On the 91h day of June, 1998, the South Burlington Planning Commission approved the request of Alan Palmer for revised final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of adjusting the property boundary between lot #2 of a five (5) lot subdivision approved on 12/6/77 and the adjacent property to the west. The boundary line adjustment involves reducing the size of lot #2 by 5,000 square feet. The sketch plan was reviewed on 4/ 14/98. 2. This property located at 15 Palmer Court (lot #2) lies within the IC District. It is bounded on the west by the other lot involved with this boundary adjustment (Pete's RV Center), on the south by a mixed commercial building, on the north by the airport, and on the east by Palmer Court. The only issues affected by this boundary adjustment are lot size, setbacks and coverage. 3. Lot size: Lot #2 will be reduced in size by 5,000 square feet and will still meet the minimum lot size requirement of 40,000 square feet. 4. Setbacks: The proposed property line will meet the setback requirement from the existing building on lot 92. 5. Coverage: Building coverage is 18% (maximum allowed is 30%). Overall coverage is 56% (maximum allowed is 70%). Front yard coverage is not affected. 6. Other: this application should be revised to show monuments/pins on all corner points. the plat should be revised to note that the correct name of the street is Palmer Court. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat application of Alan Palmer to adjust the property line between lot 42 of a 5-lot subdivision and the adjacent property to the west, 15 Palmer Court, as depicted on a plat entitled, "Compiled Plan 1 For Boundary Line Adjustment Between Alan Palmer & S.M. S. Realty Partnership Williston Road, South Burlington, Vermont," prepared by Vermont Land Surveyors, dated September 9, 1997, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plat plan shall be revised to show the changes listed below and shall require approval of the City Planner. Three (3) copies of the approved revised plat plan shall be submitted to the City Planner prior to recording. a) The final plat plan shall be revised to show monument/pins on all corner points. b) The final plat plan shall be revised to note that the correct name of the street is Palmer Court. 3. Any change to the final plat plan shall require approval by the South Burlington Planning Commission 4. The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format of the digital information shall require approval of the City Planner. 5.
