Consent Agenda: a. Design Review Application #DR-00-18 — Siding, Roof & Door Alterations — John Kennedy, 340 Dorset Street: This project consists of a design review application submitted by John Kennedy, agent for Edgar Welch, to amend a previously approved planned unit development consisting of. 1) 12,980 sq. ft. building used for retail use, 2) a 1,800 sq. ft. building used for retail use, 3) 1,800 sq. ft. accessory structure, and 4) one residential unit on the second floor of the 12,980 sq. ft. building, 338 & 340 Dorset St. The amendment consists of. 1) replacing the siding of the 1,800 sq. ft. building used for retail use with vinyl siding, 2) painting the roof of the 1,800 sq. ft. building used for retail use, and 3) revising entrance on the south fagade of the 1,800 sq. ft. building used for retail use, 338 Dorset Street. b. Design Review Application #DR-00-21— Window & Door Alterations — South Burlington Realty Company, 368 Dorset St: This project consists of a design review application of South Burlington Realty Company to amend a previously approved planned unit development. The amendment consists of 1) altering the window locations on the south and north facades of the 8,944 sq. ft. building at 368 Dorset Street, 2) removing the northern most door on the west faVade of the 8,944 sq. ft. building at 368 Dorset Street and replacing it with glass, 3) altering the entrance ways on the north and south facades of the 8,944 sq. ft. building at 368 Dorset Street to include triangular pediments instead of the previously approved segmental pediments, 4) removing the door on the east fagade of the 8,944 sq. ft. building and replacing it with glass, 5) the replacement of the balcony railing on the west faVade with vertical shiplap siding, and 6) replacing the wooden shingles on the 8,944 sq. ft. building with vinyl shakes at 368 Dorset St. Ms. Quimby moved to approve the consent agenda subject to the stipulations in the staff memorandum of 1 September 2000. Mr. Cameron seconded. Motion passed unanimously. 5. Public Hearing: Application MS-00-03 of Kathryn and Patrick Flynn for approval under Section 25.118 of the South Burlington Zoning Regulations. Request is for permission to construct a 360 sq ft. addition to project eight feet into the 10 foot side yard setback requirement and to project 15 feet into the 30 foot front yard setback requirement, 34 Myers Court: 2 DEVELOPMENT REVIEW BOARD 5 SEPTEMBER 2000 Ms. Flynn explained that her father moved into the h; s and because of his disability, they wanted to make it more accessible to him. The addition would allow for an enclosed lift. Ms. Flynn said they have signed statements from 5 neighbors clos,, to hem that they don't object to this. Ms. Flynn also noted they had originally thought of a ramp, but it would have had to be quite length and wrap around because of the high stairs. Mr. Dinklage said that the new ordinance was not intended to allow further encroachment into setbacks. Mr. Schmitt said he would approve it if it weren't encroaching further into the setback or if there were other homes on that side of the road with similar situations already existing. Mr. Belair said that the ordinance was made to allow people to come forward to where adjacent homes are. They can be allowed to come further if they meet certain criteria, one of which is that it would fit the character of the area. Staff felt this proposal did not. Mr. Dinklage noted this is not a temporary solution to an access problem. He suggested the Flynns find a temporary solution, something that can be removed when the person no longer lives in the house. He felt that what is now being proposed is a permanent alteration that enlarges the house significantly. Mr. Flynn asked about a lift out front. Mr. Dinklage suggested discussing this with staff. Mr. Cameron noted that a ramp can be dangerous in Vermont because of ice and snow. He felt a life was a good idea. A poll of members showed that a majority would vote against the application. Staff asked for a continuance to allow for drafting of an appropriate motion. Mr. Farley moved to continue the application until 19 September. Mr. Boucher seconded. Motion passed unanimously. 6. Application #MS-00-05 of Faucet Builders, Inc, under Section 25.117 of the South Burlington Zoning Regulations for the alteration of the existing grade. This project consists of adding 96 cubic yards of fill material on an existing residential lot for the construction of a single family dwelling, 1397 Spear Street: Ms. Quimby stepped down due to a conflict of interest. Mr. Faucet said they had built the home next to the entrance to Stonehenge. It will be about 39 ft. high (there is a 40 ft. limit). Enclosed are staff 5/16/00 memo for your review. Counsel's opinion was included in the September 5 h memo package. 