Dear Ray:
We are writing on behalf of Gardner Construction, Inc. (c/o Brad Gardner) to request
Development Review Board scheduling and review of the attached Sketch Plan for a 7 Lot, 23 Unit PRD
located at 1398 Hinesburg Road.
A Sketch Plan was previously submitted to the City on 1/15/2016 and was presented to the DRB
on 4/5/2016. As it has been more than 6 months since the DRB Sketch Plan hearing, we are resubmitting
the attached application for Sketch Plan review. The attached plans have been revised to incorporate
feedback from the 4/5/2016 Sketch Plan hearing.
The project involves two parcels owned by Brad Gardner (Parcel ID #0860-01398) totaling 5.84
acres. The parcels are located within the Southeast Quadrant - Neighborhood Residential zoning district.
The proposal is to dissolve the lot line between the existing parcels and subdivide the parcel into 7 lots.
A total of 23 units are proposed. Of the 23 units, one (1) unit is the existing single family home to
remain, four (4) are proposed single family lots, twelve (12) are proposed carriage homes and three (3)
are duplexes. Units 1-4 are currently proposed as 1 story units as to minimize the developments visual
impact from Hinesburg Road.
As part of this subdivision Wildflower Drive is to be extended from the "Summerfield"
subdivision to the south and connect back into Hinesburg Road at the existing driveway location for
1398 Hinesburg Road directly opposite Butler Drive. Per a 1/20/16 meeting with City Staff, Wildflower
Drive is proposed at 24' wide, to minimize impervious surface and match the existing pavement width
within the Summerfield subdivision. All units will be served by municipal water and sewer.
There is an existing Class II Wetland in the north-west corner of the property and Class III
wetlands located along the eastern property line and western property line. The connection of
Wildflower Drive directly across from Butler Drive will have marginal impact to the Class II wetland and
buffer. Detailed information regarding the proposed wetland impacts will be provided with our
preliminary submittal.

Please see below for a summary of the plan changes as a result of the former Staff Report,
Sketch Hearing and meeting with Staff:
1) The duplex units along the southerly property line (adjacent to the Summerfield
development) have been replaced with carriage homes to fit the character of the
surrounding neighborhood. This results in three (3) units vs. the four (4) units previously at
this location.
2) The common amenity area has been revised to remove a carriage unit (Unit 7 in the
previous 1/15/2016 submittal) to increase the Common Land area and make the area more
accessible to the surrounding neighborhood. The plans have been forwarded to a Landscape
Architect who will provide additional detail regarding the common amenity area with the
preliminary submission.
3) Per a conversation between Brad Gardner and Kevin Dorn, the six (6) carriage homes
located in the north-west corner of the property are sized based on the existing homes
located on Kirby Road. These six (6) units replace the previous three (3) units at the north-
west corner and result in one (1) additional unit, despite the reduction of one (1) unit along
the southerly boundary and one (1) unit abutting the Common Land.
4) The private drives serving units 6-11 & 17-22 have been reduced to 200' in length.

Paul: While your recollection differs from ours, thank you for replying.
We remain hopeful due to being at the Sketch level the Sketch that the DRB will see some positives in the changes made
since the 2016 Hearing.
We understand more work is necessary for the Common Amenity Area, but suggest it’s a bit premature at the Sketch
level.

Thank you for your note. It’s my understanding that Marla spoke with you last week regarding the
Hinesburg North View Protection District. It’s a restriction on the property that all parties must have
missed in April 2016, but certainly better to know now than at a later stage in the review. You note that
you may wish to seek a zoning amendment on this item. Should you wish to do so, the Planning
Commission has a policy in place for the consideration of zoning amendments. I’ve attached it for you.
The Commission’s next round of “initial reviews” will take place on October 9th; the deadline for
submission of requests is September 7th. The following round will be in March/April.
Regarding the rest of the design, as you know, the Board provided feedback in April of 2016 regarding
the overall design and intensity of the layout as presented. Staff’s notes at this sketch plan is, we
believe, consistent with the Board’s guidance and with our prior general feedback. We do appreciate the
modifications that were made to the Wildflower loop road dimensions.
With regards to the open space, from staff’s perspective we feel it is possible this area could if well
designed, and so that is why our comments focused on the need for a preliminary layout of this area.
With regards to the dead‐end roads and overall site layout, our notes indicate, as we have before, that
design as presented is problematic and we have encouraged your team to look into alternative
arrangements that better meet the purposes of the regulations.
We are happy to work with your team in any way that can be of help.
Marla will be our staff person at tonight’s DRB meeting.

Paul / Marla: I am writing to inquire as to whether Paul intends to be present at tomorrow’s DRB
Hearing. As you may be aware the Staff Notes for the Gardner’s Sketch Plan at 1398 Hinesburg Road are
not good, stating “several major issues of concern with the proposal” and recommending “continuing
the meeting to address issues with the application form, if any, and to potentially allow design technical
review”.
We feel that this submission did address the issues formally raised at the 4/5/2016 Sketch Hearing as
outlined in our July 17, 2018 cover letter. Namely, the two (2) duplex Units formerly proposed along the
southerly property line were reduced to three (3) single Units to better blend with the Wildflower loop
single family homes, former Unit 7 was eliminated in the interior circle to provide for an increased
Common Amenity Area and the Private Roads serving Units 6 – 11 and 17 – 22 were reduced in length to
not exceed the 200 lf requirement. While two (2) Units were removed at key locations the change to six
(6) small Units at the northeast corner of the parcel replace the former three (3) larger Units resulting in
a change from 22 to 23 Units.
Hopefully, Paul recalls that this proposal had an informal meeting with Staff including you prior to the
additional land at the northwest corner of the parcel purchased from South Burlington Realty Company
and more importantly had a “Design Technical review” meeting on 1/20/16 as referenced in our July 17,
2018 cover letter for this submission. While my notes nor recollection recall specific discussion of the
“Hinesburg North View Protection District”, the layout at the northwest corner of the project is the
same as reviewed at the 1/20/16 meeting at which we discussed these Units being 1 story to reduce the
visual impact from Hinesburg Road and were asked to include a porch and front façade appearance on

