CITY OF SOUTH BURLINGTON
DECISION AND FINDING OF FACT
On the 23rd day of June, 1997, the South Burlington Zoning Board of
Adjustment heard testimony regarding a variance application of Bill
Warnock and Michele Starr, 69 Bartlett Bay Road.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for this
application, the Zoning Board finds, concludes, and decides as
follows:
Findings of Fact
1) The area in question is zoned R-1 District.
2) Section 25.00 requires a minimum front yard of fifty (50) feet
and a minimum side yard of twenty five (25) feet.
3) The existing lot contains 7500 square feet with seventy five
(75) feet of frontage.
4) The existing dwelling 24'x 251 constructed approximately eight
(8) years ago meets the R-1 District requirements.
5) The proposed addition to the front (6'x 10') requires a six
(6) feet waiver and the attached 15'x 301 garage will be
located to within ten (10) feet of the side yard.
Conclusion
1) The character of the area will not be affected by the proposed
addition, other structures located within ten (10) feet of the
side yards.
2) The forty-four (44) foot setback is greater than most other
structures within the neighborhood.
3) Additional living area and storage space is required by the
applicant.
4) The proposed garage represents a minimum size addition.
5) The addition is supported by the neighbors, they believe that
this will enhance the character of the area.
6) Lot was pre-existing, small lot set-off prior to zoning
bylaws.
Based upon the findings and conclusion setforth above, the Zoning
Board of Adjustment hereby grants the applicant's request to
construct a 15'x 30' at
