HomeMy WebLinkAboutSP-93-0000 - Decision - 0020 Palmer CourtFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Alan Marcelino for construction of 981 additional square feet within an existing 7,500 square foot building (8,481 total square feet) used for a contracting business and motor vehicle repair, 20 Palmer Court. On the 24th of August, 1993 the South Burlington Planning Commission approved the request of Alan Marcelino for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of increasing the office space for a contracting use by 981 square feet and parking and circulation changes. The expanded office space will be constructed within the existing 7500 square foot building with no increase in building size. This building was originally approved on 3/13/90. This application was withdrawn at the 6/22/93 meeting because front yard coverage was not met. 2. This property located at 20 Palmer Court lies within the I-C District. It is bounded on the south by an industrial/warehouse building and Palmer Court, on the west and north by an industrial/warehouse building, and on the east by Muddy Brook. 3. Coverage/setbacks: Building coverage is 6.2% (maximum allowed is 30%). Overall coverage is 23% (maximum allowed is 70%). Front yard coverage is 30% (maximum allowed is 30%). 4. Access/circulations: Access is provided by a 25 foot curb cut on the Palmer Court cul-de-sac. No change proposed to the access. Circulation is adequate. 5. Landscaping: The original landscaping requirement for this project was $3600. The site has $1870 worth of existing landscaping and the applicant is proposing additional plantings which will bring the total value up to the $3,600 requirement. The plantings proposed include White Pine, Ward's Yew and Sargent Juniper. A $3,600 landscaping bond is currently in place which will expire on 11/25/93. 6. Parking: The uses on the property require a total of 10 parking spaces and 11 spaces are shown on the plan including two (2) handicapped spaces. 7. Sewer: No additional allocation required. 1 8. Lighting: Exterior lighting consists of two (2) 400 watt metal halide lamps and two (2) 250 watt metal halide lamps mounted on the building. 9. Dumpster: Two (2) dumpsters are shown on the site screened with a stockade fence. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Alan Marcelino for construction of 981 additional square feet within an existing 7,500 square foot building (8,481 total square feet) used for a contracting business and motor vehicle repair as depicted on a plan entitled "New - Site Plan Layout, 20 Palmer Court, South Burlington, Vermont 05403", prepared by Gordon G. Woods, Associates and dated 12/92, last revised 8/19/93, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The existing $3,600 landscape bond shall be extended for another three (3) years to assure that the new landscaping to be planted takes root and has a good chance of surviving. 3. All exterior lighting shall be downcasting and shielded and shall not cast light beyond the property line. Any change in existing lighting or new lighting shall be approved by the City Planner prior to installation. 4. The applicant shall obtain a zoning/building permit within six (6) months or this approval is null and void. 5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the expanded space. 6.
