CITY OF SOUTH BURLINGTON
RE: Findings of Fact, site plan application #SP-00-31 of Chase Properties to
amend a previously approved site plan to change the use of an existing one-story
single family dwelling currently in use for general office to a personal instruction
facility at 42 Airport Road, South Burlington.
Based on the applications, plans and supporting materials contained in the
document file for this application, the Administrative Officer finds, concludes and
decides as follows:
FINDINGS of FACT
1. The applicant has requested site plan approval for replacement of an
existing general office tenant in a single-family residence building on the lot at 30
- 42 Airport Road with a personal instruction facility serving 1-4 students.
2. The applicant has submitted plans entitled "Chase Properties &
Development, LTD, Airport Drive, S. Burlington VT, 05403, Site Plan," prepared
by Neagley & Chase Construction Company, and dated July 8, 2003.
3. The 42 Airport Road property contains 0.55 acres and is zoned
Commercial 1.
4. The subject property is approved for general office use with 24 spaces on a
gravel parking area associated with the 42 Airport Drive residential building
under review in this application.
CONCLUSIONS of LAW
Zoning District, Parking & Dimensional Requirements
Lot size, Coverage and Setbacks: All existing conditions are unchanged from the
previously approved site plan.
Parking: The plans show 24 spaces on a gravel parking area, with a sign
designating one handicapped parking space. The required parking for personal
instruction facility is 2 spaces per employee. The application indicates a
maximum of 4 employees, which would require 8 spaces. Therefore the parking
requirement is met.
FINDINGS of FACT and DECISION

Site Plan Standards
The application does not show any changes from the previously approved site
plan, other than the change of use of the existing single-family building to
personal instruction facility. The plan meets the City's general and specific
review standards for site plans, including such issues as fenced and screened
dumpsters (provided on the 3o Airport Road parcel) and a bike rack (provided at
42 Airport Road).
DECISION and CONDITIONS
Based upon review of the plans as submitted, the Administrative Officer approves
Site Plan application #SP-oy_f-31 of Chase Properties, subject to the following
conditions: "J
1. The plans must be revised to indicate a snow storage area one one or
both properties. Three full-size copies and one 11x17 must be
resubmitted and signed by the Administrative Officer or Director of
Planning & Zoning prior to issuance of a Zoning Permit.
2. All previous approvals and stipulations which are not superseded by
this approval shall remain in this effect.
3. The applicant shall obtain a zoning permit within six months of this
decision of this approval shall be null and void.

pursuant to 24 VSA §4472(d) (exclusivity of remedy; finality).