4) CONTINUED - KATHY & PATRICK FLYNN - MISCELLANEOUS APPLICATION — WORKSHOP & PORCH LIFT, 34 MYERS COURT This project was continued from the September 5, 2000 Development Review Board meeting to allow staff time to prepare a denial decision (memo enclosed). The applicants have altered the plans and now only propose to construct a 10 feet 8 inches by 16 feet 7 inches addition for the purpose of installing a handicapped accessible lift under Section 25.118 of the South Burlington Zoning Regulations. The proposed addition will project seven feet into the 10 foot side yard setback requirement and to project 11 feet into the 30 foot front yard setback requirement, 34 Myers Court. The revised plan results in the proposed addition for handicapped accessibility extending 11 inches closer to the front property line than the present porch area. Section 25.118 is a new addition to the Zoning Regulations that provides exceptions to yard setback and coverage requirements for lots in existence prior to February 28, 1974 that are primarily a single family or two-family residence. This property at 34 Myers Court is located in the Residential Four District. It is bounded on the west by Myers Court, on the north by a single family residence, on the east by a single family residence, and on the south by a single family residence. This property is one of the closest to the street in the immediate neighborhood as it currently exists. Criteria of Section 25.118 (a): The applicant has prepared a short report addressing the criteria for side yard encroachment (see enclosed). The applicant has submitted floor plans depicting that the encroachment as within five (5) feet to the side yard property line. These plans are inaccurate and should be revised. Criteria of Section 25.118 (c): This section provides for encroachment of a structure to within three feet of the side yard property line provided that the encroachment will not have an undue adverse affect on: (i) views of adjoining and/or nearby properties (ii) access to sunlight of adjoining and/or nearby properties Development Review Board September 19, 2000 (iii) adequate on -site parking; and (iv) safety of adjoining and/or nearby property The applicant has submitted a report addressing these criteria (please see enclosed). It is staff s recommendation that the side yard encroachment will not have an adverse affect. The existing structure projects ten feet into the front yard setback. The applicant has proposed encroaching an additional foot into the front yard setback for an overall encroachment of 11 feet. It is staff s position that the proposed encroachment is acceptable. While staff would normally recommend against further encroachment into the front yard setback in which the proposed encroachment is not similar to any other structure in the neighborhood, the proposed project is for an enclosed accessible lift which will expand the least amount possible into the front yard setback. An accessible ramp would be exempt from front yard setbacks, and staff believes that a lift that is incorporated into the fabric of the existing building would pose less of an effect on the neighborhood than a ramp. Criteria of Section 25.118 (e). This section provides for encroachment of a structure to within less than ten (10) feet from the property line provided survey data from a licensed surveyor showing the location of affected property lines, existing and/or proposed structures, and any other information deemed necessary by the Administrative Officer is provided. A survey plat of the property has been provided. 5) CONTINUED - BARRETT — SITE PLAN — TRAILER & ACCESS DRIVE, 6 LIME ROCK ROAD This project was continued from the September 5, 2000 Development Review Board meeting at the request of the applicant (memo enclosed). The applicant is working with a surveyor to delineate the floodplain and may present new information on the location of the floodplain at the meeting. 6) HENRY & SHERRY BARTON — MISCELLANOUS APPLICATION — DECK ADDITION, 2 SHERRY ROAD The applicants are seeking approval under Section 25.118 of the South Burlington Zoning Regulations to legitimize a 10 foot by 12 foot deck addition that was constructed last year without a permit that projects 10 feet into the 30 foot front yard setback requirement, 2 Sherry Road. Since this encroachment is more than average, the project must be reviewed under Section 25.118(c) of the Zoning Regulations. Section 25.118 is a new addition to the Zoning Regulations that provides exceptions to yard setback and coverage requirements for lots in existence prior to February 28, 1974 that are primarily a single family or two-family residence. This property at 2 Sherry Road is a corner lot located in the Residential Four District. Belair, Administrative Officer RJB/mcp Encls MEMORANDUM TO: SOUTH BURLINGTON ZONING BOARD FROM: PATRICK & KATHRYN FLYNN/ WORKHORSE CONSTRUCTION SUBJECT: BUILDING PERMIT — 2ND APPEAL DATE: 9/13/00 We would like to re -appeal for a building permit based upon making changes that we feel will satisfy the concerns voiced by the zoning board. Basically, we have eliminated the larger addition from our original proposal. The structure that we are now proposing is simply to build a lift with a new entryway. Attached floor plans reflect that we should now be close to compliance with existing ordinances. Specifically, the new structure will be 5 feet from the side property line, 291" from the front property line and 397' to the middle of the