Dear Peter:
In line with our phone conversation enclosed four (4) copies of a preliminary
lay -out for your side track in South Burlington.
As you will note, this has not been checked in the field for obstructions.
However, the only thing that could trouble the present lay -out is a power polo
which would entail the movement of the switch ten to fifteen feet either north
or south of the present location.

Produce - At the present time, our plant in Burlington produces only hamburg,
hot dog, and dinner rolls. Because of space limitations, our bread
products are baked at the Bouyea Baking Co. in Plattsburgh, N.Y.
Future plans are to incorporate facilities at this new plant to enable
us to bake bread as well as rolls.
Distribute - Big Boy, Home Style, Old Vermonter Oatmeal, Sourdough Italian,
and other breads.
Freihofer Bread, Cakes, Pies, Donuts and Pastries.
Table Talk Pies
Koffee Kup Bread & Rolls (outside of Chittenden County)
Fassetts bakes rolls for its own routes and for Bouyea Baking Co. in
Plattsburgh, Millbrook in Albany, N.Y., United Baking in Schenectady, N.Y.,
and Fortin Bakery in Hemingford, Canada. We also service McDonalds,
Burger King, Red Barn, Lums, and most of the chains.

5 New wholesale routes are planned this spring for the Manchester, N.H.
division.
The eighteen Burlington route trucks leave between 1 a.m. and 7 a.m. five
days a week. They return to the bakery anywhere between 11:30 a.m.
and 5 p.m. A map of our distribution area is included. Approximately
50% of our sales dollars come from out of state. Approximately 60% of
the products that Fassetts produces are sold out of state.
Five days a week our three trailers leave for New Hampshire and Rutland
about midnight. They return to the bakery between 6-9 p.m. One
trailer leaves for Albany about 10 a.m. and returns about 8 p.m.
We receive two trailers from Plattsburgh ( 3 p.m. and 8 p.m.). We also
receive one trailer from Millbrook about 2 p.m. These two trailers
from Plattsburgh and the Millbrook trailer spend about one hour at our plant.

We wish to re -locate in South Burlington for the following reasons:
1. Our present plant on North Winooski Avenue is not of sufficient
size to permit the addition of new bakery machinery to keep
abreast of product demand. In addition, compliance with proposed
future federal regulations relative to the food industry would
be difficult to implement at our present location.
2. Railsiding available to permit receiving ingredients (flour, sugar,
shortening) in bulk.
3. Proximity to the interstate system.
4. Route 7 would be a good location for our thrift store. Our
store located next to the Volkswagon agency on Route 7 averages
50 customers per day. We expect this to increase to 100 customers
per day.

District Environmental Commission #4 hereby issues a Land Use Permit pursuant
to the authority vested in it in 10 VSA, Chapter 151. This permit applies
to the lands identified in Miscellaneous Land Records Volume 136, Pages 313-
323 of the Land Records of So. Burlington, Vermont as the subject of a sales
contract to Fassetts Bakery, Inc., the "permitee" as grantee. This permit
specifically authorizes the permittee to construct a 48,500 square foot bakery
and offices on a 16.8 acre parcel of land on Shelburne Road in So.' Burlington,
Vermont.
The permittee, his assigns and successors in interest are obligated by this
permit to complete and maintain the project only as approved by the District
Commission in accordance with the following conditions:
(1) The project shall be completed as set forth in Findings of Fact and
Conclusions of Law #4C0339, in accordance with the plans and exhibits
stamped "Approved" and on file with the District Environmental Commis-
sion, and in accordance with the conditions of this permit.
(2) By acceptance of the issuance of this permit without appeal, the
permittee confirms and agrees for itself and all assigns and successors
in interest that the conditions of this permit shall run with the land
and the land uses herein permitted, and will be binding upon and enforce-
able against the permittee, and all assigns and successors in interest.
The granting of less than an undivided whole interest in this project
is prohibited without prior approval of the District Environmental
Commission.
(3) This permit hereby incorporates all of the conditions of the Certifica-
tion of Compliance #4C0339, issued on August 14, 1978, by the Regional
Engineer, Division of Protection, Agency of Environmental Conservation
in compliance with Vermont State Board of Health Regulations, Chapter 5,
Sanitary Engineering, Subchapter 1, Public Buildings. This Certifica-
tion is for external water, sewer, and site work only. Before the
permittee commences any construction involving plumbing, he must obtain
a written Certification of Compliance for Plumbing.

