FINDINGS OF FACT & DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, application of the Bread Loaf Corporation to amend an existing site plan for
a 51,174 square foot baking manufacturing facility, 68 Nesti Drive. The amendment consists of-
1) constructing four (4) loading docks on the north and east facades, and 2) relocating an existing
landscaping bed on the east facade.
On the day of October, 2000, the South Burlington Director of Planning and Zoning
(hereinafter Director) approved the request of the Bread Loaf Corporation for site plan review under
Section 26.10 of the South Burlington Zoning Regulations based on the following findings:
1. This project consists of amending a previously approved site plan for a 51,174 square foot baking
manufacturing facility. The amendment consists of 1) constructing four (4) loading docks on the
north and east facades, and 2) relocating an existing landscaping bed on the east facade.
2. This property located at 68 Nesti Drive lies within the C2 District. It is bounded on the south by
Sanel Auto Parts, on the west by railroad tracks, on the no.l'_l by undeveloped land and to the east
by Champ Car Wash.
3. Access/Circulation: This property does not have frontage on Shelburne Road so its access to
Shelburne Road is via a private right-of-way called Nesti Drive which also serves the Mitsubishi
dealership, Champ Car Wash and Sanel Auto Parts. The applicant has one (1) curb cut onto this
right-of-way and it is 75 feet in width. No change are proposed.
Circulation is adequate.
4. Coverage/Setbacks: Building coverage is 9.6% (maximum allowed is 30%). Total lot coverage
is 29% (maximum allowed is 70%). Front yard coverage is 0%.
The additions will meet all setback requirements.
5. Traffic: This property is in Traffic Overlay Zone 5. Traffic generation would not be affected by
the addition of the four loading docks.
6. Lighting No alterations are proposed.
7. Landscaping The minimum landscaping requirement, based on building costs, is $4,050
which is not being met. The plans should be revised to illustrate an additional $748 worth of
landscaping.
8. Parkin : The existing use requires a total of 59 parking spaces and the plan indicates that 63
parking spaces including six (6) handicapped spaces are available.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Director of Planning and Zoning
approves the application of Bread Loaf Corporation to amend a previously approved site plan for
a 51,174 square foot baking manufacturing facility. The amendment consists of 1) constructing four
(4) loading docks on the north and east facades, and 2) relocating an existing landscaping bed on the
east facade seven (7) feet to the west, as depicted on a two page set of plans, page one entitled
"Bouyea Fassetts, Inc.," with a stamped received date of 10/23/00 with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain
in effect.
2. The plans should be revised to show the changes below and shall require approval of the Director.
Three (3) copies of the approved revised plans shall be submitted to the Director prior to permit
issuance.
a) The plan shall be revised to illustrate an additional $748 worth of landscaping.
3. Prior to issuance of a zoning permit, the applicant shall post a $4,050 landscape bond. The bond
shall remain in effect for three years to assure that the landscaping takes root and has a good chance
of surviving.
4. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative
Officer prior to use of the loading docks.
5. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of
the zoning regulations or this approval is null and void.
6. Any change to the site plan shall require approval From the South Burlington Development
Review Board. /1 -
