On October 6, 1977 an application for an Act 250 permit was filed by
ALAN D. PA-.,T.iR, P. 0 .Box 2346, South Burlington, for a project generally
described as a 5 lot industrial subdivision, Williston Road, .South
Burlington, Vermont.
The tract of land consits of 14 acres. The applicant's leMl interest
is owner.
Under Act 250 projects are reviewed based on the 10 environmental criteria
of 10 VSA, s6086 (a) 1-10. Before granting a permit, the Board of District
Commission must find that the project complies with these criteria and is
not detrimental to the public health, safety or general welfare.
Decisions must be stated in the form of findings of fact and conclusions of
law. The facts we have relied upon are contained in the documents on file
identified as Exhibits A through P, (and the evidence received at the
hearings November 16, 1977 and December (9, 1977).
Parties to this application are:
(A) The Applicant - Alan D. Palmer
(B) The Regional Planning Commission (by) Douglas Whitney
(C) Agency of Environmental Conservation (by) Russell Reay
In making the following findings, we have summarized the statutory language
of the 10 criteria of 10 VSA s6086 (a):
1. There will be no undue water or air pollution:
a. Any industry locating in the development will be reviewed for con-
formance to the State air pollution rep
ulations.
b. the project has been reviewed by the Agency of Environmental Conser-
vation under the Vermont Health Subdivision Regulations. The Agency has
approved lots 1 and 2.
c. The applicant proposes to place storage buildings without sewer or
water facilities on lots 4 and 5. Lot #3 will be improved by the applicant,
who will re -apply for approval of that lot under the Health Subdivision
Regulations.
2.-3. There is sufficient water available and no existing water supply will
be unreasonably burdened:

4. There will be no unreasonable soil erosion or effects on the capacity of
the land to hold water:
a. The applicant will utilize the measures specified in the erosion control
plan submitted as part of the application. The applicant will further
comply with the recommendations of the Soil Conservation Service described
in a letter of November 22, 1977.
5. This project will not cause unreasonable safety or congestion conditions
with respect to highvra.ys or other means of transportation:
a. The access onto Williston Road will be constructed as approved by the
Vermont Highway Department. Williston Road will be modified to provide for
a left turn lane for eastbound traffic. Although the truck lane up the hill
will be eliminated, it has not been entirely satisfactory due to insufficient
area to blend into traffic at the top of the hill.
b. The Vermont Hifnway Department has testified that the access and
improvements appear satisfactory and would function due to the depTee of
traffic on the access.The solution to the traffic problem on Williston Road
will be the widening of the road to four lanes. There is a possibility
that the road could be funded as an urban systems project.
c. The sight distance of more than 400' to the west is within the
desirable distance specified for roads of that size.
6.-7. There will be no unreasonable burdens on educational or other munici-
pal services:
a. The City of South Burlington has stated that the project will not
place a significant burden on necessary municipal services. A bond will be
requiredfor the construction of the road.
8. There will be no undue adverse effects on aesthetics, scenic beauty, his-
toric sites or natural areas:
a.F,ach building in the project will be submitted to the Commission for
review prior to construction.
9. The project is in conformance with the Capability and Development Plan:
a. Buildings in the project will be reviewed by the Commission for energy
conservation before they are constructed.
10. The project is in conformance with the local and regional plans:
a. The City of South Burlington has stated that the project is in conform-
ance with the local plan.

cation referred to above, if completed and maintained in conformance with
all of the terms and conditions of that application, and of Land Use Permit
ACO296, will not cause or result in a detriment to public health, safety
or general welfare under the criteria described in 10 V.S.A. §6086 (a)
and that, pursuant to such section, a permit is therefore issued.

