HomeMy WebLinkAboutZB-97-0000 - Decision - 0042 0044 Millham Court (2)ri STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the loth day of March, 1997, the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Louis and Janice Bouchard, 40-42 Millham Court. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question zoned R-4 District. 2) Section 25.00 Dimensional requirements provides for a minimum front yard of thirty feet and a side yard of ten feet. 3) The lot in question is irregular with 88 feet frontage and a total lot area of 11,790 square feet. 4 ) The existing set backs are twenty feet front yard and thirteen feet side yard. 5) The property is developed with a two family dwelling (24' x 63' wood frame building) and a 20' x 22' detached garage. 6) Proposed construction is a 12' x 30' enclosed porch to within one (1) foot of the southerly side yard. Conclusion 1) The applicant occupies one half of the duplex. On the side of the structure in question, the property drops -off to a brook, this area is undevelopable. 2) The applicant planned his porch in this location due to the pitch of the roof and for ease of construction. 3 ) The property in question is the last lot on a dead-end street. 4) The property is unique in design which creates a hardship. 1 5) Variance does not alter the character of the neighborhood. Adjoining property owners has no problems with proposed structure. Based upon the findings and conclusion setforth above, the Zoning Board of Adjustment hereby grants the applicant request to construct an enclosed porch to within seventeen (17) feet of the front yard and one (1)/ooJ of the southerly side yard located at 40-42 Millham Court.
