In conjunction with the slope stabilization project proposed for 72 Bartlett Bay Rd., on behalf of
the owners, Kevin and Marina Meehan, we would like to request a one (1) year extension of our
previously approved Miscellaneous Application (#MS-11-06). As I'm sure you are aware, there
are only a few contractors in the area capable of performing this work, as well as a dwindling
supply of appropriate material to construct the stabilization walls. Unfortunately it does not look
like contractor will prepared to start work on this project until the early fall. Once the contractor
provides a more definitive time table, we will apply for the building permit

The purpose of this letter is to address the issue of potential flood level impacts related to the
proposed sea wall and slope stabilization project for Kevin and Marina Meehan at 72 Bartlett
Bay Rd. This project involves the construction of a short (+/- 4') quarry stone sea wall and the
stabilization of the slope failure currently occurring at the subject property. These areas have
been caused by the high lake levels this spring and have been exacerbated by the effects of
hurricane Irene. There is currently slope protection in place that is comprised of 6" minus rip -rap
between elevations 98' to 102' along the lake shore. Unfortunately with the high lake level this
year, several areas of the bank were exposed to the lake and have started to erode and cause
significant slope failures.
The purpose of this project is to create a more substantial barrier of protection for the existing
steep lake shore slopes associated with this lot and to prevent further erosion of the slopes
between the lake and house. The existing rip -rap will be removed and reused for slope
stabilization on the proposed finished grades behind the proposed 4' sea wall. This wall will be
set approximately along the 100' contour elevation and keyed into the existing ground. The top
of wall elevation will be 104'. No work shall be performed below the 98' contour. The existing
failed slopes will be cleaned and stabilized with stabilization fabric. Granular fill will be installed
in 12" lifts and layered with geo-grid every 24" to anchor the proposed sea wall and newly
placed material. The top 24" of material placed behind the sea wall will be comprised of 6"
minus rip -rap. This construction will extend from the top of the sea wall back to the existing
slope on a 3:1 grade. The construction will be performed along the entire lake frontage of the
property (approximately 74').
Based on the scope of the work proposed relative to the size of Lake Champlain, this project will
not result in any significant increase in the base flood levels, nor will it increase any risk to the
surrounding properties, facilities or structures from erosion or flooding. Furthermore, due to the

project scope and the understanding that no work is proposed below the 98' contour, no permits
are required from either the U.S. Army Corp of Engineers or the State of Vermont Agency of
Natural Resources Department of Environmental Conservation. The plan elevations are based
upon the Lake Champlain water elevation, as established from the United States Geological
Survey Gauging Station 04294500, located in Burlington, Vermont (Datum NGVD 29), at the
time of survey.

Kevin & Marina Meehan, hereafter referred to as the applicants, are seeking miscellaneous
approval for the installation of erosion control measure (sea wall and slope stabilization), 72
Bartlett Bay Road.
This application is being reviewed under Conditional Use criteria and Section 12.01(1)(3) of the
South Burlington Land Development Regulations.
Associate Planner Cathyann LaRose and Administrative Officer Ray Belair, referred to herein as
Staff, have reviewed the plans submitted on October 26, 2011 and have the following comments:
CONDITIONAL USE CRITERIA
Pursuant to Section 14.10(E) of the Land Development Regulations the proposed conditional
use shall meet the following standards:
The proposed use, in its location and operation, shall be consistent with the planned character
of the area as defined by the City of South Burlington Comprehensive Plan.
The proposed project is consistent with the planned character of the area, as defined by the South
Burlington Comprehensive Plan.
The proposed use shall conform to the stated purpose of the district in which the proposed use
is located.
The proposed erosion control measures and stairs conform to the stated purpose of the Lakeshore
Neighborhood Zoning District.
The Development Review Board must find that the proposed uses will not adversely affect
the following:
(a) The capacity of existing or planned municipal or educational facilities
The proposal does not adversely affect the capacity of municipal or educational facilities.
(b) The essential character of the neighborhood or district in which the property is located,
nor ability to develop adjacent propertyfor appropriate uses
The proposal does not adversely affect the character of the neighborhood. The proposed erosion
control measures will help to protect areas up and down lake of the subject property from further
damage from erosion.
(c) Traffic on roads and highways in the vicinity.

