Public Hearing: Final Plat Application i)f Alan Plamer to adjust the property line between lot #2 of a 5-lot subdivision and the adjacent property to the west, 15 Palmer Court: Mr. Palmer explained they want to straighten the line to meet the topography. This is a joint action with Pete's Trailer Mart. Mr. Burgess reminded the applicant that this action requires a survey of both properties. Mr. Palmer said they have done theirs, but Pete's does not want to do one because of the cost. Mr. Weith felt there should be a survey now. Mr. Dinklage said he would be happy with a sign -off from Pete's that they accept the new boundary. He also wanted markers at every corner and every break in the property line. Other members were content with this. No other issues were raised. Public Hearing: Final Plat Application of Roger Schibani & Mery Brown to amend a previously approved planned unit development consi:;Ling of a 54,480 sq. ft. shopping center with 4 buildings, 150 Dorset Street. The amendment consists of 1) adding a 5'xl8' refrigeration unit, 2) construction of a gable entrance to the westerly side of the main building, and 3) changes to the parking and circulation layout: Mr. O'Leary said they want to put the 4'xl8' condenser behind the building. They looked at changes in parking and have come up with a diagonal parking plan that comes close to meeting the city standard. In doing this, they lost about 10 spaces, but they did add some in back for an overall gain. They also will move the dumpster and compactor to the back of the property and screen them with a fence and landscaping. There was a misunderstanding about some of the exterior work now being done. They are adding gables and an overhang. They would like a second overhang. The Zoning Board has granted a variance for this. Mr. O'Leary also noted that Green Mountain Power will be taking care of the overhead wires. Memorandum - Planning June 9, 1998 agenda items June 5, 1998 Page 2 5) BRIAN WAXLER - RETAIL BUILDINGS - SITE PLAN This application was continued from the 5/12/98 meeting (minutes enclosed) to provide the applicant an opportunity to revise the plan and give staff time to seek an opinion from the City Attorney regarding an access issue. As we have previously discussed, the City Attorney has advised that the Planning Commission has authority to require one shared curb -cut. 6) ALAN PALMER - BOUNDARY ADJUSTMENT - REVISED FINAL PLAT This project consists of adjusting the property boundary between lot #2 of a five (5) lot subdivision approved on 12/6/77 and the adjacent property to the west. The boundary line adjustment involves reducing the size of lot #2 by 5,000 square feet. The sketch plan was reviewed on 4/14/98 (minutes enclosed). This property located at 15 Palmer Court (lot #2) lies within the IC District. It is bounded on the west by the other lot involved with this boundary adjustment (Pete's RV Center), on the south by a mixed commercial building, on the north by the airport, and on the east by Palmer Court. The only issues affected by this boundary adjustment are lot size, setbacks and coverage. Lot size: Lot #2 will be reduced in size by 5,000 square feet and will still meet the minimum lot size requirement of 40,000 square feet. Setbacks: The proposed property line will meet the setback requirement from the existing building on lot #2. Coverage: Building coverage is 18% (maximum allowed is 30%). Overall coverage is 56% (maximum allowed is 70%). Front yard coverage is not affected. Other: — this application should include a complete survey of both involved properties, including the S.M.S. Realty Partnership property. The applicant does not want to provide this information. — the plat should be revised to note that the correct name of the street is Palmer Court. 2 PLANNING COMMISSION 14 APRIL 1998 page 9 4. Pursuant to Section 6.607 of the zoning regulations, the Planning Commission modifies the minimum lot size requirements for lots #33-37. In addition, the Planning Commission modifies the minimum frontage requirements on lots #33-37. 5. Pursuant to Section 513.1 of the subdivision regulations, the Planning Commission waives Section 401.1(i) of the subdivision regulations to allow a reduction in the radius curve along the redesigned Nowland Farm Road from 500 feet to 300 feet and reduce the tangent length. 6. The following lot combination shall be constructed as a duplex unit • 33-34 . 7. The applicant shall be responsible for constructing Nowland Farm Road and bike path from Dorset Street to just-easterly_of Vale Drive as shown on Sheet C2-4. Similarly, the applicant shall be responsible for constructing Dorey Road from Four Sisters Road to the proposed connection with Vale Drive as shown on Sheet C2-4. Alternatively, the applicant shall be required to construct Nowland Farm Road and Dorey Road to the applicant's westerly most boundary if the applicant for Pinnacle @ Spear Development returns to the Planning Commission and the Planning Commission is able to place a condition on the Pinnacle at Spear Development that requires that applicant to construct said roadways to his easternmost property line. 8. Any change to the final plat plan shall require approval by the South Burlington Planning Commission. 9. The final plat plans (sheets 3 of 7, and 5 of 5) shall be recorded in the land records within 90 days or this approval is null and void. The plans shall be signed by the Planning Commission Chair or Clerk prior to recording. Prior to record- ing the final plat plans, the applicant shall submit a copy of the survey plats in digital format. The format of the digital information shall require approval of the City Planner.
