VERMONT November 3, 1966 Mr. Henry LeClair Town Manager South Burlington, Vermont Dear Henry: AREA CODE 602 864-4666 I have searched the title to 320 feet of Oakwood Drive, which is being conveyed by .Roland and Evangeline DesLauriers to the Town for highway purposes. The title is clear on this property, with the exception of two mortgages to the Burlington Savings Bank dated March 3, 1958 and August 17, 1966, of record in Volume 45, Page 354 and Volume 84, Page 191, respectively. I have prepared and obtained partial releases of these mortgages, and the same is enclosed herew ith. I am also enclosing the Warranty Deed which has already been signed. This may now be recorded along with the partial release. Very truly yours, John TEwing JTE/p Enc. JOHN T- EwING ATTORNEY AT LAW 86 ST. PAUL STREET BURLINGTON. VERMONT November 3, 1966 Mr. LaForrest H. Thompson Thompson, Prahl ,,i Kelly 239 South Union Street Burlington, Vermont Pe: Town of South Burlington. Dear LaForrest: Thank you for your letter of Octo ich I have reviewed. I have also researched the applicable law. It is my opinion that the i school must be turned over to the S 3222 provides in part as follows: " amounts in lieu of a rate on a after the grand list book has n c Town Clerk, set the tax rate ces, T of the sums voted for the ict. Title 16, VSA, Section istrict votes specific nd list, the Selectmen shall, nd lodged in the office of the L o raise the specific amounts voted. " Title 24, V ecttoWiS" provides in part as follows: "The Town Treasurer upo eceivi from the Selectmen a town tax bill... shall credit... the Town Sc 1 Dis r ct ... with the gross sum of the levy provided for such... he balance of such levy shall be credited to the general fund. Under these sections, it is my opinion that the tax rate must be set by the Selectmen in an amouit sufficient to raise the sum specifically voted for the school. Please let me know if you have any further questions concerning this. Very truly yours, John T. Ewing JTE/p cc: Mr. Henry LeClair LAW ❑FFICE OF ❑MER L.