been no accidents reported within 4001yards of that intersection, during the
period of a year or so. He said that Mr. Searles had not thought this was a
dangerous intersection. This period was July 1 to June 30, 1976 to 1977. Mr.
Hendley said that his information did not cover that period.
Mr. Morency asked what limited the sight distance here and was told that it
was the vertical curve of Hinesburg Road.
Mir. William Mikell said that he lived on Van Sicklen road east of the proposed
project and that he was the abutting owner on the east. He did not know if
he represented the views of his neighbors. He said that the proposed plan
seemed reasonable but that he wanted to call attention to a few things. He
said that he would be opposed to an access road to Van Sicklen because it
would cross a beautiful open space and would be an eyesore. He also felt
that the 4 long "finger" lots would not prove useful to the people living
on them. The back portions, he said, would not be used much at all. He also
felt that there would be no way for people to get to some lovely open space
near Muddy Brook. Mr. Segal replied that they are going to give a pedestrian
easement on the east end of the property. Mr. Page felt that this issue should
be looked at some more before final plat. Mr. Mikell said that he would not
like to see lot 5 developed without another hearing because he was afraid that
any building in there would have a tendency to pollute Muddy Brook.
Mr. Levesque pointed out that it was very late and that the discussion had not
ended yet.
Mr. Poger moved to continue the public hearing to the meeting of November 6,
1977 at 7:30 pm. in City Hall. Mr. Ewing seconded the motion and it passed
unanimously.
Mr. Levesque said that he would like a report on the trail system from Bill
Schuele's group. Mr. Morency said that he would like more information on
the sewage and drainage systems here. Mr. Woolery said that he would like
Mr. Szymanski to look at the details of the public road here. Mr. Morency
suggested that the developer also talk to the City Engineer about the height
of the road at the intersection with Hinesburg Road.
Public hearing - Preliminary Plat, Muddy Brook Industrial subdivision, 5 lots,
4050 Williston Road
Mr. Ewing excused himself from this discussion. Mr. Alan Palmer said that
there would be 5 lots on the land near Mluddy Brook and the Airport land. The
land is zoned Industrial and Airport Industrial and no one is sure exactly
where the line is. He said that the main issue was the access problem and
that he had several letters from the Highway Department. The last one he
received, he said, agreed to the access he snowed the Commission. The land
slopes to the east at 5-7%. Powerlines run through the property, but Mr.
Palmer said that the power co. was going to move the poles so that they would
be farther east and out of the right of way of the road. Set -backs, power -
lines and topography limit the buildable area of this land. He can put
parking or storage under the pererline easement, but no permanent structures.
Mr. Morency.asked about the CO district near the brook and was told that it
coincided pretty well with the top of the bank, so it did not really enter
into the buildable area. :4r. Palmer said that he had room to put a 40' x
60' storage building on lot 5 with parkin; under t::e Powerline.
As far as access, he said that the intersection would be 450' - 500' from the
brcw of the hill and t::at the speed limit is 35::ph in there. There would be
a restriction on left turns coming east by having one of the access roads
too narrow for a large truck to negotiate. Trucks would have to enter by
making a right turn.

Mr. Morency asked about the on -site sewage disposal and was told that the only
lot that would not meet requirements would be ##5 and the building that will go
there will not produce effluent - it will just have water for a sprinkler
system. Mr. Levesque asked about the possibility of a pedestrian easement to
the brook and Mr. Palmer said that he was in favor of that. Mr. Poger asked
if the proposed uses were compatible with the zones and Mr. Page replied that
he would look into that more before final plat. Mr. Poger asked if Mr. Palmer
could phase development so that the Commission could see how the access was
working out and was told that that would be OK if the road could also be
phased. He did not want to be limited as to which lot he worked on first,
though. Mr. Page said that he would like to have more information on erosion
controls that would be used during construction. Mr. Palmer said that they
would seed and mulch.
Mr. Woolery moved that the South Burlington Planning Commission aplrove the
preliminary plat application of Alan D. Palmer, for a 5 lot industrial sub-
division, as depicted on a plan set of 3 pages, entitled °1i;uddy _k ndustrial
1) The J ustrial/Airport Industrial boundary line shall_ be_ as shown
on the plan of record.
2) Pere test data shall be required prior to issuance of any building
permits.
3) The possibility of a right of way, between lots 1 & 2, for access
purposes from the property to the west shall be explored ;rior to, and resolved
at, the final plat hearing
4) The desirability of setting a strip of land aside for widening o
Route 2 shall be determined by the City Engineer, and shall be shown, if
appropriate, on the final plat.
5) Improvements to Route 2 shall be as mutually agreed upon by the
State Highway Department, City Engineer and applicant, and shall be installed
at the developer's expense; access layout shall be determined in simil-
fashion and shown on the final plat.
6) Applicant shall meet with the Natural Resources Committee regarding
avossible Pedestrian easement extendinnorthward_frggi_t�le_ Qnd. of the cul-de-
sac, which is to be added to the final plat, if appropriate.

