SITE PLAN APPLICATION #SP-17-46
FINDINGS OF FACT AND DECISION
Gardner & Sons Development Corporation, hereinafter known as "applicant", is seeking after -the -fact
approval to amend a previously approved plan to further develop a 2.16 acre parcel developed with a
two (2) family dwelling by constructing a single family dwelling, and constructing a 3-unit multi -family
dwelling, O'Brien Drive. The amendment consists of amending the Site Plan to depict the "as -built"
locations for the following for units 3-6: 1) the air conditioning units 2) the deck and stairs 3) the
entrance walks, 9 & 40 Ally's Run.
Based on the plans and materials contained in the document file for this application, the Administrative
Officer finds, concludes, and decides the following:
FINDINGS OF FACT
Gardner & Sons Development Corporation, hereinafter known as "applicant", is seeking after -the -fact
approval to amend a previously approved plan to further develop a 2.16 acre parcel developed with a
two (2) family dwelling by constructing a single family dwelling, and constructing a 3-unit multi -family
dwelling, O'Brien Drive. The amendment consists of amending the Site Plan to depict the as -built
locations for the following for units 3-6: 1) the air conditioning units 2) the deck and stairs 3) the
entrance walks, 9 & 40 Ally's Run.
2. The owner of record of the subject property is Gardner & Sons Development Corporation.
3. The application was received on July 3, 2017.
4. The subject property is located in the Residential 4 Zoning District.
5. The plan set submitted consists of two (2) pages with page one (1) entitled "Gardner Parcel, A 1 Lot,
6 Unit PRD O'Brien Drive South Burlington, VT Site Plan", prepared by O'Leary -Burke Civil Associates,
PLC, dated 6/2/2016 and last revised on 6/27/2017.
ZONING DISTRICT & DIMENSIONAL REQUIREMENTS
6. The proposed project will meet all dimensional requirements and limits which had been approved as
part of the original PUD approval (#SD-16-15). Building coverage is calculated at 9.1% (maximum
allowable is 20%) and the overall coverage is proposed to be 20.6% (maximum allowable is 40%). No
waivers have been granted.
SITE PLAN REVIEW STANDARDS
Section 14.06 of the South Burlington Land Development Regulations establishes the following general review
standards for all site plan applications:
Only the standards below are affected by this application. All other standards will continue to be met.

Air Conditioning
7. The applicant has added air conditioning units on units #3-6, which were not previously depicted on the
plan. These air conditioning units are shown on the revised plans.
Deck and Stair Location
8. The applicant has changed the location of the decks attached to units #3-6, and has added stairs,
neither of which were previously depicted on the plan. The location of the decks and stairs is shown on
the revised plans.
Entrance Walks
9. The applicant has added entrance walks and stairs leading up to units #3-6, which were not
previously depicted on the plan. The location of the entrance walks and stairs are shown on the
revised plans.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves #SP-17-46 of Gardner
and Sons Development Corporation, subject to the following conditions:
1. All previous approvals and stipulations for the project must remain in full effect except as amended
herein.
2. This project must be completed as shown on the plat submitted by the applicant and on file in the
South Burlington Department of Planning and Zoning.
3. The applicant must obtain a zoning permit for the site modifications within six (6) months pursuant
to Section 17.04 of the Land Development Regulations or this approval is null and void.
4. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use or
occupancy of the buildings.
5. Prior to issuance of a zoning permit for the buildings, the applicant shall submit to the
Administrative Officer a final set of project plans as approved in digital (PDF) format.
6. Any changes to the site plan will require approval of the South Burlington Development Review
Board or the Administrative Officer.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision by filing a
Notice of Appeal with the secretary of the Development Review Board. This Notice of Appeal must be
accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
