HomeMy WebLinkAboutSP-00-45 - Decision - 0020 Palmer Court#SP-00-45 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, site plan application of Allen Marcellino to amend a previously approved site plan for an 8,481 square foot building used for a contracting business and motor vehicle repair. The amendment consists of: 1) a 2,500 square foot addition for contracting business use, 2) converting space used for a motor vehicle repair use to use by the contracting business, and 3) sheds totaling 1,630 square feet for the storage of salt, 20 Palmer Court. On the 3rd of October 2000, the South Burlington Development Review Board approved the site plan application of Allen Marcellino under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a previously approved site plan for an 8,481 square foot building used for a contracting business. The amendment consists of: 1) a 2,500 square foot addition for contracting business use, and 2) converting space used for a motor vehicle repair use to use by the contracting business, and 3) sheds totaling 1,630 square feet for the storage of salt, 20 Palmer Court. 2. The owner of record is Allen Marcellino. 3. This property is located at 20 Palmer Court and lies within the I-C District. It is bounded on the south by an industrial/warehouse building and Palmer Court, on the west and north by an industrial/warehouse building, and on the east by Muddy Brook. 4. Access/Circulation: Access is provided via a 25 foot curb cut. No changes are planned. Circulation on the site is adequate. 5. Coverage/Setbacks: The building coverage will increase from 6.2% to 7% (30% max). The total coverage will also increase from 23% to 40% (70%). The front yard coverage will remain unchanged at 30% (30% max). All setbacks are being met. 6. Parking: The proposed uses will require ten (10) parking spaces and 15 are being provided, including one handicapped space (one required). A bike rack is being provided. 7. Landscaping: The minimum landscaping requirement, based on building costs, is $1,350. The applicant has proposed $1,305 worth of landscaping for a $45 shortfall. Staff recommended waiving this difference as no additional substantial landscaping could be added for this amount. Staff also recommended replacing the Norway Maple with a Sugar Maple as Norway Maples are a non-native intrusive species. 8. Traffic: ITE estimates that the property currently generates 8.12 P.M. peak hour vehicle trip ends (vtes). The proposed addition will generate an additional 2.45 P.M. peak hour vtes for a total of 10.57 P.M. peak vtes. The estimated road impact fee will be $58.56. 9. Sewer: The applicant did not request an additional sewer allocation. 10. Lighting_ No new lights are proposed. If the applicant wishes to add lights, cut sheets must be submitted for review by the Director of Planning and Zoning. All lights must be downcasting and shielded. 11. Dumpsters: There are three dumpsters currently on the property. One of these dumpsters is currently unscreened. The plans must be revised to provide screening for all dumpsters. No new dumpsters are proposed. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the site plan application #SP-0045 of Allen Marcellino to amend a previously approved site plan for an 8,481 square foot building used for a contracting business and motor vehicle repair. The amendment consists of 1) a 2,500 square foot addition for contracting business use, 2) converting space used for a motor vehicle repair use to use by the contracting business, and 3) sheds totaling 1,630 square feet for the storage of salt, 20 Palmer Court, as depicted on a three (3) page set of plans, page one entitled "New Addition Site Plan Layout 20 Palmer Court, So. Burlington Vermont 05403", dated May 12, 200, last revised 9/21/00, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall. remain in effect. 2. The site plans shall be revised to show the changes listed below and shall require approval of the Director of Planning & Zoning (hereinafter Director). Three (3) copies of the approved revised site plans shall be submitted to the Director prior to permit issuance. a) The plans shall be revised to illustrate a Sugar Maple in place of the proposed Norway Maple. b) The plans shall be revised to show all dumpsters screened. c) The plans shall be revised to illustrate water and sewer services. 3. Any new exterior lighting shall consists of downcasting shielded fixtures. The applicant shall post a $1,305 landscape bond prior to issuance of a zoning permit. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 5. Pursuant to Section 26.105(a) of the Zoning Regulations, the Development Review Board grants a landscaping waiver of $45. 6. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Development Review Board estimates that the expansion will generate 2.45 additional vehicle trip ends during the P.M. peak hour. 7. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the occupancy of the new addition and newly converted space. 8. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the Zoning Regulations or this approval is null and void. 9.
