HomeMy WebLinkAboutZB-96-0000 - Decision - 0035 Myers CourtSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 22nd day of January 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Art and Dorothy Vigil, 35 Myers Court. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: 1) The area in question is zoned R-4 District. 2) Section 25.00 requires a minimum rear yard of 30 feet and side yard of 10 feet. 3) The property is developed with a single family two story dwelling and a detached 22'x 24' garage. 4) The garage is under a 1977 zoning variance and is located to within 2 feet of the rear yard and 8 feet of the northerly side yard. 5) The proposed addition is a 22'x 22' attached carport to the garage maintaining to same setbacks. Conclusion 1) The location of the garage is nonconforming and the setbacks predate zoning. 2) Zoning Board of Adjustment granted dimensional waivers in 1977 to previous owners. 3) Attached carport does not encroach any greater than existing garage. 4) Large tree on southerly side of garage prevents adding a carport to the side. 5) Appellant did not create hardship, purchased property 21 years ago. 6) No objection from nearest neighbor affected by this proposal. 1 FEB 12 V% Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicants request to construct a 22'x 22' at ch d carpo t to within eight (8) feet of the northerly side yar at Mye��uir. i Chairma'h, `- - South Burlington Zoning Board of Adjustment 2 FE B 1 2 1996
