Galbraith, hereafter referred to as the applicant, is seeking conditional use approval under Section 14.10, Conditional Use Review, of the South Burlington Land Development Regulations to construct a retaining wall approximately 16' x 97' at 68 Bartlett Bay, along Lake Champlain. Associate Planner Cathyann LaRose and Administrative Officer Ray Belair, referred to herein as Staff, have reviewed the plans submitted on June 7, 2004 and have the following comments. CONDITIONAL USE CRITERIA Pursuant to Section 14.10(E) of the Land Development Regulations, the proposed conditional use shall meet the following standards: The proposed use, in its location and operation, shall be consistent with the planned character of the area as dehned by the City of South Burlington Comprehensive Plan. Staff does not feel that the proposed project is in conflict with the planned character of the area, as defined by the Comprehensive Plan. The proposed use shall conform to the stated purpose of the district in which the proposed use is located. According to Section 4.03(A) of the Land Development Regulations, the Lakeshore district is designed to promote the area's historic development pattern of smaller lots and minimal setbacks. The district encourages the conversion of seasonal homes to year round residences. The proposed retaining wall will not affect the stated purpose of the Lakeshore District. The Development Review Board must find that the proposed uses will not adversely affect the following: (a) The capacity of existing or planned municipal or educational facilities. In a memo dated 6/9/05 (attached), the City Engineer noted that the applicant's plan was acceptable. (b) The essential character of the neighborhood or district in which the property is located, nor ability to develop adjacent property for appropriate uses Staff feels that the proposal does not adversely affect the character of the neighborhood. (c) Traffic on roads and highways in the vicinity. The proposed addition will not affect traffic in the vicinity. (d) Bylaws in effect. K t The proposed retaining wall shall adhere to Section 12(D)(2) of the South Burlington Land Development Regulations, governing all lands within one hundred fifty feet horizontal distance of the high water elevation of Lake Champlain. The reconstruction of pre-existing structures may be approved by the DRB as a conditional use provided the requirements of the underlying zoning district and the following standards are met: (a) The structure to be expanded or reconstructed was originally constructed on or before April24, 2000. The proposed retaining wall meets this criterion. (b) The expanded or reconstructed structure does not extend any closer to the applicable high water elevation than the closest point of the existing structure. The proposed retaining wall meets this criterion. (c) The total building footprint area of the expanded or reconstructed structure shall not be more than fifty percent larger than the footprint of the structure lawfully existing on April24, 2000. The proposed retaining wall meets this criterion. (d) An erosion control plan for construction must be submitted by a licensed engineer detailing controls that will be put in place during construction or expansion to protect the associated surface wafter. The plan submitted by the applicant was designed by a professional landscaping firm and does not detail the erosion control plans. The regulations require that a licensed engineer detail the erosion controls. 1. Prior to issuance of the zoning permit, an erosion control plan for construction must be submitted by a licensed engineer detailing controls that will be put in place during construction to protect the associated surface water. (e) A landscaping plan showing plans to preserve, maintain, and supplement existing trees and ground cover vegetation is submitted and the DRB finds that the overall plan will provide a visual and vegetative buffer for the lake. Staff feels that this criterion is being met. The proposed retaining wall shall also adhere to Section 12(D)(3) of the South Burlington Land Development Regulations, governing water -oriented development. (a) The improvement involves, to the greatest extent possible, the use of natural materials such as wood and stone. The applicant has proposed a retaining wall composed of concrete blocks with the look of stone. The actual materials are not in compliance with the criterion, but staff feels that their appearance is in keeping with the goal of the criterion. The Development Review Board should discuss the proposed materials, with the knowledge that such approval may set a precedent. 3 (b) The improvement will not increase the potential for erosion. Staff feels that, when construction is complete, the proposed retaining wall will actually deter erosion better than the existing retaining wall. (c) The improvement will not have an undue adverse impact on the aesthetic integrity of the Lakeshore. The proposed retaining wall is more aesthetically pleasing than the existing retaining wall (d) A landscaping plan showing plans to preserve, maintain, and supplement existing trees and ground cover vegetation is submitted and the DRB finds that the overall plan will provide a visual and vegetative buffer for the lake. Staff feels that this criterion is being met. Pursuant to Section 3.13(F) of the Land Development Regulations, the proposed conditional use shall meet the following standards: The Development Review Board in granting conditional use approval may impose conditions of the following: a) Size and construction of structures, quantities of materials, storage locations, handling of materials, and hours of operations. b) Warning systems, fire controls, and other safeguards. c) Provision