6. Site plan application of Dave Desarno for erection of a modular
building for office use next to the rental car wash facility at
Burlington International Airport
Mr. Desarno said effective 11/1, they will have room for adminis-
trative offices except for an office for his own use. The re-
qeusted space is for his office. Mr. Weith said he found no
problem with the application.
Ms. Peacock moved the Planninq Commissionapprove the Site Plan
Application of Dave Desarno for erection of a 700 sq. ft. modular
building for office use as depicted on - a - 2-paqe set of plans
entitled "Burlinqton International Airport. National Car Rental
Lease Area," prepared by Jerry Damico and dated 10/89, with the
following stipulation:
1. The applicant shall obtain a building permit within 6 months or
this approval is null and void.
Mrs. Maher seconded. Motion passed unanimously.
7. Site Plan application of Wright & Morrissey for construction of
a 3-story. 20,500 sq. ft. buildinq for office use. 99 Swift Street
Mr. Webster said the building will be on the west side of the site
and will use the park curb cut, closing existing curb cuts. They
will pave and widen the park curb cut to 3 lanes (2 for exit).
The buildinq is 35 ft. hiqh. All setbacks are met. Wriqht &
Morrissey will occupy a portion of the building themselves,
leasinq the rest.
Mr. Weith said landscapinq is under the requirement. Mrs. Maher
asked for at least 1 everqreen and felt the whole landscape plan
could be better.
The city engineer has suqgested a professional enqineer desiqn the
storm system.
Mr. Weith noted they are short 8 parking spaces. Ms. Peacock suq-
qested reviewinq the situation in a year to see if they are
needed. Mr. Webster noted they lose 320 sq. ft. per floor for
stairs, 100 sq. ft. for elevator, and 60 sq. ft. for the elevator
equipment room. This reduces sq. footaqe for parking requirements
Mr. Craiq felt it was an acceptable trade-off for what they are
doing for Farrell Park.

Parking: The plan shows 31 parking spaces. The plan shows 2
handicapped spaces, however, these spaces are substandard. I am
unable to determine the required number of spaces because I do
not have all of the necessary information (i.e., office space
square footage, number of non -office employees and numbers of
company vehicles). I will try to have this information for
Tuesday's meeting.
Setbacks/coverage: Setback requirements are met. I will provide
proposed coverage at the meeting.
Landscaping: The project requires $12,600 in new landscaping.
The plan shows Norway Maple, Washington Hawthorn, Euonymus, Aus-
trian Pine, Lilac and yews. A row of Austrian Pine are proposed
along the north property line in order to screen the building and
loading area from the residence to the north. I will provide the
proposed value at the meeting.
Sewer: A sewer allocation of 270 gpd will be needed assuming 18
employees. This will be deducted from the total granted for the
subdivision. The applicant will be required to pay the $2.50 per
gallon fee prior to issuance of a building permit.
Traffic: The project will generate between 69 and 324 daily
trips and 8 and 40 peak hour trips depending on how much of the
building is office and how much is warehousing. The applicant
will be required to pay between $79 and $396 into the Williston
Road Improvement Fund. I will determine an estimated number of
peak hour trips and required fee before Tuesday's meeting.
Dave Desarno proposes to erect a 700 square foot modular office
building next to the existing rental car wash facility at Burl-
ington International Airport. The applicant has informed me that
he will be the only one in the office. It will be for his Na-
tional Car Rental business.
There will be no water and sewer hook up to the building. Bill
Szymanski had asked that the applicant add a note to the plan
indicating that if and when hook ups are proposed, that they be
connected to the existing sewer and water lines serving the car
wash. He has added this note.
Since this office is only for one person, I see no problem in
terms of parking, traffic, circularizer, etc.

The plan showing location of proposed modular
dated 10/89 is acceptable.
1. A large water shed area drains to this area. The drainage
system should be adequate to accommodate at least a 25 year
storm. An engineer should design the system to avoid possible
flooding in the area. The building should be along the east side
of the site on higher ground and the parking lot where the build-
ing is planned.
2. Drainage system shall be concrete or plastic, not metal or
aluminum.
3. Farrell park was given to the City. There may be
restrictions on its use. The deed should be checked for any
restrictions.
4. The City should not be responsible for maintaining the access
drive including snow plowing.
5. Recreation director Bruce O'Neill should review the proposed
park entrance plan.

