Findings of Fact, Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on May 24, 1999 by application of Donald
& Sandra Rendall seeking a variance from Section 25.00 Dimensional Requirements of the South Burlington Zoning
Regulations. Request is for permission to demolish an existing carport and replace with a 28' x 28' garage and 10' x 24'
breeze way located to within forty (40) feet of the required front yard, at 51 Old Farm Road. The Board of Adjustment finds
as follows:
l) This property located at 51 Old Farm Road lies within the Rl District.
2) The minimum front yard setback requirement is 50 feet. The existing carport and breeze way are located 40 feet from the
front property line. The proposed garage will be placed on the footprint of the existing carport, with the exception that the
new garage will extend two (2) feel longer and two (2) feet deeper than the existing structure. The new garage will not be
located closer to the road than the existing structure.
3) The driveway will be relocated approximately 20 feel to the north of its present location to allow ingress and egress from
the garage on it's north side. Under the existing situation, vehicles arc required to back into Old Farm Road when leaving
the carport. The new plans will allow vehicles leaving the property to drive into the street as opposed to backing out into the
street.
4) The new structure and relocation of the driveway will allow the applicant to divert surface drainage away from the house
and garage.
5) Relocation of the new garage to comply with the front yard setback would require substantial reconstruction and redesign
of the existing house.
ORDER
The variance to construct a new garage and breeze way to within 40 feet of the required front yard at 51 Old Farm Road
is hereby GRANTED
