This project, consisting of amending Permit # WW-4-0287-1 for the mixed use commercial building located on Lot 2 for
operation of a cold coffee beverage production (DBA Death Before Decaf) and bottling operation in Suite 212 at 15 Palmer
Court in South Burlington, utilizing bottled water for production and bottling, and municipal water for washing and general
production with 4 employees, served by municipal water and sewer services; assign allocations to the other 4 buildings on
Lots 2, 3, 4 and 5 in the Muddy Brook Industrial Park located on 15 Palmer Court,' South Burlington, VT in South Burlington,
Vermont, is hereby approved under the requirements of the regulations named above subject to the following conditions.
i. GENERAL
1.1 The project shall be completed as described in the application prepared by Paul O'Leary PE. The project shall not
deviate from the approved proposal without prior written approval from the Drinking Water and Groundwater
Protection Division. (No Plans)
1.2 This permit does not relieve the landowner from obtaining all other approvals and permits PRIOR to construction
including, but not limited to, those that may be required from the Act 25o District Environmental Commission; the
Drinking Water and Groundwater Protection Division; the Watershed Management Division; the Division of Fire
Safety; the Vermont Department of Health; the Family Services Division; other State departments; or local officials.
1.3 The conditions of this permit shall run with the land and will be binding upon and enforceable against the landowner
and all assigns and successors in interest. The landowner shall record and index this permit in the South Burlington
Land Records within thirty, (3o) days of issuance of this permit and prior to the conveyance of any lot subject to the
jurisdiction of this permit.
1.4 All conditions set forth in Permit Number WW-4-o287-1 shall remain in effect except as amended or modified
herein. This project is approved for the following changes to the mixed use commercial building on Lot 2:

1.5 Construction of additional nonexempt buildings, including commercial and residential buildings, is not allowed
without prior review and approval by the Drinking Water and Groundwater Protection Division and such approval
will not be granted unless the proposal conforms to the applicable laws and regulations. No construction is allowed
that will cause non-compliance with an existing permit.
1.6 Each purchaser of any portion of the project shall be shown a copy of the Wastewater System and Potable Water
Supply Permit and the stamped plan(s), if applicable, prior to conveyance of any portion of the project to that
purchaser.
1.7 By acceptance of this permit, the landowner agrees to allow representatives of the State of Vermont access to the
property covered by the permit, at reasonable times, for the purpose of ascertaining compliance with the Vermont
environmental and health statutes and regulations, and permit conditions.
1.8 Any person aggrieved by this permit may appeal to the Environmental Court within 3o days of the date of issuance
of this permit in accordance with 10 V.S.A. Chapter 22o and the Vermont Rules of Environmental Court
Proceedings.
2.WATER SUPPLY
2.1 This project is approved for the existing connection to the water supply system owned by the City of South
Burlington as depicted on the plan(s) stamped by the Drinking Water and Groundwater Protection Division.
2.2 This project is approved with an existing building's. water service piping. The Drinking Water and Groundwater
Protection Division assumes no liability for the adequacy of this water service. Should the water supply fail and not
qualify for the minor repair or replacement exemption, the landowner shall engage a Licensed Designer to evaluate
the cause of the failure and to submit a permit amendment application to this office, and receive approval thereof,
prior to correcting the failure.
2.3 The landowner shall install and maintain backflow prevention devices that conform to Vermont Department of
Public Safety standards and NFPA 13 for any connection of a sprinkler fire suppression system to a public drinking
water system.
2.4 This permit is based, in part, on a municipal approval for connection to their water distribution system. If the
municipal approval expires, this permit shall be invalid unless the municipality renews its approval. If the
municipality approval expires, a new permit must be issued for the project. An updated application form and an
application fee will be required for the project. A new municipal approval letter shall be required. The rules in
effect at the time of the filing of the application for a new permit will be applied to the project.
gMASTEWATER DISPOSAL
3.1 This proj ect is approved for the existing connection to the City of South Burlington wastewater treatment facility
as depicted on the plan(s) stamped by the Drinking Water and Groundwater Protection Division.
3.2 This project is approved with an existing building sewer line. The Drinking Water and Groundwater Protection
Division assumes no liability for the adequacy of this sewer line. Should the line fail and not qualify for the minor
repair or replacement exemption, the landowner shall engage a Licensed Designer to evaluate the cause of the failure
and to submit an amendment application to this office prior to correcting the failure.

