On September 13, 1995, you were advised by this office that the
addition of a carport to your garage is subject to approval from
the Zoning Board of Adjustment. Your failure to cease
construction of the carport and secure the approvals and permits
necessary creates a zoning violation of Section 27.10 of the
South Burlington Zoning Regulations.
Pursuant to 24 V.S.A. Section 4444 you have seven (7) days in
which to cure this violation. In order to cure the violation,
you must file an application for a dimensional variance. If the
violation is not cured you will be subject to legal action and
fines of up to fifty ($50.00) dollars per day for each day the
violation continues.
If you do not agree with this "Notice of Violation" you may
appeal it to the Zoning Board of Adjustment in writing within
fifteen (15) days of today's date.
If you have any questions regarding this matter, please don't
hesitate to call me.

This letter will confirm our conversation regarding the addition
of a carport to your detached garage.
Be advised that a variance was granted to Leon Bundy on June 10,
1977 permitting construction of the garage to within two (2) feet
of the rear yard and eight (8) feet of the side yard. Enclosed
is a copy of the site plan which was submitted by Mr. Bundy. The
minimum dimensional requirement without a variance is thirty (30)
foot rear yard and ten (10) foot side yard. The garage in
question is a noncomplying structure and any alteration or
addition to a noncomplying structure is subject to review by the
Zoning Board of Adjustment.
Enclosed please find an application for a hearing before the
Zoning Board of Adjustment. Include along with the application a
revised site plan.
The Board meets on the 2nd and 4th Mondays monthly, the hearing
fee is fifty (50) dollars.