The motion was seconded by Mr. Morency, who said that he would like the erosion
control measures checked by someone and that he would like to see some traffic
figures for the area for final plat. He also wanted some figure for the distance
of the building on lot 5 from the bank. Mr. Palmer thought it would be 15'.
Mr. Foger felt that the Commission should limit the size of that building.
The motion passed unanimously.
Public Hearing - Final Plat, Brand Farm Condominiums (150 units) 800 Dorset
Street
Mr. James Lamphere said that at the preliminary stage the problem with this
project had been that there was not enough room in the Airport Parkway sewage
treatment plant for it. The developers had an independent study done by a
consulting engineer using flows recommended by the Department of Health,. and
this study shows that there is enough rocm. He said that they felt that Mr.
.Szymanski's estimate of 350 gallons per day per unit was high. He said that
he realized that Mr. Szymanski was thinking of infiltration, but felt that
that was already in the system and that the newer pipes do not allow so much
of it.- He said that they felt the capacity was there and he requested approval
for the development.
Mr.Poger said that Mr. Szymanski was probably right to give the Commission
conservative figures because that gave the city more protection. He also
said that there would probably be enough room for the project eventually and
that they could build as capacity became available. Using the city figures,
he said, there was room for phase 1 at least. Mr. F.oger Curtis felt that
approval for phase 1 only would be a hardship.. Approval for 2 phases would
carry them through to the sewer vote. Mr. Page said that Mr. Szymanski felt
that because of the reduction in units in other projects, there was enough
capacity for phase 1 but not 2. Mr. Lamphere said that I•ir. Szymanski would
not discuss the report. Mr. Poger felt that the Commission had to rely on
the judgement of its City Engineer and said that he could not vote for another
phase if the City Engineer said the capacity was not there. Mr. Page pointed
out that there was a plan for a motel and restaurant that had an approval and
no expiration date. Mr. Levesque felt that the Commission should go with the
Department of Health figures. He said that when South Burlington had been a
town, they had had a Manager and an Engineer and that when they grew a great
deal and became a city, they had one man doing both jobs. He felt that that
was too great a workload for one man. Mr. Woolery felt that because these are
two -bedroom units, there may not be as many people in each as in a single family
home. Mr. Peter Collins felt it was unfortunate that the members of the
Commission had not received copies of the study, which he felt would convince
them about the capacity. Mr. Lamphere asked whether this project was next in
line for sewer capacity and was told that that was correct. Mr. Collins felt
that that was not what was happening- he pointed out that Country Club Estates
had been given capacity before this project by the City Council. Mr. Poger
said that as far as the Commission knew, Brand was next on the capacity list.
Mr. Ewing said that he would like to see the developer's report. Mr. Poger
asked Mr. Page to ask the City Attorney if the Commission could put expiration
dates on approved plans. This would give the city mcre capacity to work with.
Mir. Collins asked that the Commission approve phase 1 and continue the rest
until the next meeting;, during which time the consultant's report would be made
available to the members.