The proposed measures will have no affect traffic on roads or highways in the vicinity.
(d) Bylaws in Effect
The proposed erosion control measures and stairs shall also adhere to Section 12(D)(3) of the
South Burlington Land Development Regulations, Surface Water Protection Standards,
governing water -oriented development.
(a) The improvement involves, to the greatest extent possible, the use of natural materials such
as wood and stone.
The applicant has proposed supplemental stabilization measures including the reconstruction of
the existing sea wall and stabilization of the existing bank along the Lake. Measures include
repairing existing rip -rap stabilization and supplementing with stabilization fabric, granular fill,
and additional rip -rap. Existing decks and stairs will be moved to facilitate construction then
reconstructed in their original locations.
(b) The improvement will not increase the potential for erosion.
When construction is complete, the proposed retaining wall will deter erosion more effectively
than what exists today. The applicant states that no work will be done below the 98' contour and
all access will be through the subject property.
(c) The improvement will not have an undue adverse impact on the aesthetic integrity of the
lakeshore.
The erosion that is currently occurring is destroying the vegetation; the new erosion -control
measures will eliminate further destruction of this vegetation.
(d) A landscaping plan showing plans to preserve, maintain, and supplement existing trees
and ground cover vegetation is submitted and the DRB finds that the overall plan will provide
a visual and vegetative buffer for the lake.
The applicant has stated that existing vegetation will be maintained outside of construction areas.
Staff does not feel that additional vegetation is needed at this time or as a result of this
application.
Pursuant to Section 3.13(F) of the Land Development Regulations the proposed conditional use
shall meet the following standards:
The Development Review Board in granting conditional use approval may impose conditions of
the following:
a) Size and construction of structures, quantities of materials, storage locations, handling
of materials, and hours of operations

b) Warning systems, fire controls, and other safeguards.
c) Provision for continuous monitoring and reporting.

d) Other restrictions as maybe necessary to protect public health and safety.
Staff does not feel it is necessary to impose any of the above conditions on the proposed project.
Water -Oriented Development
The applicant is also proposing to install new stone steps to access the lake front. Pursuant to
Section 10.01(F)(3)(a):
No encroachment, including fill, new construction, substantial
improvement, or other development, that would result in any increase in
flood levels within the regulatory floodway during the occurrence of the
base flood discharge, shall be permitted unless hydrologic and hydraulic
analyses are performed in accordance with standard engineering
practice, by a licensed professional engineer, certifying that the proposed
development will: a) Not result in any increase in flood levels (0.00 feet)
during the occurrence of the base flood; and b) Not increase any risk to
surrounding properties, facilities, or structures from erosion or flooding.
The applicant's engineer has submitted a letter addressing these criteria (attached from Civil
Engineering Associates, dated October 26, 2011). Staff finds the plans to be in compliance.
RECOMMENDATION
Staff recommends that the Development Review Board approve Miscellaneous application #MS-
11-06.

Please find attached a Miscellaneous Application for the Development Review Board, the
associated $123.00 application fee check, a series of photos taken at the project site detailing the
erosion, an abutter's list along with stamped envelopes to all abutters, a certification statement
with regards to the flood level impact for the project, as well as five (5) full and one (1) half size
plan sets associated with the proposed sea wall and slope stabilization project for Kevin Meehan
at 72 Bartlett Bay Rd.
The project involves the construction of a short sea wall and the repair and stabilization of some
areas of slope failure associated with the high spring Lake Champlain water elevation. The
existing rip -rap bank stabilization will be repaired and supplemented and the areas of slope
failure will be repaired with stabilization fabric, granular fill layered with geo-grid, then covered
with 24" of rip -rap. The existing decks and stairs will be temporarily removed to facilitate
construction then reconstructed in their original locations. No work is occurring below the 98'
contour and construction access will be available from the property, so no applications have been
made to the Army Corp of Engineers of Vermont Agency of Natural Resources.

9. Winter Stabilization
Purpose.
Managing construction sites to minimize erosion and prevent
sediment loading of waters Is a year-round challenge. In
Vermont, this challenge becomes even greater during the late fall,
winter, and early spring months Construction' struction as discussed here, describes the period
between October 15 and April 15, when erosion previntlon and
sediment control is significantly more difficult.