Unit 1 (done), Justin Rabidoux requested a decrease in road width for consistency with Wildlife Loop
(done) and Paul discussed the need for a better Common Amenity Area. As stated above and in our July
17, 2018 cover letter, a Unit was eliminated in this area. In addition, the Gardner’s did hire Terry Krinski
Landscape Architect who did come up with a Concept which will be finalized and provided with
Preliminary Plan submission.
In addition to the above regarding the “Hinesburg North View Protection District” the Gardner’s moved
forward with the purchase of the approximate 1 acre parcel from South Burlington Realty Company
following the 1/20/16 meeting with Staff and the 4/5/2016 DRB Hearing as well as the subsequent Re‐
Zoning of the 1 acre to allow for the purchase and use with this project. In review of the Regulations
regarding Scenic View Protection Overlay District we are in hopes that the DRB will grant a waiver for
Units 1 – 5. If not, we will pursue a re‐designation of the District to be consistent with the re‐zoning as it
appears the 1 acre was merely a southwest appendage of the South Burlington Realty Company lands
and had little if anything else to do to “..encourage the preservation of spectacular views of the Green
Mountains”.
Paul, we are in hopes that you have planned on attending tomorrow’s DRB hearing and regardless,
request your input on the above. We look forward to hearing from you.

Hi Paul/Marla,
Following up from the 8/21/2108 DRB Meeting and 10/9/2018 Planning Commission Meeting, it appears the Planning
Commission will be moving forward with looking into amending the View Protection Corridor at 1398 Hinesburg Road,
although the timeframe is not exactly clear when this will occur.
The continuation of the 1398 Hinesburg Road Sketch Plan (SD‐18‐26) is scheduled for the DRB on 11/6/2018. The intent
of continuing SD‐18‐26 was to allow for the 6 month approval window to align with Planning Commission
recommendation to remove the view protection corridor, and as we are unsure when the Planning Commission will be
taking this item up, we are requesting that the DRB continue SD‐18‐26 to the maximum date that they’re
conformfortable with.
We were not planning on attending the DRB meeting next week so please pass this request along to the DRB. If you
need a formal letter please let me know.

Following up from your 8/21/2018 email correspondence with David Burke, please see attached letter requesting the
Planning Commission initiate an amend to the City’s LDR’s to remove the portion of the Hinesburg Road North View
Protection Zone located on the 1.29 acre parcel to the north of 1398 Hinesburg Road.

As stated at the 8/21/2018 DRB meeting, we would like to schedule a meeting with Staff to review the overall design for
the PRD located at 1398 Hinesburg Road, but we feel it would be more productive to schedule this meeting after the
October PC meeting once we receive initial feedback on the view corridor.

Subject: Wetlands at Gardner Parcel at 1398 Hinesburg Road
Dear David,
I have reviewed the Gardner Parcel sketch plan and the proposed impacts to wetlands on the site
with regard to South Burlington Wetland Protection Standards and Review Procedures. Under
these standards, encroachment into wetlands and wetland buffers may be permitted if three
criteria are met. The first two of these – that the encroachments will not adversely affect the
ability of the property to carry or store flood waters adequately, and the encroachments will not
adversely affect the ability of the proposed stormwater treatment system to reduce sedimentation
according to state standards – are not applicable to this site as there is no floodwater storage on
the site and stormwater treatment proposed for the site (construction of a gravel wetland) will
actually enhance the value of two small Class III wetlands.
The third wetland protection standard allows encroachments if impacts to wetland values and
functions are minimized and/or offset by appropriate landscaping, stormwater treatment, stream
buffering or other mitigation measures
Five wetland areas were identified and delineated on this parcel:
1. The only Class II wetland is at the northwest corner of the parcel. This wetland and its
50-foot buffer are protected with the exception of the proposed roadway and sidewalk
which will aligned directly across from Butler Drive. This is a wet meadow that, because
it receives runoff from nearby roadways, is valuable for surface and groundwater
protection. Because it will be largely protected, the wetland’s capacity to perform this
function will not be affected.
2. The small Class III west of proposed Unit 23 that will be filled has very low values and
functions and apparently exists only because natural flows have been disrupted by the
existing driveway. This is a seasonal wetland characterized by hydrology at the drier end
of the scale which does not support wetland dependent species. It performs no protected
function at a significant level.
3. The small Class III depressional wetland (formerly a pond, now choked with persistent
emergent vegetation) in the southeastern corner of the parcel near proposed Lot 15 will
be preserved and have a protected 10-foot buffer that should be adequate to preserve its
values which are already compromised by surrounding land use.
4. The two small Class III wetlands in the northeastern corner of the parcel will be impacted
by construction of a gravel wetland stormwater management area, but this will offset
impacts by duplicating and enhancing the values and functions found in the existing
wetlands.
In summary, with the exception of the open water habitat found at the small pond in the
northeastern corner of the parcel, all wetlands on at the Project site are wet meadows, and as
such have limited functions and values. One small wet meadow area with minimal functions and
values will be filled, and impacts to all other wetlands have either been minimized or will be
offset by stormwater treatment facilities.