(4) No changes from the approved plans shall be made without written approval
from the District Environmental Commission.
(5) The Commission maintains continuing jurisdiction during the lifetime of
the permit and may periodically require that the permit holder file a
statement certifying that the project is being completed according to
the terms of the permit.
(6) All exterior lighting shall have concealed light sources, so that said
sources are not visible from Route 7.
(7) The applicant shall install low flush closets, and low flow showerheads.
(8) Soil erosion shall be controlled as outlined in the Findings of Fact
and as specified by the applicant in written procedures incorporated
in the contractor's specifications, a copy of which is on file and
labeled Exhibit 17.
(9) All construction on this project must be completed by May 31, 1979.
(10) This permit shall expire on August 4, 1998, unless extended by the
District Commission.

where written application has been made to the Agency of Environmental Con-
servation and approval obtained.
(3) This project is approved for municipal water and sewer hook-ups as authorized
by William J. Szymanski, City Manager of South Burlington,
(4) The storm water runoff plans are approved with the following condition: all
disturbed areas shall be seeded and mulched within ten days of completion,
(5) This project is approved for sewer line construction to be built in ac-
cordance with the Ten State Standards and as shown on the approved plans.
In addition the sewage ejector system shall be a duplex system with a
storage capacity large enough to handle a four hour peak flow period,
(6) This Certification of Compliance is limited to exterior water and sewer work
only. Under no circumstances shall any interior pluming be installed until
written approval is received from this office for the interior plumbing
work.
(7) A copy of the approved plans and the Land Use Permit shall remain on the
project during all phases of construction and, upon request, shall be made
available for inspection by State or local personnel.

On June 19, 1978 an application for an Act 250 permit was filed by Fassetts
Bakery, Inc., 294 North Winooski Avenue, Burlington, Vermont for a project
generally described as construction of a 48,500 square foot bakery facility and
offices on a 16.8 acre parcel of land on Route 7 in South Burlington, Vermont.
Under Act 250, projects are reviewed based on the 10 environmental criteria
of 10 VSA, §6086(a) 1-10. Before granting a permit, the Board or District
Commission must find that the project complies with these criteria and is
not detrimental to the public health, safety, or general welfare.
Decisions must be stated in the form of Findings of Fact and Conclusions of
Law. The facts we have relied upon are contained in the documents on file
identified as Exhibits 1 through 17 and from evidence received at a hearing
on July 12, 1978.
Parties to this application are: the applicant by James Bouyea, Peter Bouyea,
Gordon Woods, Peter M. Collins, Esq., Wilfred J. Trombley, and Ron Barlow;
and the Regional Planning Commission by Victor Morrison.
In making the following findings, we have summarized the statutory language of
the 10 criteria of 10 VSA, §6036(a):
(1) There will be no undue water or air pollution:
i. Natural gas will be used for heat and the ovens, which will cause
no undue air pollution.
ii. The drainage system consists of two 8" concrete drainage pipes
from the paved areas which flow through a catch basin and into
a detention basin. Overflow from the catch basin is diverted
through a 15" metal pipe into an outfall area. A roof drain
is connected to a subsurface pipe which flows into a catch
basin and, then into the outfall area.
iii. The project will meet water resources department regulations.
iv. The project will utilize an air cooled compressor rather than
a water cooled system to conserve water.