If construction activities involving earth disturbance continue past
October 15 or begin before April 15. the following requirements
must be adhered to:

stockpiling.
2.Limits of disturbance moved or replaced to reflect boundary of
winter work.
3. A mow management plan prepared with adequate storage and
control of meltwater, requiring cleared snow to be stored down
slope of all areas of disturbance and out of wtormwatr
treatment structures.
4 A minimum 25 foot buffer shall be maintained from perimeter

11. Miscellaneous Application #MS-06-08 of David Goodrich to expand footprint

surface water buffer area, 72 Bartlett Bay Road:
Mr. Belair noted the corrected square footage to 2452 sq. ft.
Mr. Goodrich said they added a covered porch in the rear and moved the building back 2
feet. It has been taken out of the flood plain, and they have an exemption letter.
Mr. Belair said the Stormwater Superintendent has to look at the plan and review the
contour lines.
The motion was amended to eliminate Stipulation #3 and renumber subsequent
stipulations.
Ms. Quimby moved to approve Miscellaneous Application #MS-06-08 of David
Goodrich subject to the stipulations in the draft motion as amended above.
12. Site Plan Application #SP-06-54 of Christine & Charles Newhardt to add a
695 sq. ft. accessory residential unit, 53 East Terrace:
Mr. Newhardt said there is no change to the footprint of the building.
Ms. Newhardt said there will be "in -line" parking in the driveway, which is double -wide.
Tenants will stack cars in one lane and the Newhardts will do the same in the other lane.
Ms. Quimby moved to approve Site Plan Application #SP-06-54 of Christine & Charles
Newhardt subject to the stipulations in the draft motion. Mr. Farley seconded. Motion
passed unanimously.
13. Continued Sketch Plan Application #SD-06-69 of R. L. Vallee to amend a
previously approved plan for a service station with gas sales. The
amendment consists of: 1) razing the existing service station building, 2)
constructing a 3,000 sq. ft. building consisting of 1600 sq. ft. of short-order
restaurant use and 1400 sq. ft. of convenience store use, 811 Williston Road:
Mr. Belair advised that the applicant requested a continuance until 7 November.

David Goodrich, hereinafter referred to as the applicant, is seeking miscellaneous
approval to expand the footprint of an existing single family dwelling from 1768 sq. ft. to
2138 sq. ft. in a surface water buffer area, 72 Bartlett Bay Road.
Associate Planner Cathyann LaRose and Administrative Officer Ray Belair, referred to
herein as staff, have reviewed the plans submitted on August 31, 2006 and have the
following comments.

CONDITIONAL USE CRITERIA
Pursuant to Section 12.01(D) of the South Burlington Land Development Regulations,
the proposed structure shall be reviewed as a conditional use and shall meet the
following standards:
The proposed use, in its location and operation, shall be consistent with the
planned character of the area as defined by the City of South Burlington
Comprehensive Plan.
Staff feels that the proposed project is consistent with the planned character of the area,
as defined by the Comprehensive Plan.
The proposed use shall conform to the stated purpose of the district in which the
proposed use is located.
Staff feels that the proposed project is consistent with the stated purpose of the
Lakeshore Neighborhood District, which is "to encourage residential use at densities and
setbacks that are compatible with the existing character of the lake shore neighborhoods
located in the vicinity of Bartlett Bay Road and Homes Road. "
The Development Review Board must find that the proposed uses will not
adversely affect the following:

(a) The capacity of existing or planned municipal or educational facilities.
The proposed project will not adversely affect municipal services. This addition will have
no impact on educational facilities.
(b) The essential character of the neighborhood or district in which the
property is located, nor ability to develop adjacent property for appropriate
uses.
The proposed project will not have an adverse affect on the character of the
neighborhood or zoning district that this property falls within.
(c) Traffic on roads and highways in the vicinity.
It is extremely unlikely that this proposed addition will generate any additional traffic.
Any traffic that is generated by this addition will be negligible in its effect on the
neighborhood.
(d) Bylaws in effect.
The proposed project meets all of the dimensional standards of the zoning district.
(e) Utilization of renewable energy resources.
The proposed project will not likely affect renewable energy resources.
(0 General public health and welfare.
The proposed project will not likely have an adverse affect on general public welfare.
SITE PLAN REVIEW STANDARDS
Pursuant to Sections 14.06 and 14.07 of the Land Development Regulations, the
proposed conditional use shall meet the following standards:
(a) The site shall be planned to accomplish a desirable transition from structure
to site, from structure to structure, and to provide for adequate planting, safe
pedestrian movement, and adequate parking areas.
The proposed project has been planned to accomplish a desirable transition from structure

(b) Parking shall be located to the rear or sides of buildings to the greatest extent
practicable.