Dear Susan;
At your request, I have tied down the time schedule of con-
struction. If all goes as planned, the foundation wall will be
completed on or about. October 10, 1978; within one week of com-
pletion the disturbed slopes will be topsoiled and seeded and
also mulched. I really don't think there will be much exposed
area. At present much of the cut has taken place and the slopes
have been seeded and mulched.
Mr. Nash of Instant Shade Tree will be moving the landscaping
trees to the designated spots during the week of October 10, 19789
some will have to wait until the week of April 20, 1978 to be
planted but most of the landscaping will. be done before October
31. 1974.
The total project should be complete by November 1, 1978
with a few small remaining interior items left to be done.
Mr. Hipes of the Soil Conversation Service will be adding
comments as to the progress of the entire project.

At your request, I inspected the erosion and sediment control measures
applied on lot l of the industrial site on Williston Road.
The vegetation has been established on at least 75% of the soil area.
Hard use areas are paved or gravel covered. There are some bare soots
on the embankment east of the access road. The mulch needs to be
maintained on these areas.
The catch basins in the storm water system need cleaning out. They
should be checked after every rain. There is no evidence of any sedi-
ment getting to the creek.
The vegetation between the site of construction and the creek is act-
ing as an effective filter strip and should not be disturbed.

District Environmental Commission #4 hereby issues a Land Use Permit pursuant
to the authority vested in it in 10 VSA, Chapter 151. This permit applies
to the lands identified in Book 134, Pages 56-58 of the Land Records of So.
Burlington, Vermont as the subject of a deed to Alan D. Palmer, the "permittee"
as grantee. This permit specifically authorizes the permittee to construct a
building 50' X 182' and an attached office/storage shop 40' X 62' on Lot #2
of the Muddy Brook Industrial Park, So. Burlington, Vermont.
The permittee, his assigns and successors in interest are obligated by this
permit to complete and maintain the project only as approved by the District
Commission in accordance with the following conditions:
(1) The project shall be completed as set forth in Findings of Fact and
Conclusions of Law #4CO296-2 in accordance with the plans and exhibits
stamped "Approved" and on file with the District Environmental Commis-
sion, and in accordance with the conditions of this permit.
(2) By acceptance of the issuance of this permit without appeal, the permittee
confirms and agrees for himself and all assigns and successors in interest
that the conditions of this permit shall run with the land and the land
uses herein permitted, and will be binding upon and enforceable against
the permittee, and all assigns and successors in interest. The granting
of less than an undivided whole interest in this project is prohibited
without prior approval of the District Environmental Commission.
(3) This permit hereby incorporates all of the conditions of the Certifica-
tion of compliance #4CO296-2 issued on September 22, 1978 by the Regional
Engineer, Division of Protection, Agency of Environmental Conservation in
compliance with Vermont State Board of Health Regulations Chapter 5,
Sanitary Engineering, Subchapter 1, Public Buildings and Subchapter 15,
Plumbing,
Condition #2 specifically states, "The interior plumbing for this project
is approved with the conditions that the lavatory waste lines located within
the building slab must be cast iron and two inches in diameter."

(4) The Commission reserves the right to evaluate and impose additional
conditions with respect to soil erosion during the lifetime of Permits
#4CO296, #4CO296-1, and #4CO296-2.
(5) The Commission maintains continuing jurisdiction during the lifetime
of the permit and may periodically require that the permit holder file
a written statement certifying that the project is being completed in
accordance with the terms of the project.
(6) The County Forestor shall review and approve the landscape plan and
species list prior to any planting. The permittee shall continually
maintain the approved landscaping, replacing; any dead or diseased plantings
as soon as seasonably feasible.
(7) The permittee shall comply with all the recommendations of Don Hipes,
Soil Conservationist, as set forth in Exhibit 11.
(8) The permittee shall arrange a site inspection with Don Hipes, District
Conservationist, and James Dodge, Environmental Inspector, on or about
November 15, 1978, for the purpose of inspecting the entire site to
determine if additional erosion control measures are necessary. All
recommendations shall be set forth in a letter to the District Commission
no later than December 1, 1978 and shall become a part of the approved
plans for this permit. The permittee shall comply with any recommendations
no later than December 15, 1978.
(9) The fire hydrants shall be installed as set forth in Exhibit 5 no later
than November 1, 1978.
(10) The permittee shall install aerator -type faucets and low -flush toilets
in all lavatories.
(11) The applicant shall apply to the District Commission for approval for any
change in manufacturing=, processes which will cause emissions into the
air or injection of toxic wastes into the soils.
(12) All construction on this project must be completed by December 31, 1978.
(13) All landscaping shall he completed by June 1, 1979.
(14) This permit shall expire on September 28, 1998, unless extended by the
District Commission.