v. The project will be connected to the municipal sewer system
and all water used for truck and equipment washing will be
discharged into the sanitary sewer. (Exhibit 9)
vi. A Certification of Compliance with Vermont State Board of
Health Regulations for external water, sewer, and site work
only has been issued. The permittee cannot commence further
construction involving plumbing without first obtaining a
written Certification of Compliance for the Interior Plumbing.
vii. The applicant has stipulated that he will install low flush
toilets, urinals and low flow shower heads.
(2-3) There is sufficient water available and no existing water supply
will be unreasonably burdened.
The Champlain Water District and the City of South Burlington
have indicated that there is ample water available for this pro-
ject and it will create no burden for the existing system. (Exhibits
7 and 9) .
(4) There will be no unreasonable soil erosion or effects on the capacity
of the land to hold water:
The applicant has stipulated that written procedures for erosion
control will be included in the specifications supplied to the
contractor to include, but not limited to, the following:
i. There shall be no disturbance of the site within 50' of the top
of the bank by the stream except for installation of the storm
water discharge system.
ii. The trench for the discharge pipes shall be completed within
a week, and seeded and mulched within 10 days.
iii. The rip -rapped outfail area shall be completed within a week.
iv. Any stock piles of topsoil shall be seeded and mulched within
10 days of final grading, if not sold immediately.
v. All disturbed areas of the site shall be seeded and mulched
within 10 days of completion of grading, especially the swale
to the east of the building.
(5) This project will not cause unreasonable safety or congestion conditions
with respect to highways or other means of transportation:

i. The City of South Burlington has approved the construction of the
bakery facility, partially because the business was -a low traffic
generator.
ii. The applicant will try to maintain and share a common curb cut
with Wickes Lumber for the intersection with Route 7.
iii. If possible, the applicant will also share the same driveway
as used by Wickes Lumber.
iv. The proposed south end connector can be located across the
northeast section of the property.
v. The applicant will construct a railroad siding in conjunction
with the Vermont Railway as discussed in Exhibit 10.
(6-7) There will be no unreasonable burdens on educational or other muni-
cipal services:
The Commission found Criterion 6 to be not applicable to this project.
The City of South Burlington finds that the construction of the new
facilities will not create any unreasonable burden on the city govern-
ment to provide services. (Exhibit 8)
(8) There will be no undue adverse effects on aesthetics, scenic beauty,
historic sites or natural areas:
i. The one story building is designed to be unobtrusive on the
site, with the highest portion being 35'.
ii. Exterior wall materials will be "unistress" concrete sections
in brown tones in keeping with surrounding buildings.
iii. There is no known wildlife habitat on the site.
iv. Exterior lighting will be 20' sodium box fixtures. The
applicant stipulated that these pole lights will have concealed
light sources.
v. Lights mounted on the exterior of the building shall be shaded
and focused onto the parking areas and driveways so that the
light sources are not visible from Route 7.
vi. The undisturbed portions of the site will be left in their
natural state.
(9) The project is in conformance with the Capability and Development
Plan:

i. The applicant has stated that although the soils are good
for agriculture, that is not economically feasible at the
price of $11,000 per acre.
ii. Topsoil from the construction site will be stockpiled and
sold.
iii. Energy Conservation:
a. Heat is produced within the building by two ovens which
each produce 1,200,000 BTU each hour, and a steam boiler
used for raising the bread.
b. Circulating units called Modine heat exchangers will help
salvage and utilize the heat produced by the ovens and
should heat the bakery entirely except during down hours.
c. In the summer, cooling is a problem; an air exchange
system is used.
d. The office area will be insulated to R-31 in the roof
and R-16 in the side walls, according to tentative specifi-
cations in Exhibit 17.
e. During the down hours, steam unit heaters will be used
to keep the building at SSo.
f. Insulation will be an advantage only on the down days in
the winter when no heat is being generated from the ovens.
g. Insulation in the bakery facility will be provided by
"unistress" concrete wall sections which provide at least
an R- factor of 12, and ceiling sections which have at
least an R value of 10.
iv. Green Mountain Power and the Vermont Gas Systems indicate that
they can supply service for this project. (Exhibits 2 and 11)
10. The project is in conformance with the local and regional plans:
The South Burlington Planning Commission finds that this project
is in conformance with the Comprehensive Plan.

