FINDINGS OF FACT AND DECISION
Grandview Farm, Inc. is seeking miscellaneous after -the -fact approval to for after -the -fact approval to place

The Board held a public hearing on this application on October 7, 2014. David Marshall represented the
applicant.
Based on testimony provided at the above mentioned public hearing and the plans ands supporting materials
contained in the document file for this application, the Development Review Board, finds, concludes, and
decides the following:
FINDINGS OF FACT
1. Grandview Farm, Inc. is seeking miscellaneous after -the -fact approval to place 3,800 cubic yards of fill on an
undeveloped lot, 596 Meadowland Drive.
2. The owner of record of the subject property is Grandview Farm, Inc.
3. The subject property is located in the Industrial & Open Space Zoning District
4. The plan submitted consists of three (3) pages, page one is entitled "Neogley & Chase Construction Office
Facility Lot 5 Meadowland Business Park 66 Bowdoin Street South Burlington Vermont, Lot 3 — Overall Site
Plan," dated Aug. 20, 2014.
This application shall be reviewed under Section 12.02.E. Standards for Wetland Protection and Review
Procedures and Section 3.12 Alteration of Existing Grade of the Land Development Regulations.
Section 12.02. E. Standards for Wetland Protection Standards
(3) Encroachment into Class 11 wetland buffers, Class 111 wetlands and Class 111 wetland buffers, may
be permitted by the DRB_upon finding that the proposed project's overall development, erosion control,
stormwater treatment system, provisions for stream buffering, and landscaping plan achieve the
following standards for wetland protection:
(a) The encroachment(s) will not adversely affect the ability of the property to carry or store
flood waters adequately;
(b) The encroachment(s) will not adversely affect the ability of the proposed stormwater
treatment system to reduce sedimentation according to state standards;
(c) The impact of the encroachment(s) on the specific wetland functions and values identified in
the field delineation and wetland report is minimized and/or offset by appropriate landscaping,

stormwater treatment, stream buffering, and/or other mitigation measures.
The applicant submitted a report on October 15, 2014 (included in the packet) prepared by Oakledge
Environmental Services addressing the impact of the wetland encroachment of the soil stockpile. The report
concludes that the above standards for wetland protection have been met.
Section 3.12 Alteration of Existing Grade
The removal from land or the placing on land of fill, gravel, sand, loam, topsoil, or other similar material in
an amount equal to or greater than twenty (20) cubic yards, except when incidental to or in connection with
the construction of a structure on the same lot, shall require the approval of the Development Review Board.
The Development Review Board may grant such approval where such modification is requested in connection
with the approval of a site plan, planned unit development or subdivision plat. This section does not apply to
the removal of earth products in connection with a resource extraction operation.

Wetlands Report for Lot #3
Meadowlands Business Park
October 15, 2015
This report reviews and addresses the permanent placement of a soil stockpile on Lot 3
at the Meadowland Business Park, as it relates to the City of South Burlington's
Standards for Wetland Protection.
The soil stockpile was placed in an open field on an undeveloped lot, in the location
shown on the attached plan. A silt fence was installed around the soil stockpile to
prevent the movement of soil from the stockpile to the adjacent wetland and upland
field. In addition, the stockpile was seeded and mulched to stabilize stockpile soils.
The Town of South Burlington's Zoning Regulations outline the following Standards for
Wetland Protection:
(3) Encroachment into Class 11 wetland buffers, Class 111 wetlands and Class 111
wetland buffers, may be permitted by the DRB upon finding that the proposed
project's overall development, erosion control, stormwater treatment system,
provisions for stream buffering, and landscaping plan achieve the following
standards for wetland protection:
(a) The encroachment(s) will not adversely affect the ability of the
property to carry or store flood waters adequately;
(b) The encroachment(s) will not adversely affect the ability of the
proposed stormwater treatment system to reduce sedimentation according to
state standards;
(c) The impact of the encroachment(s) on the specific wetland functions
and values identified in the field delineation and wetland report is minimized
and/or offset by appropriate landscaping, stormwater treatment, stream
buffering, and/or other mitigation measures.
Oakledge Environmental Services, Inc. evaluated the project in October 2014 for
compliance with the municipal Standards for Wetland Protection. The evaluation
included a review of site plans and aerial photographs, a review of the project history
with David Marshall, P.E., the Project Engineer, and a field evaluation of the wetland
and stockpile disturbance footprint area. According to the Site Plan and a review of the
project history with the Project Engineer, the soil stockpile permanently impacted a
section of open field within the 50-foot buffer zone for the wetland. Approximately 2.5 —