I move that the South Burlington Planning Commission approve the
final plat application of Alan D. Palmer, for a five lot industrial
subdivision, as depicted on a plan set of. 3 pages, entitled "Muddy
Brook Industrial Park...", dated 11/l/77, drawn by D. Duckett, sub ect
to the following stipulations:
1) Layout of access point (as depicted on plan accompanying
Highway Department letter of November 23, 1077) shall be shown on
the final plat for recording.
2) P erc test results shall be required prior to issuance of any
building permits.
'-3) Land for road widening and the pedestrian easement shall be
secured by offers of irrevocable dedication.
4) This plan is subject to a final utilities review by the City
Engineer.
,5) Because the ability of the proposed roadway and access
improvements to remedy potential traffic hazards is unknown, 3 of
the lots may be developed after final plat approval; development of
the .remaining 2 lots is contingent upon Planning Commission review of
accident patterns and locations, at least 1 year after the first 3
lots have been developed and are inuse; additional roadway or access
improvements may be required before the balance of the lots may be
developed.
6) Bonds, in an amount set by the City aiigineer, :tor all required
improvements, shall be posted prior to the issuance of any building
permits.
7) The final plat shall be recorded within 00 days and reviewed

The proposed addition, 1100 square feet in size, will fit in
the "ell" of an existing structure. Parking, circulation, and
access are adequate. The amount of landscaping conforms to ord-
inance requirements; however, I recommend that the landscaping be
relocated to the front of the property, closer to Williston Road,
if possible.
2) Final Plat, Muddv Brook Industrial Park
The application is complete; I suggest two further chances:
first, to show the layout of the approach to Williston Road (as
required by the Highway Department) and secondly, pedestrian trail
easements be added. Both of these changes could be made conditions
of approval.
3) Chastenay, 1 lot Subdivision
Contour information shows there is adequate buildable area
for a duplex on the proposed lot. A restriction to minimize or
prevent erosion would be in order. A survey ;rust be recorded be-
fore a building permit is issued. A pedestrian easement, contiguous
with the existing sewer easement on this property, should be con-
sidered. The City Engineer must approve the hook-up to municipal sewer.
4) Sketch Plan Review, DesLauriers Property
Lot layout and access plans appear to be excellent.
Soils on the proposed residential appear to be quite wet. A
small drainageway will need to be culverted for about 60 feet.
Finally, because of the sewer capacity shortage, no more than 1 or
possibly 2 lots should be granted final subdivision approval at
this time.
A use variance for a small (3,000 square feet) office building
at the southern edge of the property has been granted by the Zoning
Board of Adjustment.

EROSION PROTECTION
A. Sediment basins or traps will be constructed to keep
the soil on the site.
B. Cut and fill slopes will be stabilized with temporary

SUGGESTED MOTION OF APPROVAL
MUDDY BROOK INDUSTRIAL PARK
I move that the South Burlington Planning Commission approve
the preliminary plat application of Alan D. Palmer, for a 5 lot
industrial subdivision, as depicted on a plan set of 3 pages,
entitled "Muddy Brook Industrial Park... dated 8/22/77, drawn
by D. Duckett, (with page 3, as revised, showing proposed contours)
subject to the following stipulations:
1) The Industrial/Airport Industrial boundary line shall be
as shown on the plan of record.
2) Perc test data shall be required prior to issuance of any
building permits.
3) The possibility of a right of way, between lots 1 & 2, for
access purposes from the property to the west shall be explored prior
to, and resolved at the final plat hearing.
4) The desirability of setting a strip of land aside for
widening of Route 2 shall be determined by the City Engineer, and
shall be shown, if appropriate, on the final plat.
5) Improvements to Route 2 shall be as mutually agreed upon
by the State Highway Department, City Engineer and applicant, and
shall be installed at the developer's expense; access layout shall
be determined in similar fashion and shown on the final plat.
6) Applicant shall meet with the Natural Resources Committee
:regarding a possible pedestrian easement extending northward from
the end of the cul-de-sac, which is to be added to the final plat,
if appropriate.
7) Applicant, or his assigns, shall apply for no dimensional
variances in the development of any of the lots.
8) Specifications and layout of city street, water main and
hydrants, and storm drainage shall be as approved by the City
Engineer.
9) Because the ability of the proposed roadway and access
improvements to remedy potential traffic hazards is unknown,
of the lots may be developed after final plat approval; development
of the remaining lots is contingent upon Planning Commission review
of accident patterns and locations, at least 1 year after the first
lots have been developed and are in use; additional roadway or
access improvements may be required before the balance of the lots
may be developed.
10) More detailed erosion control measures shall be presented
on the final plat application.

