Consider request to rezone the Garvey and Russell/Sawyer lots on Williston
Road, W. Bradney Griffin
Mr. Griffin said the Garvey lot was owned by Accent Travel and that they
had options on the Russell and Sawyer lots. Accent would like to purchase
those lots and erect a professional building on the land. lie said the area
was zoned R4 but that to the east of the lots it is zoned commercial. He
added that many of the sites to the west were now in commercial use - Merriam
Graves, NCR, etc. Accent Travel would like to build something in keeping
with the residential character of the neighborhood.
Mr. Poger pointed out that the Commission had been discussing some kind
of transitional zone for a buffer area between commercial and residential,
but there was as of now no such zone.
Mr. Griffin noted that across Williston Road from this land was also zoned
commercial. To the north is city park land. He noted that the lots in question
only abutted one residence and he did not object to the plans.
Mrs. Maher asked the total square footage of the lots and was told it
was 60,000.
Mr. Eddy of Accent Travel said they needed larger quarters. They want
to erect a building larger than they need, and rent out space to accountants,
real estate agents, etc. They want a professional office building - no high
traffic uses. They now have 2-3 cars per hour for their business. Mr. Eddy
said he was thinking of an 18,000 sq. ft. two-story building, but was told
that he might not be allowed that much space, due to traffic constraints. Ms.
Bechtel will work on the formula in the ordinance and come up with a number.
Mr. Dooley wanted to know a number before the final vote, on what the ordinance
would allow.
Mr. Poger warned the applicants that this review might take a while. He
also said that if a new zone were set up, he would like to be able to insist
that the buildings have a residential look to them, via some wording in the zoning.
It was decided to schedule an informal discussion of this for the next meeting.
Consider application of Federal Express for a temporary trailer for office
use at Burlington International Airport, Air National Guard Road
Mr. Steve Franks said they wanted to use a 10' x 40' trailer for storage,
office use and computer center. Two people will work there. He said it would
be more than a temporary trailer. It will remain until the maintenance operation
is pulled out, which could be 1-2 years, or it might be as long as 5-6 years.
They are currently working out of an 8' x 10' space in another building.
One plane will layover here, although there are provisions for two, if needed.
They will use a holding tank for sewage and there will be no running
water in the trailer.
Mrs. Maher felt the Commission did not need to require landscaping in this
case.
Mr. Poger asked if approval for 24 months was a reasonable time limit and
Mr. Franks said it was. He was told he could request an extension after that time.
Mr. Dooley moved that the South Burlington Planning Commission approve.

1) Minutes of 10/9/84.
2) Zoning Amendments: Please see other memo on proposed amendments
to the Zoning Regulations. All items have been warned as previously
discussed by the Planning Commission except for the minimum lot
size section. The R-2 and R-4 two-family lot sizes were warned as
presented here. Other changes to the minimum lot size section have
not been warned, (such as density). I would like to discuss this a
bit further to clarify the Commission's intent, and it can all be
rewarned if the Commission desires.
3) Attorney W. Bradney Griffin will present his arguments for
rezoning the Garvey and Russell/Sawyer lots on Williston Road
for commercial purposes. I have explained the Commission's earlier
discussions on this and your interest in creating a new "transitional"
zone that also may apply to this area.
we are working on language for commercial zoning that allows a
limited number of commercial uses in areas that are within a stated
distance of a residential area. For example,"commercial lots that
abut or are within 250 feet of any residential district shall be
limited to the uses in 11.101 and 11.102."
This language would allow a large number of low to moderate traffic
generating uses (see section 11.101 and 11.102). The areas under
discussion on Dorset Street and Williston Road could then be re-
zoned to commercial if this change is also made. The Commission
should discuss this concept as well as the specific permitted uses.
This method will still permit all the C-1 uses in areas that do not
abut residential areas.
4) / EDERAL EXPRESS TXMPORARY TRAILER, 870 AIR NATIONAL GUARD ROAD
The i proposes to locate a temporary trailer by the Service
Road between the runway and the Emery building. It will serve as
a dispatch office for aircraft maintenance. A new area measuring
110'x25' will be paved up to the runway.
Under section 19.60 of the Zoning Regulations, temporary uses must
comply with the same traffic, parking, landscaping and sign stand-
ards as permanent uses. I question the strict application of these
requirements in this case; nevertheless my comments are as follows:

Circulation Parking and Access
Access is provided through the Service Road and a gate. New pave-
ment will be installed up to the runway, north of the trailer.
Two parking spaces are provided by the Emery/FEC office building.
Landscaping: Plantings or temporary planters should be placed
around the trailer, at a value of $200.
5) FASSETTS BAKERY, 3 LOT SUBDIVISION, SHELBURNE ROAD
The applicant proposes 2 revisions to the Final Plat approved on
September 11, 1984. This has been rewarned as a public hearing.
1) The depth of the lots has increased from 200 feet to 270 feet
to increase the useable area on each lot particularly lot 3 which
is divided by a ravine.
2) Lots 2 and 3 were approved with a shared driveway located di-
rectly across from Harbor View Road. Upon further investigation,
engineers learned that a utility pole that was to be relocated,
serves as a major trunk line and transformer. Relocation costs
exceed $20,000. The applicant prefers to move the driveway
rather than the pole.
Several issues arise:
1) The driveway was to be built directly across from Harbor View
Road to reduce the danger of conflicting turns. A high traffic
generator on lot 2 or 3 would be a problem and may have at some
point require a signal although none is warranted or planned now.
We now know that the proposed use of lot #3 is for a thrift store
for Fassetts Bakery and two other retail uses (see next agenda
item).
The fact that this is just a driveway and not a road serving
numerous lots makes it less urgent that the driveway align with
Harbor View Road. However, it appears more reasonable to have a
shared driveway between lot 2 and 3 on the lot line, rather than
offsetting it 13 feet to accommodate the telephone pole.
The sewer allocation is still 1500 gpd for the 3 lots, and all
approvals are on the waiting list.
6) FASSETTS BAKERY, LOT #3, SHELBURNE ROAD
The applicant proposes to construct a 5000 square foot building
for retail use. The tenants will be the Fassetts Thrift Store

1. I recommend an inlet and storm drain pipe along the westerly line
to intercept drainage from the three lots and piped to brook. This is
to prevent runoff down a steep bank and onto the bakery parking lot.
7) GREGORY AND DAUGHTERS Lot #1
1. The entrance drive shall have uniform radii on both sides of street
intersections.'
2. The developer of original sub -division shall furnish bond for
completion of the street and utilities prior to permit.