CONCLUSION OF LAW
Based upon the foregoing Findings of Fact, it is the conclusion of this
District Environmental Commission that the project described in the
application referred to above, if completed and maintained in conformance
with all of the terms and conditions of that application, and of Land
Use Permit #4CO339 will not cause or result in a detriment to public health,
safety, or general welfare under the criteria described in 10 VSA g6086(a)
and that, pursuant to such section, a permit is therefore issued.

mended herein, under any of the 10 environmental criteria of 10 VSA,
§6086 (a) 1-10.

In line with our phone conversation last week, our people have checked
the golf driving range in South Burlington for availability of rail
sidings. A siding could be brought up all along the property. However,
more grading will be required at the north and south ends. The 3niddle
of the tract appears to be the best location.
Vermont Railway's policy for new sidings to industry is as follows:
(1) Railway will construct a turnout and track from the point of
switch to our property line on subgrade furnished by Industry.
(2) Industry will pay cost of the turnout and track not to exceed $80'000.
(3) This money will be refunded over a period of five to ten years on a

) 10 NSA, Chapter 151 (Act 250)
District Environmental Commission #4 hereby issues a Land Use Permit Amendment pur-
suant to the authority vested in it in 10 VSA, Chapter 151. This permit applies to
the lands identified in Book 142, Pages 547-550 of the Land Records of South Burling-
tion, Vermont, as the subject of a deed to Fassetts Bakery Trust, the "permittees"
as grantees. This permit specifically authorizes the permittees to revise the land-
scape plan to eliminate four islands in the parking area and to redistribute the
32 yews to be planted in them around the foundation.
The permittees, their assigns and successors in interest, are obligated by this
permit to complete and maintain the project only as approved by the District Cyr
mission in accordance with the conditions of Land Use Permits #4C0339 and #4C0339-1
except as amended herein.
1. The permittees shall continually maintain the landscaping substantially as ap-
proved by replacing any dead or diseased plantings as soon as seasonably pos-
sible.
2. From November 15 to April 15 of any calendar year, all non -vegetated areas
of the site shall be mulched until final vegetative cover is established.
All mulch, hay bale siltation dams, and other erosion control devices shall
be installed immediately upon grading and shall be maintained until vegeta-
tion is permanently established on all slopes and disturbed areas. The Com-
mission reserves the right to evaluate and impose additional conditions with
respect to soil erosion control.

On April 28, 1979, a request for an Act 250 permit amendment was filed by
Fassetts Bakery, Inc., of Shelburne Road, South Burlington, Vermont, for an
amendment to the project approved in Land Use Permit #4C0339, and generally
described as the revision of the landscape plan to delete the islands in the
parking lot.
Based upon a review of the application, and the receipt of no adverse Com-
ments from any party, the District Environmental Cor-ussion finds that there
will be no undue, unreasonable or adverse irpacts resulting from the project
as amended herein, under any of the 10 environmental criteria of 10 VSA
06086 (a) 1-10.
It is, therefore, the conclusion of this District Environmental Commission
that the project described in the application referred to herein, if Com-
pleted and maintained in conformance with all of the terms and conditions of
that application, and of Land Use Permit Amendment #4C0339-2, will not cause
or result in a detriment to the public health, safety or general welfare un-
der the criteria described in 10 VSA, §6086(a) and that, pursuant to such
section, a permit is therefore issued.