Subdivision Regulations
With regard to the number of public hearings, Dick Spokets
interpretation of the law is that the final meeting on a sub-
division must be a public hearing. The rationale behind re-
quiring 2 public hearings, under the current regulations, is
that the first one (preliminary) is where a warned public hear-
ing is of great importance; the second (final) is largely a
formality; but is required by law.
Dick Spokes is currently researching two questions that
bear directly on these proposed amendments: first, in the
case of a fairly simplelstraightforward subdivision proposal,
is it possible to combine the preliminary and final public
hearings into one meeting? secondly, if the- f inal- plat- approval -
process were to be made largely an administrative matter, with-
out'a public hearing, would this conflict with the enabling
legislationT
Rental Car FaciLLtX
The site plan appears to be adequate in all respects. The
proposed access is somewhat circuitous. In the long run, as
traffic increases on Airport Drive, and new AI uses replace the
residential east of Airport Drive, the effectiveness of,pro-
posed access will probably deteriorate. For the interij/\., the
proposed right of way could be acceptable, provided theia are
assurances from the road owner that access privelages will be
maintained. Ultimately, I think it would be of mutual benefit
to both the applicant and the City if the entire operation
were contained within the Airport boundaries.

This project, consisting of amending Certification of Compliance #4CO3 ) I I to install an oil/water
separator, a new sanitary sewer line, simplex pump station and sanitary sewer manhole to connect to
the municipal sewer collection and treatment system two bays of car washing within the existing
building served by Municipal water located at 1200 Airport Drive in the City of South Burlington,
Vermont-, is hereby approved under the requirements of the regulations named above subject to the

This does not constitute approval under Act 250 case number 4CO311.
GENERAL
This permit does not relieve the permittee from obtaining all other approvals and permits as may
be required from the Act 250 District Environmental Commission, the Department of Labor &
Industry — telephone (802) 828-2106 or (802) 879-2300 and local officials pLiff to proceeding
with this project.
The project shall be completed as shown on the following plans which have been stamped

8. A copy of the approved plans and this permit shall remain on the project during all phases of
construction, and upon request, shall be made available for inspection by State or local personnel.
WASTEWATER DISPOSAL
9. The project is approved for wastewater disposal by the construction of a connection to the
municipal wastewater treatment facility as depicted on the approved plans. The project is
approved for a maximum of 2,600 gallons of wastewater per day. The Wastewater Management
Z:1
Division shall allow no other method, or location of wastewater disposal without prior review and
approval.
10. This permit issued by the Wastewater Management Division shall be valid for a substantially
completed wastewater system upon receipt by the Division of a certification from a State of
Vermont registered professional engineer, signed and dated, that states:
"I hereby certify that the instal lation-related information submitted is true and correct
and that, in the exercise of my reasonable professional judgment, the wastewater system
has been installed in accordance with the permitted design and all permit conditions,
were inspected, were properly tested, and have successfully met those performance
tests."
This shall include the installation of the oil/water separators, sanitary sewer lines, pump
station and manhole.

The South Burlington Planning Commission held a meeting on
Tuesday, 23 June 1992 at 7:30 pm, in the Conference Room, City
Hall, 575 Dorset St.

Mr. Weith noted a request from the Davis Co. for a 6-month ex-
tension on the Farrell St. building. They are still looking
for tenants. This would be their first extension

Mr. Weith directed members attention to a letter from FEP assoc-
iates (Ben Franklin store on Shelburne Rd.). They had proposed
some plantings and islands. When they were approved, the Com-
mission let them put in temporary islands. After a year they
were to make them permanent. They are asking for a delay until
the end of August to see if the Chittenden Bank is successful
with their negotiations with Mr. Farrell. Mr. Craig said the
Chittenden should come in at the same time this is discussed.