Parking is to the front and side of the building. However, given that the nature of the project
as a single-family residential use, staff finds this layout acceptable and in harmony with the
rest of the neighborhood.
(c) Without restricting the permissible limits of the applicable zoning district, the
height and scale of each building shall be compatible with its site and
existing or adjoining buildings.
The applicant has stated that the proposed structure will be approximately 24'2"' in
height, which is in compliance with Section 4.07(E) and 4.08(F) of the Land
Development Regulations.
(d) Newly installed utility services and service modifications necessitated by
exterior alterations or building expansions shall, to the extent feasible, be
underground.
1. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility
lines, services, and service modifications shall be underground.
(e) The DRB shall encourage the use of a combination of common materials and
architectural characteristics, landscaping, buffers, screens and visual
interruptions to create attractive transitions between buildings of different
architectural styles.
Staff feels that this requirement is being met.
(f) Proposed structures shall be related harmoniously to themselves, the terrain,
and to existing buildings and roads in the vicinity that have a visual
relationship to the proposed structures.
Staff feels that this requirement is being met.
(g) The reservation of land may be required on any lot for provision of access to
abutting properties whenever such access is deemed necessary to reduce
curb cuts onto an arterial of collector street, to provide additional access for
emergency or other purposes, or to improve general access and circulation
in the area.
Staff does not feel it is necessary to require any additional access easements as part of the
proposed project.
(h) Electric, telephone and other wire -served utility lines and service connections
shall be underground. Any utility installations remaining above ground shall
be located so as to have a harmonious relation to neighboring properties and
to the site.
Staff has already stated that any new utility lines, services, and service modifications shall
be underground.

(i) All dumpsters and other facilities to handle solid waste, including compliance
with any recycling or other requirements, shall be accessible, secure and
properly screened with opaque fencing to ensure that trash and debris do not
escape the enclosure(s).
As this is a single-family residential lot, it is unlikely that this criterion would apply.
Q) Landscaping and Screening Requirements
The proposed project does not require additional landscaping or screening under the
SBLDR. Furthermore, no trees or shrubs are proposed to be removed in order to
accommodate the addition and so none are required to be replaced.
Pre -Existing Structures along Lake Champlain and within Queen City Park
This proposed expansion shall be reviewed under Section 12.01(D) of the SBLDR which
includes all lands within one hundred fifty feet horizontal distance of the high water
elevation of Lake Champlain. The expansion and reconstruction of pre-existing
structures on these lands may be approved by the DRB as a conditional use provided
the requirements of the underlying zoning district and the following standards are met:
a) The structure to be expanded or reconstructed was originally constructed on or
before April 24, 200.
The existing structure meets this criterion.
b) The expanded or reconstructed structure does not extend any closer, measured
in terms of horizontal distance, to the applicable high water elevation or stream
centerline than the closest point of the existing structure.
The proposed expansion is no closer to the lake than the existing structure.
c) The total building footprint area of the expanded or reconstructed structure shall
not be more than fifty percent larger than the footprint of the structure lawfully
existing on April 24, 2000.
The proposed expansion meets this criterion: the expansion is 42% of the
existing structure.
d) An erosion control plan for construction is submitted by a licensed engineer
detailing controls that will be put in place during construction or expansion to
protect the associated surface water.
The applicant has submitted an erosion control plan which has in turn been
reviewed by the City's Stormwater Superintendent. His comments are attached.
The plan was difficult to review as no contour lines were shown on the plan. The
applicant should revise the plans to include contour lines and shall be re-
evaluated by the Stormwater Superintendent.

3. The South Burlington Stormwater Superintendent shall review the revised
plans and provide comment. The revised plan shall meet the satisfaction of the
Stormwater Superintendent.
e) A landscaping plan showing plans to preserve maintain and supplement existing
trees and ground cover vegetation is submitted and the DRB finds that the
overall plan will provide a visual and vegetative buffer for the lake and/or stream.
The plan indicates that all trees will remain and meets this criterion.
OTHER
Staff found initially that the subject lot is located within the Floodplain Overlay District.
However, the applicant has since secured a Letter of Map Amendment from FEMA.
Staff is satisfied that the proposal will not have any undue adverse effect on the lake.
RECOMMENDATION
Staff recommends that the Development Review Board approve Miscellaneous Application
#MS-06-08, subject to the applicant addressing the numbered items in the comments
section of this report.

• Hay bales must NOT be used as sediment barriers due to their tendency to degrade and fall apart. They may be used to
reinforce the downhill side of silt fence, but can not be used as a barrier to prevent sediment from leaving the construction site
• Please add a note stating that disturbed soils will be seeded and mulched within 48 hours of reaching final grade.
• No contour lines or elevations are given and the extent of the necessary site work is unclear. If heavy machinery will be on -sit(
for an extended period of time in order to remove/add soil the installation of a stabilized construction entrance will be
necessary.