Th application is complete. I suggest the following issues
or changes to the plan be considered by they Commission:
Access
The Highway Department has approved the location of th- access
point; modification to Williston Road at or near the proposed
intersection may be required to minimize traffic hazards. Phased
development of this protect, on a trial basis to see how the access
works out U.:!. - allow development of several lots and then review
the "on line" experience) may be desirable.
The applicant ha.s tentatively agreed to providE- a strip of
land for widening Williston Road.
Miscellaneous
The Commission must determine the dividing line. between the

Date: October 21, 1977
Area zoned Industrial District, lots as proposed are conforming
to dimensional requirements, area served as pasture land in past
years.
Soils are Adams -Windsor loamy sands with severe slopes. Green
Mountain has of 100 feet north -south right-of-way through the
parcel. A portion of the right: -of -way is proposed to be easterly
property line of this parcel which is Conservation - Open Space
District a distance of 100 feet from the center line of the stream.
Location of the proposed road off from Williston Road will require
approval of the State Highway Department (Mr. F.C. Evans has been
informed by Mr. Palmer with comments forth -coming.
Municipal sewer is not available to this site therefore on -site
disposal is required, prior to final approval percolation tests
will be required.
Lot #5 has very little buildable area and will require some filling.
Approval should be conditioned, that this lot be developed in total
conformance to the zoning regulations.
Any grading of this parcel should be done maintaining a slope that
will not erode into Muddy Brook.

SCOPE OF PROJECT
The overall intent of this project will be to create 5 indust-
rial lots that will front on a public street and have public water
to service the establishments.
Proposed buildings are warehouses, storage facilities, and
commercial business. These types of buildings do not require much
solid waste, therefore, it is proposed to treat the sewage on the
industrial lots where applicable. Please find enclosed soil test
conducted by Trudell Consulting Engineers, Inc. which established
the soil charateristics.
Palmer Company, LTD. of South Burlington will be constructing
all the proposed structures, and a public building permit is re-
quired for each commercial or industrial complex.
The exact location and size of each building is not known at
this time and as each lot is built upon a site plan will be submit-
ted with the necessary details required.
It should be noted that lot //5 is about 41 to 51 lower than
the proposed road. This lot will be filled with excavated materi-
,)ls to enhance the gradirkg.
In an overview of this Industrial Development I have contract-
ed Mr. Schmitt, the airport manager and explained to him the proposed
details. He thought it was a good idea and didn't see any inter-
ference with the operations of the airport.
I also have been working with the Vt. Highway Dept. (Mr. Frank
Evans, Utility Engineer) very closely, they have approved my road
location and are working out the intersection details. (please find
enclosed letter)

PRE -HEARING COMMENTS
Enclosed are comments of the Environmental Advisor, the Vermont Department
of Highways and the Regional Engineer.
Windsor loamy sands have been identified by the Soil Conservation Service
as primary agricultural soils in this state. The District Environmental Commission
must review the issue of reduction of the agricultural potential of the
soils, and particularly, whether the development has been planned to minimize
the reduction of agricultural potential by providing for cluster development
and like measures designed to economize on land usage.
The Interagency Act 250 Review Committee supports the suggestion of the
Environmental Advisor that the individual firms should apply for co -applicant
status and be required to go through Act 250 Review individually. In
particular, issues of waste disposal, erosion, traffic, aesthetics and impact
of growth should be reserved for review as each tenant comes forward.
The application indicates that the applicant will be constructing all
buildings itself. The District Environmental Commission must review the issue
of energy conservation with regard to the proposed buildings.
It appears in the plans that a 12 foot road cut may be necessary. No
cross sections or information on final slopes were provided. Erosion is a
potentially serious issue with regard to this application, but there is little
information on which to evaluate the potential for erosion. Furthermore,
one lot will require extensive fill. The means of handling both temporary and
permanent erosion control should be addressed by the applicant.
The Division of Historic Sites reports that it has located many archaeologic
sites along Muddy Brook. The Division has obtained permission from the applicant
to perform a site survey before hearings on the matter. The results of that
review will be forwarded, if pertinent.
It appears that a storrimater discharge permit will be required for surface
water discharges to Muddy Brook.