Mrs. Maher then moved to approve the Minutes as amended. Mr.

3. Site Plan application of Hertz Corporation for construction of
a 900 sq. ft. addition to an existing builidng for office -storage
use in conjunction with automobile rental, Burlington Interna-
tional Airport:
Mr. Dugan noted that in December they had an approval for the
same facility. This will house the facilities that are there
now. It was originally planned as a temporary building but they
now want it to be permanent. They are deleting the addition to

remain the same. This building will replace a 288 sq. ft. office
trailer. Mr. Weith noted the Airport is working on a landscape
plan that will include the $1,800. for this project. They are
trying to improve the front of the Airport. They may come to the
Commission if there are parking and/or circulation changes.
Mr. Weith noted there is an issue of a hydrant. The Chief asks
that it be raised and a gate be put in so it can be accessed for
this building. Mr. Dugan said they have no problem with this.

HERTZ OFFICE/STORAGE ADDITION - BURLINGTON INTERNATIONAL AIRPORT
2) This project consists of the construction of a 900 square foot
office/storage addition to an existing car rental service
facility. This is an amendment to a site plan approved by the
Planning Commission on November 19, 1992 (minutes enclosed).
This application increases the size of the office/storage area
from 644 square feet to 900 square feet, attaches the building
to the service facility and eliminates the 370 square foot
addition for storage and entry to the service building. The
new office/storage addition will replace a 288 square foot
office trailer used for several years.
The project site is located within the Airport zone just north
of the FAA control tower. It is bounded on the north and east
by a taxi runway, on the south by the FAA control tower and on
the west by Park & Fly. This site is shared with National Car
Rental. Both agencies use this site to store and service
rental vehicles.
Access/Circulation: Access to the site is via a two (2) way
service road connected to the one-way main terminal access
drive. The site is not accessible to the general public. A
chain -link fence completely surrounds the site and the access
gate is locked at night. Circulation pattern is acceptable.
Parking: No additional parking needed since the new building
is to replace an existing office building and the general
public will not use the site.
Landscaping: The landscaping requirement for this project is
$1,800. This site is hidden from view and not accessible to
the general public. Therefore, this additional landscaping/""
would be of greater benefit to the public if it were placed
elsewhere on airport property.

The applicant should be required to post a 3-year landscaping
bond in the amount prior to issuance of a building/zoning
permit. Also prior to permit, the applicant should have to
submit to the planner a letter form BIA which indicates the
type, size and number of landscaping species to be planted on
airport property and an indication of the general location
where landscaping will be installed. The cost of the
plantings and their installation must equal at least $1,800.
Lighting: No new lighting proposed.
Sewer: The sewer allocation for this project is 60 gpd. This ci?

is based on four (4) additional employees. The $2.50 per
gallon fee would have to be paid prior to permit.
Other: Two (2) existing dumpsters will be screened with a six
(6) foot stockade fence. (�;,
3) J.W.J. - REALTY - SATURN DEALERSHIP - 1095 SHELBURNE ROAD
This project consists of constructing a 12,247 square foot
building (9,147 feet on lst floor and 3,100 square feet on 2nd
f loor) to contain a new auto dealership on the site of an
existing Chrys 1 er- Plymouth dealership. Auto sales is neither
a permitted nor a conditional use in this district. The
Zoning Board of Adjustment granted a use variance for this
facility on April 13, 1992 and the Planning Commission
reviewed the sketch plan on May 12, 1992 (minutes not yet
available).
This property at 1095 Shelburne Road is within the Commercial
1 District. It is bounded on the north by a cemetery and
undeveloped land owned by Pomerleau, on the west by the
undeveloped residential portion of L&M Park, on the south by
the commercial portion of L&M Park, on the east by a retail
building and Shelburne Road.
The applicant has submitted an alternate plan for the Planning
Commission's consideration. This alternate plan retains the
integrity of the watercourse and CO District along the
southern boundary.
Access /Circulation: This property is currently served by a 30
foot curb cut on Shelburne Road which is proposed to be
widened to 60 feet at the property line. Section 19.103b
limits the width of a driveway to 36 feet unless a different
size is required due to special circumstances. City Engineer
Bill Szymanski was consulted regarding the width of this curb
cut. He felt this width was acceptable in order to
accommodate the new car delivery trucks. In the past, Baldwin
Avenue was used for unloading new cars. Approval from AOT
would be necessary for this curb cut widening. This access is

