Mr. DeWolfe said the screening requirement will be met. They will meet with the City
Arborist to discuss landscaping concerns.
Mr. DeWolfe also noted staff s concern with snow removal. They originally proposed to
use the parking islands, but staff doesn't want this, so snow will be trucked off -site.
Ms. Lesser asked why the proposed stone wall doesn't contribute to the landscaping
requirement. They will be using the stones in a creative way and will make a serpentine
wall between parking and the sidewalk. Ms. LaRose said the concern is that the stone
wall accounts for 1 /3 of the landscaping budget and will take away from other
landscaping. Mr. Dinklage suggested a "happy medium" might be found. Members
would support a credit, but not 1 /3.
Mr. Belair noted that staff still doesn't have information from the consultant on how wide
the right-of-way should be.
Ms. Quimby then moved to continue Preliminary Plat Application #SD-06-95 of Patrick
Malone until 19 December 2006. Mr. Farley seconded. Motion passed unanimously.
Sketch Plan Application #SD-06-94 of Catamount/Middlebury, LLC, for a
( // planned unit development consisting of. 1) a boundary line adjustment
between 1785/1795 Shelburne Rd. and 68 Nesti Dr; 2) expanding the parking
lot for auto sales & service use on 1785/1795 Shelburne Rd, 3) expanding
parking lot for mixed use building at 68 Nesti Dr., & 4) creating new access
for 68 Nesti Dr. through 1785/1795 Shelburne Road:
Mr. Knudson recused himself during this item due to a potential conflict of interest.
Mr. Williams said they have recently purchased the Bouyea property and have leased the
building on a short-term basis. They envision more future development. In the
meantime, they are talking with Bill Savoie to get access to a light on Shelburne Rd. The
agreement they have is to trade a piece of land where Savoie can build additional display
area in exchange for the applicant upgrading the entry (there will be a legal easement to
that entry).
Mr. Williams noted that the 2 properties also share a stormwater pond which is not
adequate. Part of the project will be to enlarge the pond. Mr. Williams noted that Champ
Car Wash is also supposed to be connected to this pond but is not at this time. Ms.
LaRose said the city's Stormwater Superintendent and the State will both have to review
this.
Mr. Dinklage asked about the issue of the line between 1785 and 1795. Mr. Belair said
that they have been treated as one lot. He felt it makes no sense to keep the line. Mr.
Williams said they need time to discuss the implications of this.

Mr. Dinklage asked if the new access will be a public street. Mr. Williams said they
don't yet know. If it is a mixed use development, it will have to public; if it is just
commercial, it doesn't have to. The issue is the required right-of-way. Mr. Dinklage said
a public road would also create a second parcel.
Ms. LaRose said that issue is a bit fuzzy. She said staff would advocate a public road
because of potential development in the rear and because there is a light there. Mr. Belair
read from the regulations and said he feels a public street is required. He said the street
can end when it crosses into the 68 Nesti Drive property. Ms. LaRose cited the
advantages of the applicant not having to plow the street or pay taxes on it. Mr. Belair
said there can be a stipulation that both sides of the road are part of one PUD.
Mr. Williams clarified that they will not be adding parking.
8. Continued Public Hearing: Preliminary Plat Application #SD-06-54 of John
Illick for a planned unit development to subdivide a 177.2 acre parcel into 16
lots ranging in size from 3.98 acres to 29.46 acres, Community Drive:
Mr. Belair advised that the applicant has asked for a continuance to 5 December 2006.
Ms. Quimby moved to continue Preliminary Plat Application #SD-06-54 until 5
December 2006. Mr. Farley seconded. Motion passed unanimously.
As there was no further business to come before the Board, the meeting was adjourned at
10:30 p.m.

Catamount/Middlebury, LLC, hereinafter referred to as the applicant, is seeking sketch plan approval for
a planned unit development consisting of: 1) a boundary line adjustment between 1785/1795 Shelburne
Road and 68 Nesti Drive, 2) expanding the parking lot for auto sales & service use on 1785/1795
Shelburne Road, 3) expanding parking lot for mixed use building at 68 Nesti Drive, and 4) creating a new
access for 68 Nesti Drive through 1785/1795 Shelburne Road.
Associate Planner Cathyann LaRose, Planning & Zoning Assistant Betsy McDonough, and
Administrative Officer Ray Belair, referred to herein as Staff, have reviewed the plans submitted on
October 30, 2006 and have the following comments.

1. The applicant should submit a complete boundary survey as part of the preliminary plat application.
The plans depict a property line between the properties at 1785 and 1795 Shelburne Road. This boundary
line should be dissolved. If it is not, the property at 1795 Shelburne Road will not be in conformance;
furthermore, the increase in impervious area at 1795 Shelburne Road lot due to the expansion of the auto
display area, would increase the non-conformance of the overall coverage. The Board does not have the
authority to allow any increases in non-conformance.
2. The boundary line between the lots at 1785 and 1795 Shelburne Road should be dissolved.
SITE PLAN REVIEW STANDARDS
Section 14.06 of the South Burlington Land Development Regulations establishes the following general
review standards for all site plan applications:
(a) The site shall be planned to accomplish a desirable transition from structure to site, from
structure to structure, and to provide for adequate planting, safe pedestrian movement, and
adequate parking areas.