street. The existing structure is 8'9" from the side property line, 30' from the front property line and 40'6" to the center of the street. So, basically we are proposing to extend out only 3'9" closer to the side property line; and 11" (inches) farther to the front property line and center of street. All of these dimensions include the dimensions of the stairs as Sara in the zoning office said this would be relevant. We would also like to point out that the neighbors across the street are exceedingly close to their side property lines. Specifically, Dorothy Vigil's garage at 35 Myers Court is only 5'8" to her sideline and Ruby and Wayne Gibson's garage is a mere 3'6" to their side property line. In fact, the two garages sit only 9'4" apart from one another. We hope this new proposal meets with your approval. The City Center Design Review Committee reviewed this proposal at their 8/28/00 meeting. The Design Review Committee recommends that the Board approve the application with the following stipulations: 1. This recommendation for approval of the proposed addition is based on the application's compliance with the design review criteria contained in Section 24 of the South Burlington Zoning Ordinance. The determination of whether or not this application complies with all other requirements contained in the zoning ordinance shall be made by the Code Officer. 2. The applicant has submitted floor plans depicting that the encroachment will not be closer than five (5) feet to the side yard property line. Criteria of Section 25.118 (b): One of the requirements of this criteria is that a structure may encroach into a required front yard setback up to the average front yard setback of principal structures on adjacent lots on the same street frontage. Since the applicant is proposing to exceed the average front yard setback, the conditions of Section 25.118(c) must be met for front yard encroachment. Criteria of Section 25.118 (c): This section provides for encroachment of a structure to within three feet of the side yard property line provided that the encroachment will not have an undue adverse affect on: (i) views of adjoining and/or nearby properties (ii) access to sunlight of adjoining and/or nearby properties (iii) adequate on -site parking; and (iv) safety of adjoining and/or nearby property The applicant has submitted a report addressing these criteria (please see enclosed). It is staff's recommendation that the side yard encroachment will not have an adverse affect. It is staff s position that the front yard encroachments will not meet these criteria and will have an adverse effect on other properties or the character of the neighborhood. The structure which currently exists on the property has one of the smallest front yard setbacks on Myers Court. The addition will create a noticeable intrusion into the front yard area that is not comparable to any other structures on the street. Staff recommends that the structure not be allowed to further intrude into the front yard setback as the proposed project does not meet the criteria of the Zoning Regulations. It was not the intended purpose of these Regulations to create incompatible situations but to allow structures to become more compatible with existing structures within neighborhoods. 4 DEVELOPMENT REVIEW BOARD MEMO SEPTEMBER 5, 2000 MEETING View of 34 Myers Court looking northeast from street. A survey plat of the property has been provided. 6) FAUCETT BUILDERS, INC. — MISCELLANEOUS APPLICATION — ALTERATION OF EXISTING GRADE,1397 SPEAR STREET This project consists of adding 96 cubic yards of fill material on an existing residential lot for the construction of a single family dwelling, 1397 Spear Street. The applicant has submitted a site plan depicting the existing and proposed grades. The property is located in both the Residential One and Residential Four Districts. The project area lies completely within the Residential One District. It is bounded on the east by Spear Street, on the south and west by the lands of the Stonehedge Homeowners Association, and on the north by a single family residence. Section 25.117 Requirements: The proposed filling will exceed twenty (20) cubic yards and therefore must comply with the standards of Section 25.113(b) referenced in Section 25.117(a) of the Zoning Ordinance: (a) The project must utilize topography and must relate to other existing and proposed structure must be aesthetically compatible with the neighborhood. The filling must not extend to the property lines and must blend with the existing contours. The property owner to the north has submitted a letter to the City with drainage concerns (see enclosed). The applicant should not make existing stormwater runoff conditions worse. (b) The project must not detract from scenic views of adjacent properties or public walkways. The proposed grading must not exceed the elevations presently found on the site. The proposed structure must comply with the height requirements of Section 25.113(a) of the Zoning Ordinance. (c) The project should allow for retention of additional green space that will enhance the appearance of the developed property.
