HomeMy WebLinkAboutSD-09-33 - Decision - 0670 Nowland Farm Road#SD-09-33 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING STEVE &JENNIFER HEROUX — 670 NOWLAND FARM ROAD FINAL PLAT APPLICATION #SD-09-33 FINDINGS OF FACT AND DECISION Steve & Jennifer Heroux, hereinafter referred to as the applicants, are seeking to amend a previously approved four (4) lot subdivision. The amendment consists of merging lots #3 & 4 into one (1) lot of 1.72 acres, 670 Nowland Farm Road. The Development Review Board held a public hearing on August 18, 2009. Chris Snyder represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicants, are seeking to amend a previously approved four (4) lot subdivision. The amendment consists of merging lots #3 & 4 into one (1) lot of 1.72 acres, 670 Nowland Farm Road. 2. The owner of record of the subject property are Steve and Jennifer Heroux. 3. The application was received on July 17, 2009. 4. The subject property is located in the SEQ Natural Resource Protection Zoning District. 5. The plan submitted is entitled "Lands of Steven & Jennifer Heroux Nowland Farm Road South Burlington, Vermont Final Plat Amendment Lot 3 & Lot 4 Merger", prepared by Lamoureaux and Dickinson, last revised 7/17/2009. This is a minor property line adjustment and results in no substantial change to setbacks, coverages, or other dimensional requirements that would create non- compliance as regulated in the South Burlington Land Development Regulations. The property remains in full compliance with the Land Development Regulations. Staff does recommend that the applicant remove the driveway easement to Lot 4 across Lot 3 as it is no longer necessary. `/ DECISION Motion by 6A « BLit M6 , seconded by to approve Final Plat Application #SD-09-33 of Steve & Jennifer Heroux, subject to the following conditions: I ]ADevelopment Review Board\Findings_Decisions\2009\HeroUX_SD0933_ffd.doc #SD-09-33 1. All previous approvals and stipulations shall remain in full effect except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. Any changes to the final plat plan shall require approval of the South Burlington Development Review Board. 4. The final plat plan (survey plat) shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format of the digital information shall require approval of the South Burlington GIS Coordinator.