The applicant is proposing a new roadway which will serve as an access to 68 Nesti Drive through
1785/1795 Shelburne Road property. Staff finds that the proposed access will improve the transition
between adjoining properties which will also allow for safer pedestrian movement.
The South Burlington Fire Chief shall review the plans before final plat approval.
3. The South Burlington Fire Chief shall review the plans before this final approval.
Per Section 13.01(G)(5) of the South Burlington Land Development Regulations, a bicycle rack shall be
provided to serve employees, residents, and the general public.
4. The plans shall be revised to cite the location of the bicycle rack (s).
The property at Freedom Nissan is not shown as having any parking spaces per the plans submitted.
Therefore, staff cannot address the adequacy of the parking required or provided.
5. The plans shall be revised to depict all parking spaces for both subject properties.
(b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable.
This criterion is largely being met as existing parking is located to the side and rear of the buildings. The
proposed parking area for 68 Nesti Drive is located on the east side of the building. Again, staff cannot
address the parking area for the properties along Shelburne Road as none have been delineated.
(c) Without restricting the permissible limits of the applicable zoning district, the height and
scale of each building shall be compatible with its site and existing or adjoining buildings.
The height of the building will remain unchanged.
(d) Newly installed utility services and service modifications necessitated by exterior alterations
or building expansions shall, to the extent feasible, be underground.
The plans do not indicate any changes to utilities.
Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and
service modifications shall be underground.
6. All new utility lines, services, and service modifications shall be underground.
(e) The DRB shall encourage the use of a combination of common materials and architectural
characteristics, landscaping, buffers, screens and visual interruptions to create attractive
transitions between buildings of different architectural styles.
The proposed project does not involve any new exterior construction of buildings, so this criterion is not
applicable.
(fJ Proposed structures shall be related harmoniously to themselves, the terrain, and to existing
buildings and roads in the vicinity that have a visual relationship to the proposed structures.

The proposed project does not involve any new exterior construction of buildings, so this criterion is not
applicable.
Site plan applications shall meet the following specific standards as set forth in Section 14.07 of the South
Burlington Land Development Regulations:
(a) The reservation of land may be required on any lot for provision of access to abutting
properties whenever such access is deemed necessary to reduce curb cuts onto an arterial
of collector street, to provide additional access for emergency or other purposes, or to
improve general access and circulation in the area.
Per Section 15.12(D)(2)(d) of the Land Development Regulations, if the proposed roadway (access road)
serves one (1) or more lots occupied by and/or proposed for non-residential or mixed -use development, it
shall be a public road. Section 15.12(D)(3)(e) of the Land Development Regulations states that if the
proposed roadway functions as a private frontage or service road to service more than one (1) commercial
lot, and the DRB determines the road would be consistent with the standards for PUD's, it may be a private
road.
With respect to the allowance for private roads that are consistent with the standards of PUDS, the SBLDR
require public road connections when the possibility of future development on the subject parcel or abutting
properties exists.
Staff finds that this proposed roadway should be a public road and built to public road standards. It serves
more than one (1) commercial property, and may serve residential and/or mixed use if undeveloped parcels
off this roadway are developed in the future. With the strong possibility of intense residential (up to 7 units
per acre) or commercial development on this property, it would be prudent to require a public roadway at
this time.
7. The access to the properties from Shelburne Road shall be a public street and planned in accordance
with public street standards.
(b) Electric, telephone and other wire -served utility lines and service connections shall be
underground. Any utility installations remaining above ground shall be located so as to have
a harmonious relation to neighboring properties and to the site.
As already noted, pursuant to Section 15.13(E) of the Land Development Regulations, any new utility
lines, services, and service modifications shall be underground.
(c) All dumpsters and other facilities to handle solid waste, including compliance with any
recycling or other requirements, shall be accessible, secure and properly screened with
opaque fencing to ensure that trash and debris do not escape the enclosure(s).
Screened dumpster locations are not noted on the plans.
8. The plans shall be revised to note the location of the screened dumpster areas.
(d) Landscaping and Screening Requirements
As no new construction is planned, no new landscaping shall be required.

Pursuant to Section 13.06(B)(4) of the Land Development Regulations, snow storage areas must be shown
on the plans and may not be within a stream buffer area.
9. The plans shall be revised to depict appropriate snow storage areas.
Traffic Generation
No changes in traffic generation are anticipated as the uses will remain the same.
The two properties are proposing to merge into a planned unit development. The applicant is proposing a
boundary line adjustment between 68 Nesti Drive and 1785/1795 Shelburne Road. The boundary line
adjustment is necessary for the construction of the new parking area at 1785/1795 Shelburne Road.
Staff finds no problems with this request. However, staff has already noted that the boundary line
between the Shelburne Road properties should be dissolved.
Staff recommends that the Development Review Board approve final plat #SD-06-94 subject to the
conditional numbered items in the Comments section of this report.