The motion was seconded by Mr. Ewing and passed with 3 yes votes, Messrs.
Poger and Woolery abstaining and Mr. Levesque voting no because the City
Engineer and the City Planner had liked the original plan better.
Site plan review of a gymnastics and fitness facility, lot #13 Berard
Drive
Mr. Berard said they were asking for approval of the landscaping.
Mr. Page located the site with his beautiful slides and said the street
was now up to city standards and had been deeded to the city.
Mr. Woolery moved that the South Burlington Planning Commission approve
the site plan for lot #13 Berard Drive for a gymnastics and fitness facility
as per the drawing of 6 10 78,subject to the following stipulations_
1. A landscaping bond of $1350 be posted.
2. This approval shall expire 6 months from this date.
The motion was seconded by Mr. Morency and passed unanimously.
Site plan review, Fassett's Bakery, 1805 Shelburne Road
,•Ir. Teter Collins represented Fassett's and said that their present
location was cramped and that they were looking for larger quarters. They
have bought land on Shelburne Road across from the Black Angus. The parcel
is 16 acres in size and the proposed building will be 30,000 square feet.
They will build a spur to the railroad and supplies will be brought in
by train. The proposed driveway is next to that of Wickes but they have
no great preference as to 4ihere along Shelburne Road it goes and will move
it if the Commission wants. Mr. Collins said there would be a right of
way reserved across the property to get to the land behind it across the
tracks. He also said that a lot of landscaping had already been y-t in
and they had not yet reached the amount required by the Commission. They
are running out of space to put trees and shrubs and he wondered if the
amount could be reduced somewhat. Mr. Collins said the outside of the
building would be textured concrete block and that the retail operation,
which is presently next to Chittenden County Volkswagon, will remain there
rather than being moved to this location, as originally planned. There
are no plans to move it and the building is not laid out in such a way as
to accomodate it easily. Mr. Bouyea said there would be one way flow in
the building so that flour and sugar would enter at the rear from the
rail spur and the finished bread would be taken out the front of the building.
Mr. Collins said time was pressing and asked for a speedy decision.
Mr. Ewing told the Commission and Fassett's what things the South
Burlington Connector Citizens Advisory Committee was thinking about as
far as the location in this area went. He felt the location of the
entrance near Wickes was the best possible location.
Mr. Collins said that the bakery owners would not mind giving the

Mr. Wessel arrved at this point. Xr. Johnson said that they would
use two lots on Gram Mountain Drive to the north of Tuff Kote and that
the tenant would bea manufacturer of cross-country skiis. This will be
only storage and distribution, no sales will be made from the building.
There will be three employees. Hr. Johnson said the landscaping called
for retaining the p'esent trees and some of the smaller ones will be
transplanted to thef ront of the lot. Y-r. Woolery asked if there was
room for expansion :rid was told they could add. 15,000 square feet more
to the north. If tare was some expansion the access would remain as it
is and they would sill have only one curb cut. Mr. Johnson said the
building would be 7• y attractive and that they estimated they would
generate 3.4 trucks ,er week and that there might be one semi-trailor
coming in every 2 w-eks or so. Mr. Ewing asked about drainage and was
told it would go inn catch basins along the road. Mr. Morency asked
about lighting and •e,s told there would be recessed lighting on the

on site will cause heaving and drainage problems over time if
the lot is broken up with the landscaped islands. The plantings
from the islands to be removed will be redistributed elsewhere on
site. It was my opinion that the change was not substantial enough
to warrant review before the planning commission, and I advised Messrs.
Bouyea and Woods accordingly.

GENERAL
1. The subdivision must be completed as shown on the plans:

prepared by FitzPatrick-Llewellyn, Inc. and which have been

WATER SUPPLY
4. Each lot is approved for connection to a municipal
type water system approved by the Department of Health
provided that all construction is in accordance with the
approved plans and the Environmental Protection Rules,
Effective September 10, 1982.
SEWAGE DISPOSAL
5. Each lot is approved for connection to a municipal sewage
collection system. The work shall be done in accordance

Please enter the appearance of the Agency of Environmental Conservation,
State of Vermont, in the above captioned matter.
PRE -HEARING COMMENTS
Enclosed are comments of the Environmental Advisor and the Vermont Department
of Highways.
The applicant has indicated that it is making every effort to convince the
adjoining land owner to share a common driveway, but there is no guarantee that
the common driveway will be realized. Since the District Environmental Commission
does not have control over the adjoining land owner, a condition requiring use
of a common driveway would be impossible. The District Commission might, however,
lend its good offices to the effort to obtain a common drive.
The Environmental Advisor further indicates the need for erosion control
plans. The Agency supports his recommendation that detailed plans be submitted,
specifically indicating the means by which silt -laden run-off will be prevented
from entering a stream on the property. This material should be submitted before
a permit is issued in the matter.
No information was submitted with regard to building elevations. Although
the Shelburne Road is highly developed, the Agency recommends that the District
Commission carefully review the expected aesthetic impact of the project. The
exterior of the building and signs and lighting should be made specific.
The Environmental Advisor indicates that soils are rated as good for agricul-
tural use by the Soil Conservation Service. It appears that the proposal may be making
an effort to preserve as much agricultural potential as possible by leaving 40%
of the area open.

