HomeMy WebLinkAboutZB-95-0000 - Decision - 0003 Mills AvenueSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 24th day of April, 1995 the South Burlington Zoning Board of Adjustment heard testimony regarding the appeal of Terrance and Carol Reynolds of 3 Mills Avenue. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The applicant is proposing to construct a 10'x 10' open porch which will replace existing 5' x 5' steps. 2) The required setback within the Residential 4 District is thirty (30) feet. 3) Existing setback is seventeen (17) feet which is non- conforming. 4) The proposed setback is twelve (12) feet. 5) The property is developed with a single family dwelling. Conclusions 1) The lot in question was set-off in the 1950's. 2) The average setback within the neighborhood is twenty (20) feet. 3) The existing steps are causing damage to the foundation and requires replacement. 4) The proposed deck will not encroach any greater than the existing walkway. 5) The general character of the area will not be affected by this proposal. Proposed porch will enhance the property. 6) Property has narrowness and shallowness which prevents construction of a porch in total compliance (lot size 79'x 90'). 1 7) A minimum variance which will not alter character of the area. Based upon the findings and conclusions setforth above, the Zoning Board of Adjustment hereby grants the applicants request to construct a 10'x 10' porc"oe f ront of the dwelling located at 3 Mills Avenue. / ' - .
