Re: #AO‐18‐01 1505 Dorset Street – Appeal of Administrative Officer re: Dorset Meadows
On behalf of Tom and Donna Anfuso, et al., Murphy Sullivan Kronk has filed an appeal of the administrative
officer’s decisions that the Master Plan application #MP‐18‐01 and preliminary plat application #SD‐18‐29
were complete on September 26, 2018.
When the applicant submits a complete application, this has the effect of vesting the application under the
Land Development Regulations (“LDRs”) that are current at the time of the complete application. By
submitting complete applications on September 26, 2018, the applicant’s right to review of the applications
under the LDRs effective August 6, 2018 vested. The action of the administrative officer to decide the
application is complete does not affect the vesting date of the application.
What follows is a chronology of the Project to date.
June 11, 2018: Applicant submitted a complete sketch plan application for the Project. The assistant
administrative officer classified the project as a PUD requiring master plan review. These determinations are
noted in the sketch plan staff comments prepared for the Board.
July 17 and August 7, 2018: Development Review Board held meetings at 575 Dorset Street to review the
sketch plan application. Sketch plan review is specifically not a public hearing; instead it is a meeting to
provide the DRB the opportunity to determine whether the sketch plan meets the purposes of the LDRs, and
where the DRB deems necessary, to make specific suggestions to be incorporated in subsequent submissions.
At the August 7, 2018 meeting, the Board concluded its limited review of the sketch plan.
September 24, 2018: Applicant and applicant’s engineer met with Planning and Zoning staff to review the
prepared Master Plan and Preliminary Plat application. Staff provided feedback.
September 26, 2018: Applicant delivered an application package meeting the requirements of LDR Appendix E.
Marla Keene, Assistant Administrative Officer as indicated in the City Council meeting minutes of March 7,
2018, determined both #MP‐18‐01 and #SD‐18‐29 complete.
October 11, 2018: Appellant filed notice of appeal on two grounds. First, that the sketch plan meeting is still
open and the DRB has not approved the sketch plan and second that Assistant Administrative Officer Marla
Keene did not have the authority to deem the applications complete.
October 12, 2018: Planning and Zoning Director and Administrative Officer Paul Conner issued a letter to the
applicant confirming the decisions of Marla Keene that the applications were complete on September 26,

2018, and providing an independent decision that the applications were complete on September 26, 2018.
Paul Conner was appointed as Administrative Officer on August 6, 2018.
October 26, 2018: Appellant filed notice of appeal on two grounds. First, that the sketch plan meeting is still
open and the DRB has not approved the sketch plan and second that Administrative Officer Paul Conner did
not have the authority to deem the applications complete.