Industrial Building in So. Burlington
This site is located on the west side of U.S. Route 7 (Shelburne Rd.),
between Shearer Chevrolet and the Automaster. There is presently a golf
driving range on the site.
Soils are Vergennes and Enosburg-Whately. There is a small stream
which enters the property under Shelburne Road and exits to the north.
Except for a few young elms in the stream gully, the site is open meadow.
Municipal water and sewer are planned.
No erosion control plans were submitted. Erosion control should be
designed to prevent silt -laden run-off from entering the stream, and
complete plans to that effect submitted.
The city approval for this project stipulates that Fassett's Bakery
and Wicke's Lumber (existing) share a common drive. The existing drive
to Wicke's is not wide enough to accommodate much truck traffic. The
Commission should examine any road improvement plans. Sight distances
are good.
No building elevations were submitted. The landscape plan submitted
is functional. A five-year guarantee for the plantings should be stipulated.
The soils are rated as "good" for agriculture by the SCS. Approximately
40% of the useable agricultural land on this site is proposed to be left as
meadow.
No information on energy conservation was submitted.

The access for this corner lot, as approved by the Commission
two weeks ago, is not acceptable to the developer. Consequently, a
revised access scheme, limited to the existing curb cut on Williston
Road is proposed.
Gymnastics/Fitness Center
This use was authorized by variance of the Zoning Board of Acjust-
ment on 5/15/78. The site plan is adequate.
Fassetts Bakery
This use was authorized by ZBA variance on 4/17/78. The proposed
bakery is 30,000 sq. ft. in zize;as of now, the applicant has dropped
his plans for a retail outlet.
Parking, circulation, and landscaping are adequate.
Access to Rte. 7 is proposed along the extreme south property lino
contiguous to the Wickes Lumber curb cut, and offset about 175' north
of the Allen Road intersection. The plan shows acceleration and de-
celeration lanes associated with the curb cut. This layout plan is
compatible with the layout of the Southern Connector as it is present-
ly envisaged.
The disadvantages of this plan and of compatability with the
proposed connector are 1) the placement of 3 driveways contiguous
to each other, 2) the relatively short distance to the Allen Road
intersection, and 3) the inability of access points to the Fassett's
development and the Bartlett property to align with each other so
that the frontage is split.
It should be emphasized that Fassett's is able and willing to
locate its curb cut at practically any point on its frontage. The
location shown represents the consensus. of the Zoning Board and
the City Manager. It would be desirable, if possible, for Fassetts to
allow some flexibility in the siting of the 60 foot ROW to the "back -
land", in the event the present ROW location is found to be incompatible
with the Connector's layout. This could entail rerouting the ROW
around the proposed parking lot and contiguous with the drive to Rte.
7.
Anticipated truck traffic does not concide with peak roadway
hours. Moreover, of the 74 projected employees, only about 1/3 of
them work a convential day shift (9 a.m. - 5 p.m.) see attached in-
formation sheet.

Dear Mr. Woods:
Reference is made to your request concerning electrical service for
the proposed Fassetts Bakery Inc., building on the Shelburne Road in South
Burlington, Vermont.
Under the existing Vermont Public Service Law, Green Mountain Power
Corporation is required "to furnish reasonably adequate service, accommodations
and facilities to the public."
Historically, the company has been able to anticipate customer's
requirements, and has provided the necessary facilities for added loads. It is
our intention to continue this policy in accordance with applicable Public
Service Board regulations.
Assuming the project is approved by the necessary agencies, Green
Mountain Power Corporation will cooperate in every way to provide safe, adequate
and reliable electrical service, when it is needed.
Details concerning service size and location, scheduling, costs, etc.,
should be discussed with Mr. R. B. Sloan of the Williston Commercial office.
