea.com We are representing JJJ South Burlington, LLC ("JJJ") in connection with the Cider Mill II development. On March 21, 2018, the City of South Burlington, Department of Planning and Zoning issued Findings of Fact and Decision for: (1) Preliminary Plat Application #SD-17-19 (the "Preliminary Plat Decision"); and (2) Master Plan Amendment #MP-17-02 (the "Master Plan Decision"). These decisions approved, at the preliminary plat and master plan stage, the construction of 142 units in a development known as Cider Mill II by JJJ. The Preliminary Plat Decision and Master Plan Decision have been appealed to the State of Vermont, Superior Court, Environmental Division. The Preliminary Plat Decision and Master Plan Decision are intended to amend the previously approved Cider Mill II development, consisting of 109-units that were approved by the City of South Burlington, Department of Planning and Zoning by Findings of Fact and Decision for Final Plat Application #SD-16-01 on March 16, 2016 (the "2016 Final Plat Approval"). Although JJJ is submitting a Final Plat Application for 142 units as described in the Preliminary Plat Decision and Master Plan Decision, JJJ reserves all rights to develop the 109-unit project described in the 2016 Final Plat Approval. The filing of this application should not be construed to be a waiver of our rights to proceed with the approved 109 unit Cider Mill II development. Please be in touch with questions.