On September 15, 1978, an application for an Act 250 Permit was filed by
Alan Palmer, P.O. Box 2346, So. Burlington, Vermont, for a project generally
described as construction of a warehouse/light manufacturing building 50' X
182' with an attached 40' X 62' office/shop/storage area on Lot #2 of the
Muddy Brook Industrial Park in South Burlington. The applicant's legal
interest is ownership in fee simple.
Under Act 250 projects are reviewed based on the 10 environmental criteria of
10 ITSA, §6036(a) 1-10. Before granting a permit, the Board or District Commis-
tion must find that the project complies with these criteria and is not detri-
mental to the public health, safety or general welfare.
Decisions must be stated in the form of findings of fact and conclusions of
law. The facts we have relied upon are contained in the documents on file
identified as Exhibits 1 through 14, and the evidence received at a hearing
on September 27, 1978.
Parties to this application are: the applicant, Alan Palmer; the municipality,
Chief James [a. Goddette, Sr., So. Burlington Fire Department; the Agency
of Environmental Conservation, William Hall, County Forester; and Don Hipes,
District Soil Conservationist.
In making the following findings, we have summarized the statutory language
of the 10 criteria of 10 VSA, 36086(a):
1. There will be no undue water or air pollution:
i) The applicant will install water conserving plumbing fixtures.
ii) A Certification of Compliance has been issued for compliance
with Public Buildings and Plumbing regulations.
iii) There will be no toxic industrial wastes injected into the soil
or noxious or unhealthy emissions into the air.
2-3. There is sufficient water available and no existing water supply will
be unreasonably burdened:
The applicant has a letter from the Champlain I -later District which
indicates that sufficient water is available for this project. Any
industry which might require water in a manufacturing process in
excess of 0.25 m.g.d would require further analysis and consideration
however. (Exhibit 10)

4. There will be no unreasonable soil erosion or effects on the capacity
of the land to hold water:
i) The applicant has continued to work with the District Soil
Conservationist and will follow his recommendations. He will con-
sult with the conservationist for specific measures to prevent
erosion in the winter months.
ii) All disturbed areas will be topsoiled, seeded, and mulched within
one week of the completion of the foundation wall. (Exhibit 9)
5. This project will not cause unreasonable safety or congestion conditions
with respect to highways or other means of transportation:
This criterion was addressed in Land Use permit #4CO296.
6-7. There will be no unreasonable burdens on educational or other municipal
services:
i) Criterion #6 was addressed in Land Use Permit #4CO296.
ii) Chief Goddette of the So. Burlington Fire Department has recommended
changes in the hydrant locations as specified on Exhibit 5, which the
applicant has agreed to install.
8. There will be no undue adverse effects on aesthetics, scenic beauty,
historic sites or natural areas:
i) The 50' X 182' section of the building will be a light brown steel
structure with dark brown trim. The 40' X 62' office/shop will have
diagonal pine siding and stone facing.
ii) The landscaping species will be approved by the County Forester
to insure that they are suitable for the site.
iii) The only exterior lighting will be floodlight on the office area.
iv) So. Burlington has required a $3,600 landscape bond.
9. The project is in conformance with the Capability and Development Plan:
i) The office area will have insulation with an R-value of R-36 in the
ceiling and R-19 in the side walls.
ii) The manufacturing/shop/storage areas will have insulation with an
R-value of R-13 in the roofs and R-10 in the side walls. These areas
will only be heated to 550-600. The plastics industry,which will occupy
part of the space, will produce some heat from the molding process.

10. The project is in conformance with the local plan:
The So. Burlington Planning Commission has found this project to be
in conformance with the City's Comprehensive Plan.
CONCLUSION OF LArd
Based upon the foregoing Findings of Fact, it is the conclusion of this
District Environmental Commission that the project described in the appli-
cation referred to above, if completed and maintained in conformance with
all of the terms and conditions of that application, and of Land Use Permit
#4CO296-2, will not cause or result in a detriment to public health,
safety or general welfare under the criteria described in 10 VSA §6086(a)
and that, pursuant to such section, a permit is therefore issued.