plan application of Hertz Corporation for construction of a 900
square -foot -addition to an existing building for office/storage
use in conjunction with automobile rental, as depicted on a plan
entitled, "Hertz, Burlington International Airport, South
Burlington, Vermont", prepared by Michael Dugan, and dated
12/3/91, last revised 5/26/92, with the following stipulations:
1. The landscaping requirement for this project is $1800. As
stated in two letters dated 12/10/91 and 6/16/92 from BIA
Director of Aviation, J.J. Hamilton, this $1800 of required
landscaping shall be incorporated into a landscaping master plan
which is currently being developed for the airport property.
2. An additional sewer allocation of 60 gpd is granted. The
applicant shall pay the $2.50 per gallon fee prior to issuance of
a zoning/building permit.
3. Prior to issuance of a Sertificate of occupancy for the
addition, the existing fire hydrant located west of the Hertz
building shall be raised and a gate shall be installed in the

It is our understanding that on June 23 the South Burlington Planning
Commission will be considering the request by Hertz Corporation to enlarge
their facility at the airport. As a part of that building/zoning permit
process, the Hertz Corporation must post a bond to cover the costs of required
landscaping requirements, which must equal at least $1,800.
In earlier communications with your office, it was mentioned that the airport
will be working with a firm to develop a plan for landscaping the area along
Airport Drive south of the terminal building. As a part of that airport
planning activity, the Board of Airport Commissioners at its May meeting
selected the firm of Howard, Needles, Tammen & Bergendoff to provide landside
planning and design including access roads in the terminal area, parking
solutions, traffic flow and landscaping needs. We expect to proceed with that
planning activity in the near future and will be coordinating details with
your office at that time.
As a result, we consider it premature to make any decisions, at this time,
relating to the type and species of plantings. As the specifics of the
landside planning become known and are coordinated with your office, we will
be then be able to develop our landscaping requirements. In the meantime, we
ask that the building permit for Hertz be issued so that our planning activity
will not hold up their construction.

The South Burlington Planning Commission held a meeting on
Tuesday, 19 November 1991, at 7:30 pm, in the Conference Room,
City Hall, 575 Dorset St.

Mr. Weith gave a synoosis of the City Council review of the Green
Acres application last night. He noted that in the past the
Council has reviewed applications on the basis of the PUD
criteria. Last night, however, Mr. Dinklage was the only Council
member who tried to address those criteria. other members
appeared to be supportive of Planning Commission stipulations.
Mr. Weith noted that the Commission had had a number of issues,
especially traffic. They had asked the applicant to go to the
Council and discuss the mitigation package and see if and when
the Council was goinq to implement the repairs to intersections.
Mr. Weith said the Council did not discuss this. The
Council ended up approving the Preliminary Plat with the stipula-
tion that if conditions and stipulations change, the application
has to go back to the Council.
Mr. Weith reminded members of the site visit to the Deslauriers
property on Saturday morning. He noted that earlier in the day
the Natural Resources Committee is doing a site walk on the City
Center property next to China Lite.
Mr. Weith noted receipt of a letter from Chris Cavin asking to
talk about getting recreation path construction included as part
of a development. Members asked that she be invited in to dis-
cuss this.
Mr. Sheahan advised that the City center design streetscape
committee had met and discussed lighting and sidewalks. No final
decisions have yet been made.

