Mr. Richard Ward City of South Burlington 575 Dorset Street South Burlington, VT 05403 Re: Temporary Construction Trailers Dear Dick: OF COUNSEL ARTHUR W.CERNOSIA You have asked what procedures are applicable to the approval of temporary construction trailers that are placed on property in connection with approved construction activity. The use of such construction trailers is typically temporary since they are removed once construction activity is completed. Typically a construction trailer is located on property in connection with development activity that is approved under the South Burlington Zoning or Subdivision Regulations. Consequently, the location of the construction trailer on the site should be considered part of the development activity on the site even though it will only be temporary. For this reason, I recommend that approval for the location of construction trailers on a project site, and conditions regarding the location and removal such trailers, be set forth in the approval of the principal development activity. Section 19.60 of the South Burlington Zoning Regulations addresses temporary uses. The definition of temporary uses includes "temporary structures, temporary outside storage, special sales, peddlers, flea markets, mobile eaterys and other similar uses." Section 19.601. Viewing the standards of the zoning regulations regarding temporary uses, it is not clear that this section was intended to apply to construction trailers. We discussed the type of approval necessary prior to your installing the trailer. Since the provisions within the City zoning by-laws are unclear, (we will be making recommendations to the Planning Commission to amend those provisions), he is of the opinion that your proposal should be approved by the Planning Commission under amended final plat of the Oak Creek subdivision. Please contact the City Planner, Joe Weith if you plan on proceeding with this approval. HAFTER October 7, 1992 Mr. Richard Ward, Zoning Administrator City of South Burlington South Burlington, VT 05403 Re: City Council Comments on Zoning Board of Adjustment Agenda of October 19, 1992 Dear Dick: At the City Council meeting of October 5, 1992 the Council, as usual, reviewed the upcoming Zoning Board agenda. They have asked me to relay their feelings on two (2) items. On Item #1, the Council is very concerned on the request for a variance to sell used cars at 1333 Williston Road. Parking on the site is extremely limited. The City has recently stopped issuing peddler's licenses on this site due to a lack of parking. The Council requests that the Zoning Board look closely at this use and its impact on parking and traffic circulation on the property. On Item #3, a request to install a construction trailer on lot #93 Mill Pond Lane, the Council is concerned that the one-year maximum time frame be adhered to so that past problems with construction trailers not be repeated. Permission should clearly determine the time period of the allowed use. The Zoning Board will certainly consider the impact of this trailer on the the surrounding properties and insist on mitigation measures that are appropriate, such as screening. Thank you for your attention to these matters. I am available if you, or other Zoning Board members have any questions.