DETAIL SPECIFICATIONS FOR INDUSTRIAL COURT
The roadway will be a cut -fill project where as the material
cut out shall be used to fill where needed, the cut slopes will
be of 1 on 2, also fill slopes will be 1 on

CROSS SECTION SPECIFICATIONS
Fill areas shall be compacted in 1t layers to 95,,0 with a vib-
ratory roller.
The gravel -subbase will be 8" due to the sandy material on
cite, a shim course of 2" to 3" will be placed prior to paving.
The road will have concrete curbing which will confirm to City of
South Burlington requirements. There will be a 5' shoulder from
the face of curb to either ditch line or top of slope.
The shoulder will be sloped 1" per 11 away from the curb.
EROSION PREVENTION
Care shall be taken during construction not to leave exposed
excavation and landscaping without taking measures far erosion con-
trol.
Seeding mixture per acre shall be 6i# red clover, 3" orchard
grass, 3# red top and 10## rye grass (for quick cover) and mulch.
Bales of hay or equal shall be placed lengthwise across ditch-
es and spaced 20 - 25 feet apart. Bales shall remain until veget-

SCOPE; OF PROJECT
The overall intent of this project will be to create 5 indust-
rial lots that will front on a public street and have public water
to service the establishments.
Proposed buildings are warehouses, storage facilities, and
commercial business. These types of buildings do not require much
,,,,-)lid waste, therefore, it is proposed to treat the sewage on the
industrial lots where applicable. Please find enclosed soil test
conducted by Trudell Consulting Engineers, Inc. which established
the .coil charateristics.
Palmer Company, LTD. of South Burlington will be constructing
all the proposed structures, and a public building permit is re-
quired for each commercial or industrial complex.
The exact location and size of each building is not known at
this time and as each lot is built upon a site plan will be submit-
ted with the necessary details required.
It should be noted that lot #5 is about W to 51 lower than
the Droposed road. This lot will be filled with excavated materi-
als to enhance the grading.
In an overview of this Industrial Development I have contract-
ed Mr. Schmitt, the airport manager and explained to him the proposed
details. He thought it was a good idea and didn't see any inter-
ference with the operations of the airport.
I also have been working with the Vt. Highway Dept. (Mr. Frank
Evans, Utility Engineer) very closely, they have approved my road
location and are working out the intersection details. (please find
enclosed letter)

-Site Plan Review- Parkhill Apartments
Applicant is meeting with Fire Chief today - a revised plan,
reflecting agreements reached at this meeting (and also showing
the increased parking requested by the Commission), will be
presented.
-Sketch Plan Review- Palmer Industrial Subdivision
The proposal is a simple land subdivision of a parcel of 14
acres, into five 2 acre lots. 3 of the lots fall within the Ind-
ustrial District, and two within the Air-nort Industrial District.
1. Access -Curb cut location is critical, due to high steed
traffic, hill, and curve on t:,is section of Vdilliston Road. The
Plan calls for widening of Williston Road here.
Ownership, right of way width, and layout of cul-de-sac
proposed should be determined.
2. Lot Layout $ topography -Because of steep slopes, lot lay-
out should be scrutinized to be sure there is adequate buildable
area on each lot.
3. Sewage Disposal -If City Sev,,er is proposed, effluent will
have to be pumped; there is no available capacity at this time.
Soils are Adams sands, whose suitability for on site sewage disposal
is good on slight slopes, and aecreases with increasing slopes.
-Site Plan Review -Addition to Nforco Auto Parts
A.3800 square ft. addition to the existing structures (approx.
2000 sq. ft.) is proposed. Applicant obtained a dimensional variance
to build within 2 feet of the property line.
Stipulations of the variance include: paving of the entire
parking area and better delineation of the two curb cuts and
parking spaces.