Mr. Dugan said Hertz now has a modular office which they want to
replace with something that looks like National Car Rental's
facilities. He said they are willing to contribute to the
Airport's landscape fund. They :411 screen the two dumpsters in
the north section with a fence.
There is a question of the water system upgrade. The Fire Chief
would like to see pressure increased. This requires permission
of the City of Burlington.
Mr. Dugan noted the Airport Commissioners have granted and OK to
this project. -
Commission members suggested that the Airport people be asked
what they would like in the way of landscaping from the funds
being allocated by this developer.
Mr. Austin moved the Commission approve the site plan application
of Hertz Corporation for construction of a new 644 sq. ft. of-
fice/storage building and 370 sq. ft. addition to an existing
building used for a car rental business as depicted on a four

This project consists of the construction of a 644 square foot
office/storage building and a 370 square foot addition for stor-
age and entry to the service building. The new office/storage
building will replace a 288 square foot office trailer which has
been used for several years.
The project site is located within the Airport zone just north of
the FAA control tower. It is bounded on the north and east by a
taxi runway, on the south by the FAA control tower and on the
west by Park & Fly. This site is shared with National Car Rent-
al. Both agencies use this site to store and service rental
vehicles.
Access/Circulation: Access to the site is via a two (2) way
service road connected to the one-way main terminal access drive.
The site is not accessible to the general public. A chain link
fence completely surrounds the site and the access gate is locked
at night. Circulation pattern is acceptable.
Parking:- No additional parking needed since the new building is
to replace an existing office building and the general public
will not use the site.
Landscaping: The landscaping requirement for this project is
$1260. Bill Szymanski has suggested that a planter adjacent to
the new building would enhance the site's appearance. Another
option would be for Hertz to give the airport $1260 to add land-
scaping elsewhere on airport property. The applicant is agree-
able to the latter option. If this option is approved by the
Planning Commission then a planting schedule must be submitted
with a letter or plan indicating where on airport property the
planting will take place.

Sewer: The sewer allocation for this project is 60 gpd. This is
based on four (4) additional employees. The $2.50 per gallon fee
would have to be paid prior to permit.

3) U-MALL z- TRAFFIC CIRCULATION AMENDMENT a DORSET STREET
This amendment is to revise the circulation pattern at the south
- east corner of Steinbach's. This change will involve placing a
gate at this location which when extended in an east - west
direction will prevent traffic from exiting directly onto the
northerly access drive. This gate will be used during peak
traffic periods.
Signage and temporary wheel stops will be used to inform and
direct the traffic in the desired direction. Some green space
will be lost and an existing tree will be relocated.
The proposal would increase overall lot coverage to 70.6% (maxi-
mum allowed is 70%). The Commission may waive total lot coverage
if it finds that PCD goals would be enhanced.
Staff supports'the proposed revision as this should reduce con-
gestion at the northerly entrance and improve overall traffic
circulation. However, the applicant should maintain a maximum
total lot coverage of 70%.
4) L&M, AMEND CONDITION OF APPROVAL
The applicant is requesting to amend condition 49 of the 12/11/90
approval for the L&M Park PCD (minutes enclosed). The condition
requires all intersection improvements on Route 7 to be completed
prior to issuance of certificate of occupancy. The proposed
improvements include installation of a signal and synchronization
of all traffic signals.
The Agency of Transportation approved the proposed improvements
with the exception of installing the signal. Signal warrants
are not met at this time. Enclosed is a chronology of events
prepared by Fitzpatrick -Llewellyn summarizing their dealings

1. Drainage easement should extend across the entire frontage.
2. Farrell Street is being reconstructed and will be paved
within a few days. Connections for water and sewer should be
made before the street is paved. Curb work for entrance should
also be made.
CENTER PLACE, CORPORATE WAY
1. Parking should not infringe upon a future street r.o.w. The
proposed street should be centered within this r.o.w.
2. There should be provisions for storm water retention. This'
could be an underground system.
1. A 3 or 4 foot planter adjacent to the addition would do a lot
for the site.
2. Existing green space north of the building stores two dump-
sters and a wrecked car. The surface is gravel. This gravel
should be removed and top soil added if it is to be a green
space. This area and the area adjacent to the fence should be
protected with curbs or a low fence. The area near the fuel
island should also be landscaped and protected with curb or
fence.
