The applicant has not completely satisfied this office that he in fact
has a grandfathered lot. Attorney's for the City and the Hayden's are
working on this as of this date, by the hearing date, if the matter
is not resolved the appeal will require tabling.

Re: Hayden property, Orchard Road
Dear Mr. Ploof:
Due to the legal problem with the Hayden lot and a error in the
site plan (see copy enclosed) which resulted in a warning of the
hearing which is incorrect. It is advisable that you withdraw
your application in Meriting.
It is my understanding that Mr. Hayden wishes to market the
propc..ty to include the so-called extra lot.
In any case final action must take place by the next regular
Zoning Board meeting of September 13, 1982.