for continuous monitoring and reporting. d) Other restrictions as may be necessary to protect public health and safety. Staff does not feel it is necessary to impose any of these conditions on the proposed project. RECOMMENDATION Staff recommends that the Development Review Board approve Conditional Use application #CU- 05-11 subject to the numbered conditions above. Request is to he exempt from the requirement that an in -ground swimming pool be completely enclosed by a wall, fence or other substantial structure not less than four feet in height, 1397 Spear Street: Mr. Dinklage said that the applicants had not met the criteria for a variance, and he suggested they speak with Ms. Hinds. He also noted the Board is not familiar with the technology the Fitzgeralds have described and suggested they present these to the Planning Commission and see if they will consider a change in the ordinance. Ms. Hinds said there are concerns regarding insurance, case law, etc. Mr. Kupferman then moved to approve application #VR-05-02 of Andrew & Carolyn Fitzgerald. Ms. Quimby seconded. Motion failed 0-6. DEVELOPMENT REVIEW BOARD 5 JULY 2005 Mr. Belair expressed concern with a non -natural product that might set a precedent. Ms. Hinds said "textured concrete" is allowed in the Sign Ordinance regulations and could be considered a marble product. Mr. Belair said they will also need an erosion control plan proposed by an engineer. Mr. Galbraith said Steve Vock will do this. He asked the Board for approval contingent on this. The approval motion was amended as follows: #2. the following wording was added after the word "completed": " using the proposed textured block wall system... #3. the following wording was added at the end of the stipulations: "..and approved by the Stormwater Superintendent." Belair Department of Planning 8s Zoning City of South Burlington 575 Dorset Street South Burlington, VT 05403 Dear Ray: I apologize for the delay in responding to your request for a letter from a certified arborist concerning the removal of pine trees from my property and my neighbor Mark Kelley's property. I was hoping that Tree Works in Montpelier was going to provide the letter, but at this point I am not certain they will. Their certified arborist is out of State now, and he will consider a letter that clearly states that his response is based upon pictures and a history provided by me and not based upon having seen the trees before they were removed. This is the information that I provided to Tree Works: Prior to removal of 7 pine trees, we consulted Jim Meyer at D.J. Tree (655-0264) and Terry Hall at Chittenden County Tree Service (658- 2212)and received similar opinions from both concerning the health of these trees: Pine trees have a shorter life span in the Vermont lake -side environment than in other parts of the country because of the relatively short growing season. These trees were on the edge of Shelburne Bay of Lake Champlain. 2. The pines were estimated to be between 70 to 90 years old and nearing the end of their life span given the existing environmental circumstances and the condition of these specific trees 3. Some of the trees were deemed to be at risk of being blown onto our house or one of our neighbor's houses. "It was just a matter of time" according to those we consulted 4. Over the past 24 months several large limbs have fallen from a number of these trees. Fortunately there were no injuries or significant damage except to a fence and slates on the ground 5. A number of years ago, a large limb from one of these trees fell on our house, went through the roof and into the kitchen 6. During the recent excavation for the construction of a retaining wall it was clear that there were no roots going from any of the trees toward the west. Prior to construction each tree was on the edge of the disintegrating bank. This is the bank that was being reinforced with a new retaining wall. The only roots were those on the east side of each tree 7. We were told that the weight of the equipment and the vibration from the equipment used to replace the rotting retaining wall caused additional damage to the roots of the pine trees. A large and a small tracked vehicle were used almost daily for 3 months 8. Both tree services noted a number of places where the pine trees had been hit by the equipment and according to them, potentially causing damage (see pictures that are enclosed 9. After the trees were cut down, substantial rot was noted in some of them (see pictures) 10. Both Tree Services tell us that they have removed many pines along the Lake for similar reasons 11. Our understanding of Vermont insurance is that if my tree falls on your house, your insurance covers it; however, if I knew that my tree was diseased or damaged, I would be liable for damage and injuries 12. The pine trees were, to some extent, serving as erosion control; however, the new retaining wall restores significantly more erosion control for that same area and more I will contact you as soon as I hear from Tree Works and look into getting another certified arborist if necessary. I have made numerous attempts to save these trees including consultations with a number of tree companies, extensive fertilization and consultations with Craig Lambert. Mr. Lambert is in agreement that the Oak tree closest to the Lake will continue to deteriorate. It lost 20 to 30% of it's limbs last year and this year another 20-25% of the limbs have died. Mr. Lambert also agrees that the Oak closest to the house is at significant risk because of the construction that was done in 2005 to replace our retaining wall. During that construction project most of the roots on the west side of the tree were severed and not treated appropriately.