4.0 feet of fill was placed in the location indicated on the Site Plan. The installation of
the silt fence along the east side of the stockpile resulted in approximately 1,575 SF of
temporary wetland impacts. The wetland is located in a broad topographic depression
that is relatively flat-bottomed and slightly lower in elevation than the surrounding land.
It is characterized by a mix of wet meadow vegetation and a patchwork of young, woody
shrubs and saplings dominated by relatively fast-growing species such as quaking
aspen and gray birch. The wetland is positioned to provide water storage for flood
water and storm runoff and to provide some amount of surface water treatment for
runoff that enters the shallow basin from the surrounding land. The wetland has a
history of human disturbance, including historical land clearing and rutting that is likely
associated with heavy equipment operation, and does not appear to be significant for
other wetland functions.
A. The installation of the soil stockpile did not "adversely affect the ability of the
property to carry or store flood water". The elongate stockpile created a graded
berm along the western side of the wetland, which may have increased the water
storage capacity of the shallow depression where the wetland is located. A
review of aerial photographs and the site visit uncovered no evidence that the
soil stockpile increased erosion or concentrated surface water in the field to the
west of the stockpile area, nor did its installation reduce the property's capacity to
store flood water and storm run-off
B. The installation of the soil stockpile did not "adversely affect the ability of the
proposed stormwater treatment system to reduce sedimentation according to
state standards". As noted, the stockpile was placed in an open, upland field
located outside of the topographically lower wetland to the east. The stockpile is
located on an undeveloped lot for which an individual stormwater treatment
system has not been completed. The entire Meadowlands Business Park,
however, benefits from a stormwater pond constructed on Lots 7,8, and 9, on the
north side of Meadowland Drive (see attached Site Plan). This stormwater pond
provides some of the peak flow management for the entire business park, so that
individual lots don't need to provide stand-alone peak flow management . The
discharges from the stormwater treatment systems on Lots 5 and 6, which have
been developed to the north of Lot 3, are routed northward, away from Lot 3. In
any case, the project did not impact future stormwater treatment capacity on Lot
3, nor did it impact current individual stormwater treatment systems on other
developed Lots or the stormwater treatment system for the overall Business
Park.
C. The project was designed to minimize encroachment(s) on significant wetland
functions and values. The stockpile is located in an open field vegetated with
meadowland grasses, and these conditions will also characterize the post -
development condition of the site. The soil stockpile did not cause an undue

adverse impact to any wetland functions or values. As discussed in Sections A
and B, the project did not reduce the wetland's water storage capacity for
floodwater or storm runoff , nor did it adversely impact the wetland's capacity to
provide surface water quality treatment.

South Burlington Development Review Board Meeting Participation Guidelines
The Development Review Board (DRB) presents these guidelines for the public attending Development Review Board meetings to
insure that everyone has a chance to speak and that meetings proceed smoothly.
The DRB is a Quasi -Judicial Board that oversees the approval of development projects within the City. It is made up of citizens
appointed by the City Council. The rote of the DRB is to hear and review applications for development under the applicable
regulations. The DRB can only approve applications, that comply with the applicable bylaw or state law, and the board can only levy
conditions that are permitted under the bylaw. By the same token, if a project meets the applicable bylaw criteria, the DRB is bound
by law to grant the approval.

loading of waters is a year-round challenge. In Vermont, this chatlenge