This project, consisting of connecting Lots #2, #3 and #5 referenced in Certification of Compliances
4CO296-2 (Lot #2), 4CO296-3 (Lot #5) and 4CO296-4 (Lot 93) and Lot #4 referenced in Public
Building Permit P84-1404 and Water Supply and Wastewater Disposal Permit W W-4-0287 within
the Muddy Brook Industrial Park, served by municipal water and sewer services, located off Williston
Road in the city of South Burlington, Vermont is hereby approved under the requirements of the
regulations named above, subject to the following conditions.
This permit does not constitute approval under Act 250 case number 4CO296.
GENERAL
This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from the Act 250 District Environmental Commission, the Department of
Labor and Industry -phone (802) 828-2106 or (802) 658-2199 and local officials prior to
proceeding with this project.
2. The project shall be completed as shown on the following plans which have been stamped
"approved" by the Wastewater Management Division:
Job No. 97176, Sheet C-1 "Site Plan" dated 12-29-97 revised 1-14-98; Sheet C-2 "Sta. 0+00
to Sta. 5+20" dated 12-29-97; Sheet C-3 "Sta. 5+20 to Sta. 10+00" dated 12-29-97, Sheet
C-4 "Pump Station Details and Specifications" dated 12-29-97; and Sheet C-5 "Details"
dated 12-29-97 prepared by Champlain Consulting Engineers, Inc..
The project shall not deviate from the approved plans without prior written approval from
the Wastewater Management Division.
The Wastewater Management Division now reviews the sewage and water systems for public
buildings under 10 V.S.A., Chapter 61 - Water Supply and Wastewater Disposal Permit.
4. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose
of ascertaining compliance with Vermont environmental/health statutes and regulations, with
this permit.

All conditions set forth in Certification of Compliances 4CO296-2, 4CO296-3 and 4CO296-4,
Public Building Permit P134-1404 and Water Supply and Wastewater Disposal Permit WW-
4-0287 shall remain in effect except as modified or amended herein.
6. No alterations to the buildings that would change or affect the exterior water supply or
sewage disposal, or the approved use of the buildings shall be allowed without prior review
and approval from the Agency of Natural Resources.
7. A copy of the approved plans and this permit shall remain on the project during all phases of
construction and, upon request, shall be made available for inspection by State or local
personnel.
SEWAGE DISPOSAL
8. The sewer collection system from each building to the pump station (including eliminating the
existing septic tanks, pump station modifications and force main construction herein approved
shall be routinely and reliably inspected during construction by a Vermont -registered
professional engineer who shall, upon completion of construction and prior to activating the
pump station, report in writing to the Wastewater Management Division that the installation
was accomplished in accordance with the approved plans and permit conditions.
9. The project is approved for wastewater disposal by connection to the municipal sewer system
for a maximum of 2,800 gallons of sewage per day. No other method of wastewater disposal
shall be allowed without prior review and approval by the Wastewater Management Division,
and such approval will not be granted unless the proposal conforms to the applicable laws and
regulations.

I have reviewed the plans for the above referenced project and find them to be acceptable. The
construction of the force main will require a permit from the State Highway Department because
Williston Road in that area is State maintained. Work within Palmer Heights will require a permit
from the South Burlington Street Department. I assume Champlain Consulting Engineers will
oversee the construction and testing of the pumping station and force main.

I have reviewed the plans for the above referenced project and find them to be acceptable. The
construction of the force main will require a permit from the State Highway Department because
Williston Road in that area is State maintained. Work within Palmer Heights will require a permit
from the South Burlington Street Department. I assume Champlain Consulting Engineers will
oversee the construction and testing of the pumping station and force main.