District Environmental Commission #4 hereby issues a Land Use Permit pursuant
to the authority vested in it in 10 VSA, Chapter 151. This permit applies
to the lands identified in Book 134, Pages 56-58 of the Land Records of So.
Burlington, Vermont as the subject of a deed to Alan D. Palmer, the "permittee"
as grantee. This permit specifically authorizes the permittee to construct a
building 50' X 182' and an attached office/storage shop 40' X 62' on Lot #2
of the Muddy Brook Industrial Park, So. Burlington, Vermont.
The permittee, his assigns and successors in interest are obligated by this
permit to complete and maintain the project only as approved by the District
Commission in accordance with the following conditions:
(1) The project shall be completed as set forth in Findings of Fact and
Conclusions of Law #4CO296-2 in accordance with the plans and exhibits
stamped "Approved" and on file with the District Environmental Commis-
sion, and in accordance with the conditions of this permit.
(2) By acceptance of the issuance of this permit without appeal, the permittee
confirms and agrees for himself and all assigns and successors in interest
that the conditions of this permit shall run with the land and the land
uses herein permitted, and will be binding upon and enforceable against
the permittee, and all assigns and successors in interest. The granting
of less than an undivided whole interest in this project is prohibited
without prior approval of the District Environmental Ccrm.issicn.
(3) This permit hereby incorporates all of the conditions of the Certifica-
tion of compliance #4CO296-2 issued on September 22, 1978 by the Regional
Engineer, Division of Protection, Agency of Environmental Conservation in
compliance with Vermont State Board of Health Regulations Chapter 5,
Sanitary Engineering, Subchapter 1, Public Buildings and Subchapter 15,
Plumbing,
Condition #2 specifically states, "The interior plumbing for this project
is approved with the conditions that the lavatory waste lines located within
the building slab must be cast iron and two inches in diameter."

(4) The Commission reserves the right to evaluate and impose additional
conditions with respect to soil erosion during the lifetime of Permits
#4CO296, #4CO296-1, and #4CO296-2.
(5) The Commission maintains continuing jurisdiction during the lifetime
of the permit and may periodically require that the permit holder file
a written statement certifying that the project is being completed in
accordance with the terms of the project.
(6) The County Forestor shall review and approve the landscape plan and
species list prior to any planting. The permittee shall continually
maintain the approved landscaping, replacing any dead or diseased plantings
as soon as seasonably feasible.
(7) The permittee shall comply with all the recommendations of Don Hipes,
Soil Conservationist, as set forth in Exhibit 11.
(8) The permittee shall arrange a site inspection with Don Hipes, District
Conservationist, and James Dodge, Environmental Inspector, on or about
November 15, 1978, for the purpose of inspecting the entire site to
determine if additional erosion control measures are necessary. All
recommendations shall be set forth in a letter to the District Commission
no later than December 1, 1978 and shall become a part of the approved
plans for this permit. The permittee shall comply with any recommendations
no later than December 15, 1978.
(9) The fire hydrants shall be installed as set forth in Exhibit 5 no later
than November 1, 1978.
(10) The permittee shall install aerator -type faucets and low -flush toilets
in all lavatories.
(11) The applicant shall apply to the District Commission for approval for any
change in manufacturing processes which will cause emissions into the
air or injection of toxic wastes into the soils.
(12) All construction on this project must be completed by December 31, 1978.
(13) All landscaping shall be completed by June 1, 1979.
(14) This permit shall expire on September 28, 1998, unless extended by the
District Commission.

This project, consisting of the construction of an industrial building
to be erected on Lot #2 in the "Muddy Brook Industrial Park" located off
Williston Road in South Burlington, Vermont, is hereby certified to satisfy
the requirements of the regulations named above if the following; conditions
are met:
(1) The project must be completed as shown on the sanitary plans prepared
by Trudell Consulting Engineers, Inc. on September 14, 1978 and the
interior plumbing plans prepared by Palmer Company Ltd. on September 7,
1P78 and which have been stamped "approved" by the Division of Protec-
tion. No alteration of these plans shall be allowed except where
written application has been made to the Agency of Environmental
Conservation and approval obtained.
(2) The interior plumbing for this project is approved with the conditions
that the lavatory waste lines located within the building slab must
be cast iron and two inches in diameter.
(3) A copy of the approved plans and the Land Use Permit shall remain on
the project during all phases of construction and, upon request, shall
be made available from inspection by State or local personnel.

