HomeMy WebLinkAboutSD-97-0000 - Decision - 0200 Old Farm RoadFINDINGS OF FACT & DECISION STATE OF VERMONT S - U D0 COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Daniel & Leo O'Brien to subdivide a 78.22 acre parcel into three (3) parcels of 5.50 acres, 8.21 acres, and 65.51 acres, Kimball Avenue and Old Farm Road. On the 28th day of January, 1997 ,the South Burlington Planning Commission approved the request of Daniel & Leo O'Brien for preliminary and final plat approvals under Sections 203 and 204 of the South Burlington Subdivision Regulations based on the following findings: I. This project consists of the subdivision of a 78.22 acre parcel into three (3) lots of 8.21 acres (lot #1), 5.50 acres (lot #2), and 64.51 acres (lot #3). Sketch plan was reviewed on 11/26/96. 2. This property located on the corner of Kimball Avenue and Old Farm Road lies within the C2, R1, IC and CO Districts and the Airport Approach Cone Overlay District. It is bounded on the south by a residence and undeveloped land, on the east by Technology Park, on the north by Kimball Avenue, and on the west by residences and Old Farm Road. 3. Access: A common access easement is being reserved along the property line between lots 1 and 2 to allow for a possible future shared access between these two lots. This common access is designed so that it can properly accommodate a driveway at 90 degrees to Kimball Avenue. The plat includes the metes and bounds information for the shared access. 4. Lot size/frontage: Lots #1 and 2, which lie entirely within the C2 District, will meet the minimum lot size requirement of 40, 000 square feet (0 . 92 acres) . Lot #3 meets the minimum lot size requirement for all districts. 5. Lots #1, 2 and 3 meet the minimum frontage of 200 feet along Kimball Avenue and 120 feet along Old Farm Road. 6. Other: --- the base flood elevation data was provided. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the preliminary and final plat applications of of Daniel and Leo O'Brien to subdivide a 78.22 acre parcel into three (3) parcels of 5.50 acres, 8.21 acres, and 64.51 acres, Kimball Avenue and Old Farm Road as depicted on a plan entitled, I "Subdivision Plan Daniel J. O'Brien & Leo O'Brien Jr. O'Brien Home Farm Kimball Avenue and Old Farm Road South Burlington, Vermont," prepared by Krebs & Lansing Consulting Engineers, Inc., dated November 18, 1996, last revised 1/28/97, with the following stipulations: 1• All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Any changes to the final plat plan shall require approval by the South Burlington Planning Commission. 3. The final plat plan shall be recorded in the land records within 90 days or this approval is null and void.
