HomeMy WebLinkAboutVR-97-0000 - Decision - 0068 Bartlett Bay RoadSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 23rd day of June, 1997, the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Harvey Butterfield and Deborah Galbraith of 68 Bartlett Bay Road. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: 1) 2) 3) 4) 5) 6) I ) 2) Findings of Fact Area zoned R-1 District and Conversation Open Space District. Section 3.10 Boundaries of C.O. District is defined as a 150 foot horizonal distance from high water level (elevation 102.5 feet). Parcel #1, 68 Bartlett Bay Road contains 60 feet of frontage and 136 feet of depth, therefore, is located within the Conservation/Open Space District. Parcel #2, across the street (east side) contains 651x 1001 and is located within the R-1 District. The proposed addition and relocation of the existing patio is deemed "new consruction" and is considered as an alteration to a non -complying structures. The applicant is proposing to relocate the existing patio and replace with a 71x 151 (2 story) deck. A 16'x 281 addition over one-third of the dwelling is proposed. Conclusion The Butterfield's purchased the property in 1973 and have not altered the property or change the structure. The structure has a setback from Lake Champlain of 44 feet, the proposed alteration will not change the setback from the lake. 1 I 3) The architectural design of the proposed addition is in keeping with the general character of the area. 4) The structure was built in 1945 prior to zoning by-laws. 5) No possibility to expand or improve the property within the current regulations. 6) Change in zoning by-laws has made all structures on the west side of the lake non -conforming. Based upon the findings and conclusion setforth above, the Zoning Board of Adjustment hereby grants the applicant's request to construct a 71x 151 patio and 16'x 28' second story addition to a single fmaily dwelling located at 68 Bartlett Bay Road.