10 VSA, Chapter 151 (Act 250)
On September 15, 1978, an application for an Act 250 Permit was filed by
Alan Palmer, P.O. Box 2346, So. Burlington, Vermont, for a project generally
described as construction of a warehouse/light manufacturing building 50' X
182' with an attached 40' X 62' office/shop/storage area on Lot #2 of the
Muddy Brook Industrial Park in South Burlington. The applicant's legal
interest is ownership in fee simple.
Under Act 250 projects are reviewed based on the 10 environmental criteria of
10 ITSA, §6036(a) 1-10. Before granting a permit, the Board or District Commis-
tion must find that the project complies with these criteria and is not detri-
mental to the public health, safety or general welfare.
Decisions must be stated in the form of findings of fact and conclusions of
law. The facts we have relied upon are contained in the documents on file
identified as Exhibits 1 through 14, and the evidence received at a hearing
on September 27, 1978.
Parties to this application are: the applicant, Alan Palmer; the municipality,
Chief James W. Goddette, Sr., So. Burlington Fire Department; the Agency
of Environmental Conservation, William Hall, County Forester; and Don Hipes,
District Soil Conservationist.
In making the following findings, we have summarized the statutory language
of the 10 criteria of 10 VSA, §6086(a):
1. There will be no undue water or air pollution:
i) The applicant will install water conserving plumbing fixtures.
ii) A Certification of Compliance has been issued for compliance
with Public Buildings and Plumbing regulations.
iii) There will be no toxic industrial wastes injected into the soil
or noxious or unhealthy emissions into the air.
2-3. There is sufficient water available and no existing water supply will
be unreasonably burdened:
The applicant has a letter from the Champlain Water District which
indicates that sufficient water is available for this project. Any
industry which might require water in a manufacturing process in
excess of 0.25 m.g.d would require further analysis and consideration
however. (Exhibit 10)

4. There will he no unreasonable soil erosion or effects on the capacity
of the land to hold water:
i) The applicant has continued to work with the District Soil
Conservationist and will follow his recommendations. He will con-
sult with the conservationist for specific measures to prevent
erosion in the winter months.
ii) All disturbed areas will be topsoiled, seeded, and mulched within
one week of the completion of the foundation wall. (Exhibit 9)
5. This project will not cause unreasonable safety or congestion conditions
with respect to highways or other means of transportation:
This criterion was addressed in Land Use Permit #4CO296.
6-7. There will be no unreasonable burdens on educational or other municipal
services:
i) Criterion #6 was addressed in Land Use Permit #4CO296.
ii) Chief Goddette of the So. Burlington Fire Department has recommended
changes in the hydrant locations as specified on Exhibit 5, which the
applicant has agreed to install.
8. There will be no undue adverse effects on aesthetics, scenic beauty,
historic sites or natural areas:
i) The 50' X 182' section of the building will be a light brown steel
structure with dark brown trim. The 40' X 62' office/shop will have
diagonal pine siding and stone facing.
ii) The landscaping species will be approved by the County Forester
to insure that they are suitable for the site.
iii) The only exterior lighting will be floodlight on the office area.
iv) So. Burlington has required a $3,600 landscape bond.
9. The project is in conformance with the Capability and Development Plan:
i) The office area will have insulation with an R-value of R-36 in the
ceiling and R-19 in the side walls.
ii) The manufacturing/shop/storage areas will have insulation with an
R-value of R-13 in the roofs and R-10 in the side walls. These areas
will only be heated to 550-600. The plastics industry,which will occupy
part of the space, will produce some heat from the molding process.

10. The project is in conformance with the local plan:
The So. Burlington Planning Commission has found this project to be
in conformance with the City's Comprehensive Plan.
CONCLUSION OF LAW
Based upon the foregoing Findings of Fact, it is the conclusion of this
District Environmental Commission that the project described in the appli-
cation referred to above, if completed and maintained in conformance with
all of the terms and conditions of that application, and of Land Use Permit
#4CO296-2, will not cause or result in a detriment to public health,
safety or general welfare under the criteria described in 10 VSA §6086(a)
and that, pursuant to such section, a permit is therefore issued.
