HomeMy WebLinkAboutSD-03-31 SD-03-32 - Decision - 0000 National Guard Avenue#SD-03-31 #SO-03-32 FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, re -approval of preliminary plat application #SD-03-31 and final plat application #SD-03-32 of Winooski Valley Park District (WVPD) to subdivide 67.4 acres of land into two (2) lots, 20.1 acres to be conveyed to the WVPD, National Guard Avenue. On the 21 st day of October, 2003, the South Burlington Development Review Board approved the request for Winooski Valley Park District for preliminary plat approval under Section 15.08 (B) (3) and final plat approval under Section 15.08 (E) (2) of the South Burlington Land Development Regulations based on the following findings: 1. This project consists of subdividing 67.4 acres of land into two (2) lots; 20.1 acres are to be conveyed to the Winooski Valley Park District (WVPD). The sketch plan was reviewed on May 21, 2002. A six (6) month extension to file the preliminary plat application was granted on 1/7/03. 2. This property located on National Guard Avenue lies within the I-C District, and the Floodplain Overlay District. It is bounded on the north by the Winooski River, on the east by Muddy Brook, on the south by National Guard Avenue, and on the west by National Guard Avenue and single-family residences. 3. The owner of record of this property is Shelburne Shipyard, Inc. 4. Access: No access proposed. 5. Lot size/frontage: Both lots to be conveyed to WVPD meet the minimum lot size requirement of 40,000 sq. ft. 6. There are no minimum frontage requirements. 7. Setbacks/coverage: There are no buildings on the property, so there are no issues with setbacks or coverage. 8. Floodplain District: A portion of this property is located in the Floodplain Overlay District. The boundaries of this district are shown on the plat. DECISION Based on the above Findings of Fact, the South Burlington Development Review Board approves preliminary plat application #SD-03-31 and final plat application #SD-03-32 of Winooski Valley Park District (WVPD) to subdivide 67.4 acres of land into two (2) lots, 20.1 acres to be conveyed to the WVPD, National Guard Avenue, as depicted on a two (2) page set of plans, page one (1) entitled, "Boundary Survey Land to be conveyed from: Shelburne Shipyard, Incorporated (formerly The Griswold Corporation) to: Winooski Valley Park District National Guard Avenue South Burlington, Vermont.", prepared by Krebs & Lansing Consulting Engineers, Inc., dated April 4, 2003, last revised on 6/16/03, subject to the following stipulations: 1. All previous approvals and stipulations, which are not superseded by this approval shall remain in effect. 2. Any changes to the final plat plan shall require approval of the South Burlington Development Review Board. 3. The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format of the digital information shall require approval of the Director of Planning & Zoning.
