Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the follow: FINDINGS OF FACT 1. The applicant is seeking approval for a boundary line adjustment between 60 Moss Glen Lane and 23 Mill Pond Lane. 2. The owners of record of the subject properties are Russell & Anita Shapiro. 3. The subject property is located in the SEQ Zoning District. 4. The application was received on November 8, 2010. 5. The plan submitted is entitled, "Minor Lot Line Adjustment Plan Lots 70 & 83," plan prepared by Dubois & King Inc. on 10/21/2010. Rear Setback 30 N/A N/A � Zoning Compliance i # AD-10-01 PURSUANT TO SECTION 15.19(B) OF THE LAND DEVELOPMENT REGULATIONS: 6. NO NEW LOTS ARE CREATED THROUGH THIS ADJUSTMENT. The boundary line adjustment between 60 Moss Glen Lane and 23 Mill Pond Lane does not result in the creation of any new lots. 7. THE SALE OR EXCHANGE OF PARCELS OF LAND IS BETWEEN ADJACENT PROPERTY OWNERS. The lot line is between adjacent property owners. 8. THE RELOCATION OF THE LOT -LINE DOES NOT RESULT IN THE CREATION OF A NON -CONFORMING LOT, STRUCTURE OR USE. Lots are in conformance with the City of South Burlington Land Development Regulations, Article 15 Subdivision and Planned Unit Development, Section 15.19 Minor Lot Line Adjustments. 9. THE PROPOSED CHANGE DOES NOT VIOLATE ANY CONDITIONS IMPOSED FROM PRIOR MUNICIPAL APPROVAL. This lot line adjustment does not violate any conditions of prior approval. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves a Minor Lot Line Adjustment Application #AD-10-01 of Russell & Anita Shapiro, for a boundary line adjustment between 60 Moss Glen Lane and 23 Mill Pond Lane. 1. All previous municipal approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. The plan shall be revised to show the changes below and shall require approval of the Administrative Officer. Three (3) copies of the approved revised plan shall be submitted to the Administrative Officer prior to recording. a. Amend the, "Minor Lot Line Adjustment Plan Lots 70 & 80," plan so that lot 83's parcel reads 1185-00023 not 1195-00023. 4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 1 # AD-10-01 5. The final plat plan shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Administrative Officer prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format of the digital information shall require approval of the South Burlington GIS Coordinator. 6. Any change to the plat plan shall require approval by the South Burlington Development Review Board or the Administrative Officer. Signed on this �3 day of N , 2010 by on .
